Over 90 days have elapsed since the filing of the motion for IFP. 10. To date, Plaintiff has not filed a complaint. 11. On April 19, 2013, Defendants filed a Motion to Revoke Plaintiff's IFP Status.' On May 30, 2013, we granted that motion and dismissed the instant action without prejudice.2 On June 28, 2013, Plaintiff filed a Notice of Appeal. On December 4, 2013, Plaintiff filed the following Statement of Errors Complained of on Appeal: 1. In ordering this above captioned action dismissed, the trial judge failed to follow Rule 230.2 of the Pennsylvania Rules of Civil Procedure (Pa.R.Civ.P.); 2. The trial court, in essence, granting appellee's praecipe for judgement of non pros when it did not conform to Rule 237.1 of the Pa.R.Civ.P. in that no notice of the intention to file the praecipe was attached to the praecipe, and no evidence was presented that such notice was ever given to appellant before the praecipe was filed; 3. The trial court, in essence, granted appellee's praecipe for judgement of non pros when there was no evidence presented that notice was served on appellant as prescribed in Rule 237.4 of the Pa.R.Civ.P.; 1 Defendants' Motion to Revoke Plaintiff's IFP Status(April 19,2013). 2 Order of Court,In Re: Defendants' Motion to Revoke Plaintiff's IFP Status(May 30, 2013). 4. No rule being entered upon the appellant to file a complaint in accordance with Rule 1037 of the Pa.R.Civ.P.; 5. A change in ruling(s)/law since the trial judges [sic] order to dismiss this action in that the trial judge relied on appellee's presenting a ruling made in Sloan v. Wetzel, et al, Docket No. 92 Civil 2013 (Judge David C. Klementik), in which that judge refused to approve in forma pauperis status to a prisoner who does not file an accompanying complaint — a ruling that has since changed. 6. A change in ruling(s)/law since the trial judges [sic] order to dismiss this action in that the trial judge relied on appellee's referencing another attorney from their counsels [sic] office saying in Sloan v. Murray, et al., C.A. No. 3:11-CV-00994 (M.D.Pa.) that appellant was to pay search and retrieval fee's to review discovery material — of which appellant was not able to do at that time due to his indigence. However, since the trial judge in this instant action made the decision to dismiss this action using the references made by appellee's attorney, the judge presiding over Sloan v. Murray — District Judge A. Richard Caputo — has since ruled that appellant was not to pay any search and retrieval fee's.3 This opinion in support of our order of May 30, 2013, is written pursuant to Pa. R.A.P. 1925(a). PROCEDURAL HISTORY On December 31, 2012, Plaintiff filed a Praecipe for Writ of Summons and a Motion to Proceed in Forma Pauperis. On January 4, 2012, we granted Plaintiff's motion. On March 18, 2013, Plaintiff filed a Praecipe to Reissue Writ of Summons along with a Motion for Pre-Complaint Discovery. On April 19, 2013, Defendants filed Defendants' Motion to Revoke Plaintiff's IFP Status. That same day, Defendants filed a Praecipe for Rule to File Complaint, which the prothonotary issued.4 Also on April 19th, Defendants 'Statement of Errors Complained of on Appeal(December 4,2013). 4 We note that the Rule issued by the prothonotary was mistakenly dated April 13, 2013, six days prior to the filing of Defendants' praecipe. The Rule states, in relevant part, "a rule is hereby entered upon the Plaintiff to file a complaint within twenty (20) days after service of this rule or suffer the entry of a Judgment of Non Pros." Rule (April 13, 2013) (emphasis added). As no Judgment of Non Pros was 2 filed Defendants' Objection to Plaintiff's Motion for Pre-Complaint Discovery. On May 16, 2013, Plaintiff filed a response to each of Defendants' April 19th filings. On May 30, 2013, we denied Plaintiff's Motion for Pre-Complaint Discovery and granted Defendants' Motion to Revoke Plaintiff's IFP Status, revoking Plaintiff's in forma pauperis status and dismissing the action without prejudice. DISCUSSION Pennsylvania Rule of Civil Procedure 240 states, in part: If the petitioner commences the action by writ of summons, the court shall not act on the petition for leave to proceed in forma pauperis until the complaint is filed. If the complaint has not been filed within ninety days of the filing of the petition, the court may dismiss the action pursuant to subdivision (j)(1). Pa.R.C.P. 240(j)(2). With respect to the entry of a judgment of non pros, Pa.R.C.P. 237.1(a)(2)(i) states: (2) No judgment of non pros for failure to file a complaint or by default for failure to plead shall be entered by the prothonotary unless the praecipe for entry includes a certification that a written notice of intention to file the praecipe was mailed or delivered (i) in the case of a judgment of non pros, after the failure to file a complaint and at least ten days prior to the date of the filing of the praecipe to the party's attorney of record or to the party if unrepresented . . . . Pa.R.C.P. 237.1(a)(2)(i). Finally, when an action is not commenced by a complaint: the prothonotary, upon praecipe of the defendant, shall enter a rule upon the plaintiff to file a complaint. If a complaint is not filed within twenty days after service of the rule, the entered in this matter, and as the twenty days only began to run after service of the rule,the incorrect date is of no moment. 3 prothonotary, upon praecipe of the defendant, shall enter a judgment of non pros. Pa.R.C.P. 1037(a). Plaintiff complains of six alleged errors by this Court. None of which bear any relation to the dismissal of his action. While Plaintiff cites a variety of Rules of Civil Procedure within his errors complained of, absent is the rule relied upon by this Court. We dismissed Plaintiffs action pursuant to Pa.R.C.P. 240(j)(2), which was explicitly cited in Defendants' Motion to Revoke Plaintiffs IFP Status, which we granted in our order of May 30, 2013. As such, Plaintiffs claims of error contained in paragraphs 1 — 4 of his errors complained of on appeal are without merit; a judgment of non pros was simply never entered against Plaintiff. Instead, more than ninety days had passed since Plaintiff filed his Motion to Proceed in Forma Pauperis without Plaintiff filing a complaint. Thus, pursuant to Pa.R.C.P. 240(j)(2), we dismissed Plaintiffs action, finding it frivolous. As a result of our dismissing Plaintiffs action, any alleged error concerning revocation of Plaintiffs IFP status contained in paragraph 5 of Plaintiffs statement of errors is moot.5 Regarding paragraph 6 of Plaintiffs errors complained of on appeal, District Judge Caputo's ruling bears no relevance to our decision to deny Plaintiffs request for pre-complaint discovery. In the present matter, the facts underlying Plaintiffs claims are sufficiently known to Plaintiff for the purpose of filing a complaint, as demonstrated by 'Revoking Plaintiff's IFP status also rectified our error in granting Plaintiffs Motion to Proceed in Forma Pauperis in the first place. Pursuant to Pa.R.C.P. 240(j)(2),we should have postponed ruling on Plaintiff's motion until a complaint was filed. As no complaint was forthcoming, our granting of Plaintiff's Motion to Proceed in Forma Pauperis was improper. 4 • the information contained in his Motion for Pre-Complaint Discovery. Thus we denied his motion, finding the material requested to be unnecessary to the filing of a complaint. See Pa.R.C.P. 4003.8(a) ("A plaintiff may obtain pre-complaint discovery where the information sought is material and necessary to the filing of the complaint . . . .") (emphasis added).
