1. The Appellant is Insite Development, LLC ("Insite "), a Pennsylvania Limited
Liability Company.

3. Insite is the owner of thirty-seven (37) parcels of real property identified in Plan
Book 93, Page 107 in and for the Cumberland County Recorder of Deeds. The
Tax Parcel Identification Numbers are: 10-14-0844-043, 10-14-0844-050, 10-14-
0844-051, 10-14-0844-052, 10-14-0844-053, 10-14-0844-054, 10-14-0844-056,
10-14-0844-057, 10-14-0844-058, 10-14-0844-059, 10-14-0844-060, 10-14-0844-
061, 10-14-0844-062, 10-14-0844-063, 10-14-0844-064, 10-14-0844-065, 10-14-
0844-066, 10-14-0844-067, 10-14-0844-069, 10-14-0844-070, 10-14-0844-072,
10-14-0844-073, 10-14-0844-074, 10-14-0844-075, 10-14-0844-076, 10-14-0844-
078, 10-14-0844-086, 10-14-0844-087, 10-14-0844-088, 10-14-0844-089, 10-14-

10-14-0844-099, 10-14-0844-101 (hereinafter referred to as the "Parcels").
4. The County of Cumberland, the municipality of Hampden Township and the
Cumberland Valley School District are the taxing bodies interested in the taxable
status of the Parcels.
5. This Appeal is brought pursuant to 72 P.S. §5020-518.1.
6. The assessments of the Parcels for local real estate tax purposes were fixed for the
2012 tax year as identified on Exhibit "A" (the "Assessments")
7. Insite (by its Managing Manager, Donald Erwin ("Erwin")), timely filed notice of
its intention to appeal the Assessment to the Board and a Hearing was held on
September 4, 2012.
8. Following the Hearing, Insite was informed by letters with a mailing date of
October 24, 2012, that the Board did not change the Assessments for any of the
Parcels. True and correct copies of such letters are attached hereto as Exhibit "B".
9. The Assessments for each of the Parcels as fixed by the Board is excessive,
improper, unjust and contrary to law for the following reasons:
a. The Assessments are excessive and not properly reflective of the fair
market value of the Parcels;
b. The Assessments lack uniformity;
c. The Assessments are discriminatory; and
d. The Assessments are otherwise unjust and inequitable.
WHEREFORE, the Appellant, Insite Development, LLC, requests that the Court review
and reduce the Assessment for the Parcels fixed for the taxable year 2012 and make such other
orders and decrees with respect thereto as shall be just and proper.

MOTION FOR CONTINUANCE
AND NOW, comes the Respondent/Appellee, Cumberland County Board of
Assessment Appeals, and files this Motion for Continuance of which the following is a
statement:
1. Movant is the Cumberland County Board of Assessment Appeals,
Respondent/Appellee in the above-captioned matter.

2. On November 19, 2012 Petitioner/Appellant filed a Petition for Allowance
of Appeal from the Decision of the Cumberland County Board of Assessment Appeals.
3. On December 5, 2012 the Court, by the Honorable Thomas A. Placey,
entered an Order scheduling a hearing for Monday, June 3, 2013.
4. Movant, Cumberland County Board of Assessment Appeals, desires to
coordinate with the taxing bodies for the retention of an expert appraiser to provide an
appraisal report and expert testimony for the hearing, but is unable to have this
accomplished by the hearing date of June 3, 2013.
5. Movant, Cumberland County Board of Assessment Appeals, has recently
engaged a new solicitor who is unfamiliar with this case and will not be prepared to try
this case by the hearing date.
6. Movant, Cumberland County Board of Assessment Appeals, requested
that the Petitioner/Appellant, Insite Development, LLC, concur in the request for a
continuance, but the Petitioner/Appellant has elected to NOT concur in that request.
7. The parties are significantly far apart in their valuation of the property. In
addition to assisting the Movant and the taxing bodies in preparing for trial, the
Motion for Continuance 2
preparation of an appraisal by an outside expert may assist the parties in settlement
negotiations.
8. In order to properly prepare an appraisal for the hearing, and in order to
allow the new solicitor for the Board to properly prepare for and attend the hearing, it is
respectfully requested that this Court grant a general continuance to allow the parties to
develop their evidence for the hearing, and attempt to settle the case.
WHEREFORE, Movant, Cumberland County Board of Assessment Appeals,
prays Your Honorable Court for an Order cancelling the hearing presently scheduled for
June 3, 2013, and grant a general continuance in the above captioned case.

STIPULATION AND JOINT MOTION FOR AGREED ORDER
AND NOW, this 30 day of Q r , 2014, it is hereby Agreed and Stipulated,
by and between the Petitioner, Insite Development, LLC, by and through its counsel,
Cunningham & Chernicoff, P.C.; and Respondent Cumberland County Board of Assessment
Appeals , by and through its counsel, John G. French, Esquire, Assistant County Solicitor; and
Intervenor, Cumberland Valley School District, by and through its counsel, Johnson, Duffie,
Stewart & Weidner, P.C., and interested party, Hampden Township, by and through its counsel,
Snelbaker & Brenneman, P.C., as follows:
1. Petitioner, Insite Development, LLC, filed a Petition for Appeal for the herein
captioned thirty-seven (37) Tots on August 28, 2012. A hearing was held before the Board of
Assessment Appeals on September 4, 2012. At the hearing, the Board of Assessment Appeals
entered an Order of No Change pertaining to the thirty-seven (37) parcels in question.
2. Petitioner, Insite Development, LLC, filed an Appeal from Order of Cumberland
County Board of Assessment Appeals as to all thirty-seven (37) parcels, pursuant to 72 P.S.
§5020-518.1, on November 19, 2012, to Docket No. 12-7019, in the Court of Common Pleas of
Cumberland County, Pennsylvania.
3. By Orders dated October 4, 2013 and June 12, 2014, and at the mutual request
of the parties hereto, the Court continued the hearing generally. The parties have now settled
this appeal.
4. The Assessment Appeal relates to the value as of August 28, 2012, the date the
Petition Appeal was originally filed to the Board of Assessment Appeals in Cumberland County,
and effective for assessment beginning on and after January 1, 2013.
5. The property which was the subject of the original appeal consisted of thirty-
seven (37) improved, partially improved, and unimproved building Tots identified as Tax Parcel
Nos: 10-14-0844-043, 10-14-0844-050, 10-14-0844-051, 10-14-0844-052, 10-14-0844-053, 10-
140844054, 10-14-0844-056, 10-14-0844-057, 10-14-0844-058, 10-14-0844-059, 10-14-0844-
060, 10-14-0844-061, 10-14-0844-062, 10-14-0844-063, 10-14-0844-064, 10-14-0844-065, 10-
14-0844-066, 10-14-0844-067, 10-14-0844-069, 10-14-0844-070, 10-14-0844-072, 10-14-0844-
073, 10-14-0844-074, 10-14-0844-075, 10-14-0844-076, 10-14-0844-078, 10-14-0844-086, 10-
14-0844-087, 10-14-0844-088, 10-14-0844-089, 10-14-0844-090, 10-14-0844-091, 10-14-0844-
095, 10-14-0844-096, 10-14-0844-097, 10-14-0844-099, 10-14-0844-101. Said parcels are part
of the residential development known as. Hawks Landing, situate at Lambs Gal? Road,
Hampden Township, Cumberland County Pennsylvania.

6. The Appellant withdraws its appeal as to Tax Parcel Nos.: 10-14-0844-050, 10-
14-0844-053, 10-14-0844-069, 10-14-0844-076, and 10-14-0844-078.
7. The parties stipulate that the assessed value and total fair market value of the
remaining parcels as of the date of the original appeals before the Board of Assessment
Appeals, August 28, 2012, for the 2013 tax year (the "Tax Year"), as to County and Municipal
Taxes, and fiscal year 2013-14 as to School Taxes shall be as identified on Exhibit A (the
"Stipulated Values").
8. The assessed values as indicated on Exhibit A, shall be effective for tax year
2013 beginning on or after January 1, 2013 for County and Municipal Tax purposes and July 1,
2013 for School Tax purposes and shall discontinue for tax year 2014 on or after January 1,
2014 and July 1, 2014 respectively. At that time the prior assessments for each parcel
previously established for tax year 2012 and 2012-13, will be reinstated.
9. The Cumberland County Assessment Office shall promptly notify the appropriate
taxing bodies of the change in assessment, and instruct the taxing bodies to make any
appropriate refunds for any taxes paid to such taxing body of the difference between the taxes
calculated at the rate for a lot under the original 2012 assessment, and as calculated at the rate
set forth in this Stipulation, concerning ay lots for which taxes have been paid to such taxing
body for the Tax Year. The parties expressly stipulate that any overpayment of taxes as a result
of this Stipulation shall be refunded to the Taxpayer/Appellant, rather than credited to future
taxes. The parties further stipulate that they will pay such refunds within 90 days of the date of
the final Order implementing this Stipulation.
10. Each party to this appeal shall bear its own costs.
11. The Court is requested to enter the proposed Order attached hereto.
12. The undersigned Attorneys each hereby warrant to the other, and to the parties,
and to the Court, that he/she has reviewed this Settlement Stipulation with his/her client or

AND NOW, this day of , 2013, upon Stipulation and Joint
Motion for Agreed Order, i is Decreed and Stipulated that the assessed and fair market value of
the herein captioned parcels which are the subject matter of this appeal, as of the date of the
original Petition to the Cumberland County Board of Assessment appeals, to wit:
effective January 1, 2013 for county and municipal tax purposes and July 1, 2013 for school tax
purposes is attached to this Order and incorporated herein as Exhibit "A". These assessments
shall continue for tax year 2013 beginning on or after January 1, 2013 for County and Municipal
Tax purposes and July 1 ,2013 for School Tax purposes and shall discontinue for tax year 2014
on or after January 1, 2014 and July 1 ,2014 respectively.
The Cumberland County Assessment Office shall allocate the said assessment between
land and improvements, and all parcels in accordance with the law and procedures of the
Cumberland County Assessment Office, and shall instruct the taxing bodies to make any
appropriate refunds. Any such refunds shall be paid by the taxing districts to the taxpayer within
90 days of the date of this Order. The said Stipulation and Joint Motion for Agreed order is
incorporated herein.
