Haley, Esq., and MidPenn Legal Services, and files this Motion and in support thereof avers the following: 1. On November 1, 2012 a Landlord/Tenant Complaint was filed by the Plaintiff against the Defendant before Magisterial District Court 09-03-05. 2. On December 26, 2012, a judgment for possession and damages in the amount of $789.00 was entered against the Defendant. 3. On December 27, 2012, the Defendant filed a Notice of Appeal. 4. At the time of filing the appeal, the Defendant paid the monthly rent into the Prothonotary's escrow account in the amount of$650.00. The Defendant has also paid the monthly rent in the amount of$325 for the months of January, February, March, and April 2013, totaling $1950.00. 5. The Defendant respectfully requests that the monies deposited by the Defendant be released to the Defendant. 6. The parties, through counsel, have agreed that the Defendant will vacate the residence at 3527 Rolo Court, Mechanicsburg, PA 17055,upon release of the monies deposited into the prothonotary's escrow to the Defendants. 7. The undersigned hereby certifies that the Defendant has contacted Plaintiff's counsel with regard to this Motion with request to indicate their concurrence or not a concurrence. Counsel for the Plaintiff concurs with this request. 8. The authority for this Motion can be found under Pa.R.C.P.M.D.J. No. 1008 (b).
