Plaintiff, CACH, LLC, is a corporation located at 4340 S. Monaco Street, Suite 200, in Denver, CO, and represented in the Commonwealth of Pennsylvania by the undersigned attorney. 2. Defendant, JESSE & JILL is an individual residing at 312 CENTER ST ENOLA, PA 17025. 3. The plaintiff extended credit to the defendant, JESSSE & JILL SMITH, by allowing said defendant to obtain goods and/or services on an account. 4. The defendant, JESSE & JILL SMITH, agreed to pay for all goods and/or services charged to their account in a timely manner. 5. The account arose from the purchase of a consumer credit card XXXX XXXX XXXX 6731 issued by FIA Card Services N.A. on JANUARY 8, 2008 to defendant. 6. The defendant has breached the terms and conditions of this account by failing to make payments in a timely manner as stated in the account agreement. 7. The last payment made by the defendant on this account, was on MARCH 31, 201 1, in the amount of $442.00. 8. In accord with the terms of the Defendant's account, and as a result of the breach of its terms by the defendant, the Plaintiff has declared the entire balance to be due and owing. 9. On or about MAY 17, 2011, the attached instrument was assigned to FIA CARD SERVICES, N.A., and the original payee for value in exchange for all rights, title and interest in and to its account with defendant. A copy is attached hereto as Exhibit "A". 10. By virtue of the above listed assignment, Plaintiff acquired legal title to the account of JESSE & JILL SMITH, Defendant. 11. The defendant is indebted to the Plaintiff in the principal amount of $21,467.33 for goods and/or services provided by Plaintiff to the Defendant on the account as is more fully set forth in the Statement attached hereto as Exhibit "B". 12. Despite due demand and repeated attempts, the Defendant has failed and refused to pay the balance due and owing. 13. The plaintiff is entitled to pre-litigation charge off interest of $4.78 per day from the default date ($4.78 x 511 days = $2,442.58) WHEREFORE, Plaintiff demands judgment in the sum of $23,909.91, together with court costs, attorney fees; accrued interest and any and all other relief to which the Plaintiff may appear entitled.
