Plaintiff, U.S. Bank National Association, not in its individual capacity, but solely as Legal Title Trustee for LVS Title Trust I (the "Plaintiff'), is registered to conduct business in the Commonwealth of Pennsylvania and having an office and place of business at c/o BSI Financial Services, Inc., 314 South Franklin Street, Titusville, PA 16354. 2. Defendants, Harvey Cassell a/k/a Harvey J. Cassell, Original Mortgagor and Raymond G. Pozoic a/k/a Raymond Pozoic a/k/a Raymond G. Prozoic a/k/a Raymond Prozoic, Original Mortgagor and Real Owner, (collectively, the "Defendants"), are adult individuals. Raymond G. Pozoic a/k/a Raymond Pozoic a/k/a Raymond G. Prozoic a/k/a Raymond Prozoic is the real owner of the premises hereinafter described by virtue of a Deed dated December 21, 2010, recorded February 2, 2011 under Instrument 201103989. The Deed is attached hereto as Exhibit "A" and made a part hereof. 3. Defendant Harvey Cassell alk/a Harvey J. Cassell, Original Mortgagor, upon information and belief, resides at 2 Raspberry Drive, Mechanicsburg, PA 17055. Defendant Raymond G. Pozoic a/k/a Raymond Pozoic a/k/a Raymond G. Prozoic a/k/a Raymond Prozoic, Original Mortgagor and Real Owner, upon information and belief, resides at 2 Raspberry Drive, Mechanicsburg, PA 17055. 4. On August 31, 2006, in consideration of a loan in the principal amount of $166,400.00, Defendant Harvey Cassell a/k/a Harvey J. Cassell, Original Mortgagor, executed and delivered to EquiFirst Corporation a note (the "Note") with interest thereon at 7.950 percent per annum, payable as to the principal and interest in equal monthly installments of $1,215.19 commencing October 1, 2006. The Note is attached hereto as Exhibit "B" and made a part hereof. 5. To secure the obligations under the Note, the Defendants executed and delivered to Mortgage Electronic Registration Systems, Inc. as nominee for EquiFirst Corporation a mortgage (the "Mortgage") dated August 31, 2006, recorded on September 29, 2006 in the Department of Records in and for the County of Cumberland under Mortgage Book 1967, Page 3939. The Mortgage is attached hereto as Exhibit "C" and made a part hereof. 6. Plaintiff is proper party Plaintiff by way of an Assignment of Mortgage recorded September 19, 2011 under Instrument 201125928. The recorded Assignment of Mortgage is attached hereto as Exhibit "D" and made a part hereof. 7. The Mortgage secures the following real property (the "Mortgaged Premises"): 2 Raspberry Drive, Mechanicsburg, PA 17055. A legal description of the Mortgaged Premises is attached hereto as Exhibit "E" and made a part hereof. 8. The Defendants are in default of their obligations pursuant to the Note and Mortgage because payments of principal and interest due January 1, 2007, and monthly thereafter are due and have not been paid, whereby the whole balance of principal and all interest due thereon have become due and payable forthwith together with late charges, escrow deficit (if any) and costs of collection including title search fees and reasonable attorney's fees. 9. Plaintiff has complied fully with Act No. 91 (35 P.S.'1680.401(c) of the 1983 Session of the General Assembly ("Act 91") of the Commonwealth of Pennsylvania, by mailing to the Defendants at 2 Raspberry Drive, Mechanicsburg, PA 17055 as well as to address of residences as listed in paragraph 3 of this document on September 18, 2007, the notice pursuant to § 403-C of Act 91, and the applicable time periods therein have expired.
