AND NOW, this 5t" day of December 2012, upon review of the Petition for
Appointment of Plenary Guardian of the Person and Estate of David James Eby, an
alleged incapacitated person, counsel is appointed to represent the alleged
incapacitated person, David James Eby. The court appoints Lisa M. Coyne, Esquire, to
represent the alleged incapacitated person in these proceedings.
It is hereby ORDERED and DIRECTED that a hearing is scheduled for
17 January 2013 at 1:30 p.m. in Courtroom Number 6, of the Cumberland County
Courthouse, Carlisle, Pennsylvania. A CITATION shall be issued upon David James
Eby to show cause why he should not be adjudicated an incapacitated person and have
a guardian appointed for his person and estate. PETITIONER shall serve David James
Eby with notice of the hearing, in accordance with 20 P.S. 5511(a), no less than twenty
(20) days prior to the hearing.
Furthermore, the alleged incapacitated person shall be in attendance unless it
can be established by his physician that his mental or physical condition would be

harmed by his presence at the hearing. This may be established in the form of written
interrogatories.
PETITIONER shall properly serve notice of the petition and hearing upon all
persons entitled to share in the estate oi` the alleged incapacitated person, and proof of
said service shall be filed prior to the hearing.
