Plaintiff Erie Insurance Exchange is an insurance company licensed and authorized to conduct business in the Commonwealth of Pennsylvania and having as one of its principal places of business the above captioned address. 2. John C. McGowan is an adult individual who was insured by Plaintiff Erie Insurance Exchange on 7/28/2012. 3. Defendant Comfort Zone Heating and Cooling is a business entity specializing in heating and cooling installation and repair service and having as one of its principal places of business the above captioned address. 4. On 7/28/2012 Plaintiff Erie Insurance Exchange insured John C. McGowan with a homeowners policy, policy number Q522808086, said policy covering the location of 507 Gale Road in Camp Hill, Cumberland County, PA and carrying with same, property and contents coverages. 5. Defendants, acting individually and or acting by and through their agents, servants, workmen, sub-agents and/or employees, on or about May, 2012 did install an air conditioning system in the Plaintii~s attic. 6. On or about July 28, 2012, as a result of the negligent, careless and or reckless acts and/or omissions of the defendants, acting by and through their agents, servants, workmen, sub-agents and/or employees, plaintiff s insured's residence sustained extensive amounts of water to be discharged which resulted in extensive water damages to the structure and contents. 7. The negligence of the Defendants consisted of but was nat limited to: a) Failing to properly install the air conditioning unit or system located in the attic of Plaintiff's home; b) Improper hook up of safety pan switch, which turns the power off to the thermostat; c) Failing to properly prepare the area; d) Hiring and or using unskilled ,untrained and/or unlicensed sub contractors, e) Failing to warn plaintiff of the hazards associated with improperly install of air conditioning unit or system; fj Failing to inspect the installation of air conditioning unit or system; g) Failing to properly monitors the sub contractors; h) Failing to perform proper inspections of the residence to ensure that the residence was free from defects; i) Improper drain hookup, causing drain pan to crack; j) Improper installation of wire under the plywood that the attic air conditioning unit was mounted on; k) Failing to perform installation in a professional and workmanlike manner; 1) Other such negligence that may be developed through continuing discovery and trial of this matter. 8. The aforesaid damages to Plaintiff's insured's property resulted solely from the negligent acts and/or omissions on part of Defendants named herein and were due in no manner whatsoever to any act and/or failure to act on part of Plaintiffs. 9. As a result of the aforesaid water discharge Plaintiff Erie Insurance Exchange settled the first party homeowners claim of John C. McGowan in the amount of $9,309.660,(said figure includes McGowan's first party deductible) representing fair and reasonable reimbursement for the damages sustained. 10. Pursuant to the aforesaid policy of insurance, Plaintiff Erie Insurance Exchange is subrogated to John C. McGowan for this loss.
