FOR EXTENSION OF APPOINTMENT AS AUDIS ~ ~ = ~'

TO THE HONORABLE, THE JUDGES OF SAID COURT:

1. On August 28, 2012, Petitioner was appointed auditor in the Estate of Roberta
I. Konsko (hereinafter the "estate").
2. After security was deposited for the auditor's fees and expenses, the auditor
issued a directive on October 4, 2012, for prehearing memoranda from the parties.
3. As the parties were in the process of complying with the schedule for
prehearing memoranda, eleven more heirs of the estate, on November 8, 2012, are
seeking to join in the objections of the original objector, Martin Butler.
4. In the petition of joinder the additional heirs purported to appoint the said
Martin Butler as their pro se representative to advance their objections.
5. The auditor is not aware that the said Martin Butler is licensed to practice law
or otherwise has the legal right to represent the other heirs.
6. The questions of the timeliness of the joinders and other issues involving the
petition of joinder will complicate this case.
7. After issues involving the petition of joinder have been resolved and all
prehearing memoranda have been filed, the auditor will schedule a prehearing conference

in an effort to narrow the issues and explore any prospects of resolution of the objections
by agreement.
8. In the event that the objections cannot be resolved by agreement, a hearing will
be scheduled.
9. Petitioner would request extension of his appointment until June 28, 2013.
