Plaintiff, RestoreCore, Inc., is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, having offices or a place of business located at 2322 North Seventh Street, Harrisburg, Pennsylvania, 17110. 2. Defendant, Eric Desrosiers, is and individual and citizen of the Commonwealth of Pennsylvania residing at 808 Michigan Avenue, Lemoyne, Pennsylvania 17043. 3. Defendant, Capitol Property Management, Inc., is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania having offices or a place of business located at 110 Third Street, Harrisburg, Pennsylvania 17070. 4. On or about September 19, 2011, Capitol Property Management, Inc., (hereinafter "Capitol Property") suffered a casualty loss to its property located at 110 Third Street, New Cumberland, Pennsylvania 17070 (hereinafter "property") COUNTI BREACH OF CONTRACT RestoreCore, Inc. v. Eric Desrosiers and Capitol Property Management Plaintiff hereby incorporates the above paragraphs as though the same were fully set forth at length herein. 6. On or about September 22, 2011, at the insistence and request of the Defendants, the Plaintiff provided the Defendants with certain emergency restoration and building services at the property at a price which was fair and reasonable and which the Defendants agreed to pay. Said services totaled $15,618.63. A true and correct copy of Plaintiff's Invoices are attached hereto, made a part hereof and marked as Exhibit "A". 7. Despite demand, Defendants have failed and refused to pay the balance due as set forth above. 8. Pursuant to the Restoration Contract executed by Defendants, attached hereto and marked as Exhibit "B", Defendants are responsible for Plaintiff's costs of collection including reasonable attorney fees as well as a finance charge on the unpaid balance of 1.5% per month. 9. Plaintiff has incurred expenses, including legal fees, as a result of having instituted this action and will be obliged to incur similar obligations in the future. 10. Defendants have breached their contract with Plaintiff by not paying said balance due. COUNT II UNJUST ENRICHMENT RestoreCore. Inc. v. Capitol Property Management, Inc. 11. Plaintiff hereby incorporates the above paragraphs as though the same were fully set forth at length herein. 12. Plaintiff has conferred a benefit upon Defendant by providing emergency restoration and building services to it, the quantum meruit value of which is $15,618.63. 13. Defendant, as owner of the property in question, has realized the benefits conferred upon it in the form of emergency restoration and building services rendered by Plaintiff. 14. Defendant accepted and retained the benefits under circumstances in which it would be inequitable for it to retain them without payment. 15. Plaintiff is entitled to reimbursement and compensation from Defendant pursuant to the legal doctrine of unjust enrichment. COUNT III UNJUST ENRICHMENT RestoreCore, Inc. v. Capitol Property Management. Inc. 16. Plaintiff hereby incorporates the above paragraphs as though the same were fully set forth at length herein. 17. Plaintiff has conferred a benefit upon Defendant by providing emergency restoration and building services to it, the quantum meruit value of which is $15,618.63. 18. Defendant submitted a claim to its insurance carrier, and received payment based on Plaintiff s invoices. 19. Defendant accepted and retained the benefits under circumstances in which it would be inequitable for it to retain them without payment to Plaintiff. 20. Plaintiff is entitled to reimbursement and compensation from Defendant pursuant to the legal doctrine of unjust enrichment. Wherefore, Plaintiff demands judgment against the Defendants in the amount of $15,618.63, plus interest in the amount of $2,192.80, together with reasonable attorney's fees in the amount of $750.00, plus ongoing attorney's fees, and court costs. At all times the property identified in Plaintiffs complaint was owned by Capitol Property Management, Inc. 22. At no time did Eric Desrosiers own the property identified in Plaintiff s complaint. 23. At all times Eric Desrosiers acting in his official capacity as President of Capitol Property Management, Inc. 24. Plaintiff has failed to set a claim upon which relief may be granted against Desrosiers. 25. Plaintiff has failed to set a claim upon which relief may be granted against Capitol. 26. Plaintiff has failed to mitigate their damages, if any. 27. Plaintiff s claim for recoverable damages is contrary to the law of the Commonwealth of Pennsylvania. 28. Plaintiff's causes of action may be barred in whole or in part by Parole Evidence Rule. 29. Plaintiff's claim(s) may be barred by the doctrine of estoppel, waiver and/or laches. 30. There has been a impasse in the attorney-client relationship since the issuance of the discovery and it is a matter that Counsel feels, will impact Counsels' ability to perform its professional responsibilities. 7. Petitioner has served a notice of the within petition on the party in the manner provided by Rule 440. A copy of the notice and the original certificate of service is attached hereto and incorporated herein as Exhibit "A". 8. To date, the Defendants have failed to respond to the Plaintiff's Request for Admissions. 5. Pursuant to the Pennsylvania Rules of Civil Procedure 4014, each matter of which an admission is requested is deemed admitted unless, within thirty days after service of the request, the party to whom the request is directed serves upon the party requesting the admissions an answer verified by the party or an objection. 6. The Defendants have failed to deny any of the averments in Plaintiff's request for admissions. Therefore, Pursuant to Pa. R.C.P. 4014, the following is deemed admitted: a. Restorecore Inc. provided the necessary services at the property pursuant to a written contract, with the Defendants' knowledge and consent. b. Eric Desrosiers signed the contract with Restorecore, Inc. for the work to be performed. c. Eric Desrosiers is the President of Capitol Property Management. d. Capitol Property Management owns the property at which the Plaintiff performed services. e. The Defendants received the insurance money as settlement for the loss. f. The Plaintiff is entitled to payment for the services it performed at the property. g. The Defendants were satisfied with the work the Plaintiff performed. 7. Based on the admission of the foregoing averments the Plaintiff is entitled to summary judgment in its favor. 8. Pursuant to Pa. R.C.P. 1035.2 any party may move for summary judgment whenever there is no genuine issue of material fact as to any claim or defense involved in the case. 9. Based on the averments deemed admitted in paragraph 6 above, neither Defendant can establish any genuine issue of fact as to why they should not have to pay the Plaintiff for the services it provided. 10. Accordingly, the Plaintiff is entitled to judgment in its favor, as a matter of law. On or about September 22, 2011, at the insistence and request of the Defendants, the Plaintiff provided the Defendants with certain emergency restoration and building services at the property at a price which was fair and reasonable and which the Defendants agreed to pay. Said services totaled $15,618.63. A true and correct copy of Plaintiff's Invoices are attached hereto, made a part hereof and marked as Exhibit "A ". 7. Despite demand, Defendants have failed and refused to pay the balance due as set forth above. 8. Pursuant to the Restoration Contract executed by Defendants, attached hereto and marked as Exhibit "B ", Defendants are responsible for Plaintiff's costs of collection including reasonable attorney fees as well as a finance charge on the unpaid balance of 1.5% per month. 9. Plaintiff has incurred expenses, including legal fees, as a result of having instituted this action and will be obliged to incur similar obligations in the future. 10. Defendant accepted and retained the benefits under circumstances in which it would be inequitable for it to retain them without payment. 15. Plaintiff is entitled to reimbursement and compensation from Defendant pursuant to the legal doctrine of unjust enrichment. COUNT III UNJUST ENRICHMENT RestoreCore, Inc. v. Plaintiff has conferred a benefit upon Defendant by providing emergency restoration and building services to it, the quantum meruit value of which is $15,618.63. 18: Defendant submitted a claim to its insurance carrier, and received payment based on Plaintiffs invoices. 19. Defendant accepted and retained the benefits under circumstances in which it would be inequitable for it to retain them without payment to Plaintiff. 20. Plaintiff is entitled to reimbursement and compensation from Defendant pursuant to the legal doctrine of unjust enrichment. At all times the property identified in Plaintiffs complaint was owned by Capitol Property Management, Inc. 22. At no time did Eric Desrosiers own the property identified in Plaintiff's complaint. 23. Plaintiff has failed to set a claim upon which relief may be granted against Desrosiers. 25. Plaintiff has failed to set a claim upon which relief may be granted against Capitol. 26. Plaintiff has failed to mitigate their damages, if any. 27. Plaintiffs claim for recoverable damages is contrary to the law of the Commonwealth of Pennsylvania. 28.
