Smith, Esq., by way of complaint against Defendant JOHN FORCE, avers the following: 1. Plaintiff, CACH, LLC, is a Colorado limited liability company doing business at 4340 South Monaco Street 2nd Floor, Denver, CO 80237. 2. Defendant, JOHN FORCE, is an individual residing at 50 W PENN ST ,CARLISLE, PA 17013. 3. Plaintiff s cause of action is based upon a writing. <Exhibit C> 4. Defendant, JOHN FORCE, was indebted to GE MONEY BANK for a breach of a written contract by and between them in the amount of $2,238.84 which balance was due and unpaid as of August 19, 2011, for credit card account number 6019181839226770. <Exhibit A> 5. On or about September 22, 2011, GE MONEY BANK sold the debt for good and valuable consideration to plaintiff, CACH, LLC <Exhibit B> 6. The Defendant, John Force, last tendered a payment on December 28, 2010. 7. A copy of the credit card agreement is attached hereto. <Exhibit C> 8. Plaintiff is entitled to charge-off account finance charges of $0.00. <Exhibit A> 9. Plaintiff is entitled to pre-litigation charge-off interest of $1.4095 per day from the default date 22.980% annual percentage rate x $2,238.84 / 365 days) or $1.4095x600 days = $608.93; which is accrued interest through the date of filing. <Exhibit A> Plus an award of late fees 0.00, court costs $203.75 and reasonable attorneys fees as stated in the Cardholder Agreement attached hereto as <Exhibit C>. 10. The defendant, being indebted to the plaintiff upon the account by and between them did promise to pay said sums upon demand. Demand has been made for payment and the defendant has failed to remit payment. WHEREFORE, plaintiff demands judgment against the defendant for $3,351.52 which includes interest, court costs and a prayer to the court for reasonable attorney's fees in the amount of $ 300.00 should this matter be contested or go to default judgment. You must follow the instructions for making payments provided on your billing statement If you do not, credit of your payment may be delayed up to five days. Your billing statement also explains how information on your check is used. Payment Allocation. We will apply the required total minimum payment to balances on your account using any method we choose. Any payment you make in excess of the required total minimum payment will be applied to higher APR balances before lower APR balances. You consent to us contacting you using all channels of communication and for all purposes. We will use the contact information you provide to us. You also consent to us and any other owner or servicer of your account contacting you using any communication channel. This may indude text messages, automatic telephone dialing systems andla an artifidal or prerecorded vacs. This consent applies even if you are charged for the call under your phone plan. You are responsible fa any charges that may be billed to you by your communications carriers when we contact you. Telephone Monitoring. You may dose your account at any time by sending a letter to the address shown on your billing statement a calling customer service. We may dose your account at any time, for any reason.
