Adeseun, by her attorneys, Shollenberger and Januzzi, LLP and does respectfully represent the following: 1. On October 11, 2012, The Honorable Richard S. Dougherty entered Judgment against Yasmin A. Adeseun for nonpayment of medical bills. A copy of the Notice of JudgmentlTranscript Civil Case is attached hereto and incorporated by reference herein as Exhibit "A". 2. "A party aggrieved by a judgment for money... may appeal therefrom within thirty (30) days after the date of the entry of the judgment by filing with the Prothonotary of the court of common pleas a notice of appeal on a form which shall be prescribed by the State Court Administrator together with a copy of the Notice of Judgment issued by the magisterial district judge. The Prothonotary shall not accept an appeal from an aggrieved party which is presented for filing more than thirty (30) days after the date of Q~~ ~1~3. ~S~ I ~# ~~~ ab entry of the judgment without leave of court and upon good cause shown." PA ST RCP MAG DIST J RULE 1002. 3. Thirty days after the Entry of Judgment was Saturday, November 10, 2012, therefore, the deadline to file the Appeal was Monday, November 12, 2012. 4. On Monday, November 5, 2012, Counsel for the Petitioner signed the Notice of Appeal form. The original and four (4) copies of the Notice of Appeal with the attached Notice of Judgment/Transcript Civil Case were placed into an envelope, along with a check made payable to the Cumberland County Prothonotary in the amount of $103.50 for filing fees as well as a return envelope. A copy of the Notice of Appeal is attached hereto and incorporated by reference herein as Exhibit "B". 5. The envelope was sealed and weighted on the postage machine located in to office of Counsel for the Petitioner and $1.05 postage was affixed to the envelope as indicated on the postage machine. The envelope was placed in the United States mail on November 5, 2012. 6. On November 14, 2012, two days after the deadline to file the Appeal, Counsel for the Petitioner received the envelope back in the mail indicating that .90 postage was due and the envelope was refused by the Pro#honotary. A copy of the returned envelope is attached hereto and incorporated by reference herein as Exhibit "C". 7. Due to the aforementioned circumstances, Petitioner, Yasmin A. Adeseun's Notice of Appeal was not filed with the Prothonotary within 30 days after the date of Entry of the Judgment. 8. Cumberland County L.R.C.P. 206.1(a) allows for the filing of petitions which seek the issuance of a rule to serve the interest of justice. 9. In Bass v. Com., 485 Pa. 256, 260, 401 A.2d 1133, 1135-36 (1979), the Supreme Court of Pennsylvania granted permission to file an Appeal Nunc Pro Tunc where there was anon-negligent failure to fife a timely appeal. In reaching their decision, the Court reasoned that the non-negligent failure to file a timely appeal was corrected within a very short time, during which time any prejudice was minimal. 10. The Plaintiff to this action is in no way prejudiced by the filing of an Appeal Nunc Pro Tunc. 11. The interest of justice will be served by granting Petitioner's requested relief.
