WHEREAS, Tadd R. Nyquist and Noel M. Nyquist of 710 Genevieve Drive, Mechanicsburg,
PA 17055, is about to execute contemporaneously herewith, a contract, with Landmark
Homes of 1737 W. Main St., Ephrata, PA, for the erection ofi a building upon premises
commonly known as 506 Jonagold Circle, Township Upper Allen, Cumberland County,
Pennsylvania, as set forth in the deed dated 01!06/12, recorded at Document Number
201201112, in the Recorder's Office for Cumberland County, Pennsylvania, as more
specifically described in Exhibit "A"which is incorporated herein and attached hereto.
NOW, November 2, 2012, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Owner to the said
Contrac#or to commence work an the said building, or purchase materials for the same in
consideration of the making of the said contract with Contractor and the further
consideration of One Dollar ($1.00), to contractor paid by Owner, ~ is agreed that no lien
shalt be filed against the bui}ding by the C~intractor, or any subcontractor, nor by any ofi the
materialmen or workmen or any other person for any labor, or materials purchased, ar extra
labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.

ALL THAT CERTAIN Unit in the property known, named and ident~ed in the
Declaration, referred to below, as "Winding Hills, A Planned Community,"
located in Upper Allen Township, Cumberland County, Pennsylvania, which has
heretofore been submitted to the provisions of the Pennsylvania Uniform Planned
Community Act, 68 Pa. C.S.A. § § 5101 et seq., as amended, by the recording in
the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, the
Declaration for Winding Hi11s, A Planned Community ("Declaration"), dated July 26,
2005, recorded August 11, 2005, in Miscellaneous Book 719, Page 4220, and
designated in the Declaration as Unit Nos. 192 and 194 (Unit Identifying Number),
as described in Exhibit C of the Declaration and shown (and described) on
Declaration Plats and Plans, dated July 11, 2005, recorded August 11, 2005, in the
Office of the recorder of Deeds of Cumberland County, Pennsylvania, in Right-of-
Way Plan Book 13, Page 112,
UNDER AND SUBJECT to restrictions and covenants of record, including, but not
limited to Declaration of Covenants, Conditions and Easement for Winding Hills, A
Planned Residential Development, dated July 26, 2005, recorded July 29, 2005, in
the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in
Miscellaneous Book 719, Page 2665, Declaration of Master Association for Winding
Hills, A Planned Residential Development, dated July 26, 2005, recorded July 29,
2005, in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania,
in Miscellaneous Book 719, Page 2677, and Declaration for Winding Hills, A
Planned Community, dated July 26, 2005, recorded August 11, 2005, in the Office
of the Recorder of Deeds of Cumberland County, Pennsylvania, in Miscellaneous
Book 719, Page 4220, and under and subject to easements and rights-of-way of
record.
