STIPULATION AGAINST LIENS - ~~
WHEREAS, Silver Creek Development Company Limited Partnership, a
Pennsylvania Limited Partnership of Pennsylvania, is about to execute contemporaneously herewith,
a contract with Classic Communities Corporation, a Pennsylvania Corporation of Dauphin County,
Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN Units, being Unit No. 3, Unit No. 33, Unit No. 90, Unit No.
93, Unit No. 110, Unit No. 110A, Unit No. 111, Unit No. 111A, Unit No. 112, Unit No. 113, Unit
No. 114, Unit No. 115, Unit No. 132, Unit No. 133, Unit No. 134, Unit No. 138, Unit No. 140, Unit
No. 140A, Unit No. 141, Unit No. 142, Unit No. 143, Unit No. 143A, Unit No. 179, Unit No. 180,
Unit No. 181, Unit No. 182, Unit No. 183, Unit No. 183A, Unit No. 184, Unit No. 185, Unit No.

"Units") of Silver Creek at Hampden, a Townhome Condominium (the "Condominium"), located
in Hampden Township, Cumberland county, Pennsylvania, which Units are designated in the
Declaration of Condominium of Silver Creek at Hampden, a Townhome Condominium (the
"Declaration of Condominium") recorded in the Office of the Cumberland County Recorder of
Deeds in Miscellaneous Book 724, Page 70 and in the Declaration Plats and Plans recorded
simultaneously in the aforesaid Office in Right-of--Way Plan Book 13, Page 130, together with any
and all amendments thereto.
TOGETHER with the undivided percentage interest in the Common Elements
appurtenant to the Units as more particularly set forth in the aforesaid Declaration of Condominium,
as last amended.

TOGETHER with the right to use the Limited Common Elements applicable to the
Units being conveyed herein, pursuant to the Declaration of Condominium and Declaration Plats and
Plans, as last amended.
UNDER AND SUBJECT to the Declaration of Condominium, to any and all other
covenants, conditions, restrictions, rights-of--way, easements and agreements of record in the
aforesaid Office, and matters which a physical inspection or survey of the Unit and Common
Elements would disclose.
TOGETHER with all Special Declarant Rights and other development rights, as
described in the Declaration of Condominium and/or the Act, and which are vested in Mortgagor.
BEING PART OF THE SAME premises which Silver Creek Development
Company Limited Partnership, a Pennsylvania Limited Partnership, as Agent, by its deed dated
February 3, 2005 and recorded February 8, 2005 in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania in Deed Book 267, Page 2306, granted and conveyed unto Silver
Creek Development Company Limited Partnership, a Pennsylvania Limited Partnership.
NOW, the ~~lay of December, 2012, at the time of and immediately before
the execution of the principal contract, and before any authority has been given by the said Silver
Creek Development Company Limited Partnership, a Pennsylvania Limited Partnership to the said
Classic Communities Corporation, a Pennsylvania Corporation to commence work on the said
buildings, or purchase materials for the same in consideration of the making of the said contract with
Classic Communities Corporation, a Pennsylvania Corporation and the further consideration of One
Dollar, to Classic Communities Corporation, a Pennsylvania Corporation paid by Silver Creek
Development Company Limited Partnership, a Pennsylvania Limited Partnership it is agreed that no
lien shall be filed against the buildings by the contractor, or any sub-contractor, nor by any of the
material men or workmen or any other person for any labor, or materials purchased, or extra labor
or materials purchased for the erection of said building, the right to file such liens being expressly
waived.
