STIPULATION A INST LIENS
THIS AGREEMENT made this ~ day of ~ 2012, by
and between Tamanini Homes, LC, hereina ter referred to as
Contractor,
AND
Daniel J. Boyle a nd Peggy H. Boyle, husband and wife, hereinafter
referred to as Owner, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in Monroe Toatnship, Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot ~9 Trindle
Station, 815 Tamanini Way, Mechanicsburg, PA 17055.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
tree erection and construction of the said buildings on the lot.
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract or parcel of land situated in Monroe
Township, Cumberland County, Pennsylvania, being Lot 49 as
described on a plan titled "Final Subdivision Plan for Lots 46-54,
Trindle Station, Section 1, Ph II," dated November 19th, 2009, last
revised April 14th, 2010 by Alpha Consulting Engineers, Inc. and
recorded in Cumberland County Courthouse, Instrument Number
201014375, more particularly described as follows:
BEGINNING at a point at Lots 48 & 49 of the afore mentioned plan
and along western right-of--way of Tamanini Way, said point being
North 51 degrees 30 minutes 39 seconds West a distance of 71.82 feet
from a point at Lots 26 & 27 and along the eastern. right-of--way of
Tamanini Way; thence along Lot 48 South 79 degrees 13 minutes 56
seconds West a distance of 126.88 feet to a point at lands now or
formerly of Trindle Station LLC; thence along lands now or formerly
of Trindle Station LLC North 19 degrees 03 minutes 45 seconds West
a distance of 75.77 feet to a point; thence along the same and Open
Space F-1 North 63 degrees 26 minutes 32 seconds East a distance of
128.20 feet to a point at the western right-of--way of Tamanini Way;
thence along the western right-of--way of Tamanini Way by a curve to
the right with a radius of 425.00 feet, an arc length of 1.11.12 feet, with
a chord bearing of South 18 degrees 15 minutes 30 seconds East, a
chord distance of 110.81 feet to a point, being the place of
BEGINNING.
CONTAINING 12,053 Square Feet (0.28 Acre) and BEING Lot 49 on
the Final Subdivision Plan for Lots 46-54, Trindle Station, Section 1
Phase II recorded in Instrument Number 201014375.
BEING part of the same premises which Trindle Station, LLC by deed dated
5/27/10 and recorded 6/2/10 to Instrument #201014382 granted and conveyed
unto Trindle Station, LLC.
