The Defendant, BRIAN D WILLIAMS is an adult individual residing at the address indicated on the caption hereof. 3. On or about July 7, 2006, the Defendant executed and delivered to GMAC Mortgage Corporation dba Ditech.com a Promissory Note (herein "Note") under the account XX)OCXXX21720. Any Arbitration award shall be final and may be entered as a judgment in any court having jurisdiction, except that if the amount in controversy exceeds $10,000 either party may appeal the arbitrator's award. to athree-arbitrator panel of the AAA which shall reconsider de nova any aspect of the initial award. The costs of such appeal will be borne by the appealing party regardless of the outcome of the appeal. I agree that any arbitration proceeding will only consider my Claims.
