COMPLAINT
AND NOW, comes the Plaintiff, MEMBERS ls` FEDERAL CREDIT UNION, by and
through its attorneys, MARTSON DEARDORFF WILLIAMS OTTO GILROY & FALLER, and
files this Complaint upon the following:
1. Plaintiff, Members 1 S` Federal Credit Union ("Plaintiff'), is a federally chartered
credit union located at 5000 Louise Drive, Mechanicsburg, Pennsylvania 17055.
2. Defendants, Robert N. Baum and Connie R. Baum ("Defendants"), are adult
individuals residing at 2801 Laurel Lane, Camp Hill, PA 17011.
3. On or about November 30, 2004, Defendants executed Visa Credit Card Application
("Application") with Plaintiff . A true and correct copy of the Application is attached hereto as
Exhibit "A" and is incorporated herein by reference.
4. Subsequently, Defendants were issued a Visa Credit Card ("Credit Card") and
provided with a Visa Credit Card Agreement and Disclosure, ("Agreement"). The Agreement
contained the terms and conditions of Defendant's credit card account. A true and correct copy of
the Agreement is attached hereto and incorporated herein as Exhibit "B."
5. Defendants used the Credit Card to purchase, goods, merchandise and services. A
true and correct copy of Defendants Credit Card statement dated September 13, 2012, is attached
hereto and incorporated herein as Exhibit "C."
6. Defendants have failed to make the minimum required payments when due and are
therefore in default under the Agreement.
7. Per the terms of the Agreement, when a default occurs Plaintiff may require
Defendants to pay all amounts then due and owing.
8. Plaintiff has made demand for payment of all sums due and owing thereunder, but
payment has been refused.
9. The total sum due and owing from Defendants under the Agreement, as of October
1, 2012, is itemized as follows:
Principal: $9,000.00
Finance Charges: $554.18
Court Costs: $150.00
Attorney fees: $1,500.00
Other Fees: $150.00
Total as of October 1, 2012: $9,704.18
*To be determined by the Cumberland County Sheriff.
12. Plaintiff specifically reserves the right to increase the Court Costs and Fees, and
Attorney Fees listed above should additional services be requested and/or costs/charges/fees be
incurred as a result of the collection of the money owed and foreclosure of the Real Property.
WHEREFORE, Plaintiff demands judgment against Defendants under the Note in the
amount of $9,704.18, plus any additional late fees and court costs incurred.
