MECHANICS' LIEN CLAIM
Excel Homes Group, LLC, by and through its undersigned counsel, files the
following Mechanics' Lien Claim:
1. The Claimant is Excel Homes Group, LLC ("Excel"), which has a principal
place of business at 4900 Ritter Road, Suite 130, Mechanicsburg, PA 17055. Claimant
files this Claim as a Subcontractor.
2. The Owners of the real estate against which this claim is filed are C. Grant
Lebo, III and April R. Lebo, husband and wife (the "Lebos"), who own the property at
690 Mt Rock Road, Carlisle, Penn Township, Cumberland County PA 17015.
3. The last day Claimant supplied labor and/or material was August 23,
2012.
4. The party with whom Claimant contracted was Brevity Custom Homes,
LLC. Claimant provided formal Notice Of Intention To File Mechanic's Lien on October
24, 2012. A copy of Claimant's Notice Of Intention To File Mechanic's Lien is attached
as Exhibit A.

5. The labor and material supplied by Claimant was pursuant to a Final
Invoice dated August 10, 2012, a copy of which is attached hereto as Exhibit B. Brevity
Custom Homes, LLC accepted the Final Invoice by its words and deeds, and instructed
Claimant to proceed with the work as set forth on the Final Invoice. Claimant supplied
eight (8) modular units and miscellaneous building components and materials that were
assembled into a complete modular home at the Owners' property. The Final Invoice
includes a $6,500 "Set Fee." However, the Final Invoice also indicates that it was to be
a "Builder Set." This means that Brevity Custom Homes, LLC was responsible for the
set, and that Excel would release $6,500 from the amount it received to go toward
paying the company performing the set. Any amounts over $6,500 were the
responsibility of Brevity Custom Homes, LLC. The Set Fee is included in the Final
Invoice for tax and other business reasons, but does not create any contractual
relationship between Excel and the company performing the set where the Final Invoice
reflects that it is a Builder Set. Rather, the contractual relationship is between Brevity
Custom Homes, LLC and the company performing the set. Excel is including the
$6,500 in its lien claim simply because this amount is reflected on the Final Invoice and
Excel is the one that disburses this amount to the company performing the set. By filing
this lien claim, Excel is not admitting or acknowledging that it performed the set, nor that
it is responsible for the set crew's acts or omissions. Rather, it is simply including the
Set Fee as the disbursing agent. The Final Invoice contains a detailed statement of the
kind and character of the labor and materials furnished, and the prices charged for
each, and the information contained on the Final Invoice is incorporated herein by
reference.

6. The amount claimed to be due Excel is the full amount shown on the Final
Invoice of $151,002.72, since Excel has yet to receive any portion of the payment for
the amounts set forth on the Final Invoice. See Exhibit B.
7. The real property subject to the lien is 690 Mt Rock Road, Carlisle, Penn
Township, Cumberland County PA 17015, Pennsylvania, Tax Parcel No. 31-09-0521-004.
A copy of a Deed dated June 6, 2012 and recorded on June 13, 2012 from C. Grant Lebo III
to C. Grant Lebo III and April R. Lebo, as husband and wife, is attached hereto as Exhibit C.
Copies of an aerial photograph of the real property as depicted on the Property Mapper
software for Cumberland County is attached as Exhibit D.
WHEREFORE, Claimant Excel Homes Group, LLC, claims to have a lien upon
690 Mt Rock Road, Carlisle, Penn Township, Cumberland County PA 17015, Pennsylvania,
Tax Parcel No. 31-09-0521-004, in the total sum of $151,002.72.

AND NOW COME, Defendants/Owners C. Grant Lebo and April R. Lebo
("Lebos"), by and through their counsel, Salzmann Hughes, P.C., and make this
concurred in motion for continuance of the evidentiary hearing scheduled for May 24,
2013. Plaintiff/Claimant Excel Homes Group, LLC ("EHG") requested and is in full
concurrence with this motion, and the only reason it is being filed as a concurred in
motion rather than a joint motion is for reasons of expediency in order to avoid the delay
associated with obtaining the signature of EHG's counsel whose office is located in
Harrisburg, PA. EHGs concurrence is set forth on the attached Certificate of
Concurrence executed by EHGs counsel. In support of this motion, the Lebos aver as
follows:
1. EHG commenced this action by filing a mechanics' lien claim on December
11, 2012, against property owned by the Lebos. The lien is asserted for $151,002.72,
and is for amounts that EHG claims it should have been paid by or on behalf of Brevity
Custom Homes, Inc. ("Brevity") for eight (8) modular units and miscellaneous building
components and materials that EHG supplied to Brevity. The Lebos paid Brevity in
excess of $175,000, none of which was used by Brevity to pay EHG. Brevity's principal
is Seth Hughes.
2. The Lebos filed preliminary objections and then amended preliminary
objections to the lien claim that were argued on April 5, 2013.
3. On April 18, 2013, The Honorable Judge Guido issued an Order scheduling
an evidentiary hearing for Friday, May 24, 2013 at 1:00 p.m.
4. Prior to the filing of the lien claim, the Pennsylvania State Police commenced
an investigation into Brevity and Seth Hughes in an attempt to try and locate the money
that the Lebos paid Brevity. The Pennsylvania State Police recently submitted its report
and recommendations to the Cumberland County District Attorneys Office. The
Pennsylvania State Police were not able to locate or trace all of the money paid by or on
behalf of the Lebos to Brevity.
5. On April 30, 2013, Seth Hughes and his wife filed for bankruptcy protection.
See In re Hughes, United States Bankruptcy Court for the Middle District of

Pennsylvania 1:13-bk-02294-MDF. The initial hearing of creditors is scheduled for June
18, 2013.
6. The parties are in agreement that their efforts would be better spent on
attempting to locate any money still in the possession or control of Brevity or Seth
Hughes from what was paid by the Lebos and reaching an amicable resolution rather
than continuing with an evidentiary hearing at the present time.
7. The parties are requesting that this Court continue the evidentiary hearing
until after the parties report back on their efforts to locate the missing money paid to
Brevity and amicably resolve this matter. The parties agree to provide a status update
in thirty days as to whether the evidentiary hearing is needed at that time, or whether
more time is needed to focus on locating the missing money and amicably resolving this
matter.
WHEREFORE, Defendants/Owners C. Grant Lebo and April R. Lebo, on behalf
of themselves and at the request and with the full concurrence of Plaintiff/Claimant
Excel Homes Group, LLC, requests that this Court continue the hearing scheduled for
May 24, 2013 and enter the attached Proposed Order.

Pursuant to this Court's Order of May 24, 2013, the parties file this Joint Status Report.
The status of the above captioned case is as follows:
1. The parties have agreed to continue settlement discussions and have discussed the
possibility of scheduling mediation of the dispute.
2. The rights and potential liability of a third party, being Members I st Settlement
Services, LLC may be affected by this matter.
3. The Grant and April Lebo have initiated litigation against Members 1st
Settlement Services, LLC in the Cumberland County Court of Common Pleas at Docket No.
2013-03048.
4. Members I st Settlement Services, LLC has submitted the matter to its insurance
carrier.
5. The parties are currently awaiting Members 1st Settlement Services, LLC's
insurance carrier to appoint counsel.
6. At this time, the parties do not request that this Court schedule an evidentiary
hearing.
7. The parties agree to submit a supplemental Joint Status Report no later than
August 23, 2013.
