JAMES D. HUGHES, Esquire, being duly sworn, deposes and says that he was a partner in the
law firm Irwin, McKnight & Hughes which existed from 1994 until 2003. On October 1, 2003,
the firm of Irwin, McKnight & Hughes ceased to exist. Under the terms of the Last Will and
Testament of Robert W. Birrell dated November 26, 1996, in Paragraph Six the testator appoints
Bruce E. Birrell and the then current senior partner of Irwin, McKnight & Hughes to serve as Co-
Executors. Given the above, it is determined that portion of the Last Will and Testament of the
decedent lapses and the next determined Co-Executor would b qualified to act as Co-Executor.
