Napier and Amy D. Napier, husband and wife of Cumberland County, Pennsylvania, are about to execute contemporaneously herewith, a contract with Carlson Construction, Inc., a Pennsylvania Corporation of Cumberland County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN Unit, being Unit No. 46 (the "Unit"), of Hampden Summit, a Planned Community (the "Community"), such Community being located in Hampden Township, Cumberland County, Pennsylvania, which Unit is designated in the Declaration of Covenants and Restrictions for Hampden Summit, a Planned Community and Declaration Plats, as amended (collectively the "Declaration"),together with any and all improvements thereto, as more particularly bounded and described as follows, to wit: BEGINNING at a point on the western right-of--way line of Skyview Court, said point being the northeast corner of Lot No. 45 as shown on the "Final Subdivision Plan for Hamden Summit -Phase 2"; thence along the northern boundary line of Lot No. 45, South 77 degrees 22 minutes 25 seconds West, a distance of 141.62 feet to a point; thence North O1 degree 21 minutes 45 seconds West, a distance of 123.78 feet to a point being the southwest corner of Lot No. 47; thence along the southern line of Lot No. 47, North 88 degrees 38 minutes 15 seconds East, a distance of 135.52 feet to a point on the western right-of--way line of Skyview Court; thence by the ll~ ~ 5 ~~'S"~ ~~ ~~ `~~~ said right-of--way line South O1 degree 21 minutes 45 seconds East, a distance of 61.93 feet to a point; thence continuing along the same on a curve to the left having a radius of 175.00 feet, an arc length of 34.40 feet to the point and place of BEGINNING. CONTAINING 14,985 square feet (0.34 acres) having an address of 1275 Skyview Court, Mechanicsburg, Pennsylvania 17050. BEING Lot No. 46 as shown on the plan entitled "Final Subdivision Plan for Hampden Summit Phase 2", prepared by R.J. Fisher and Associates, Inc., recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 89, Page 83. TOGETHER with the undivided Allocated Interest appurtenant to the Unit as more particularly set forth in the aforesaid Declaration as last amended. UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions, encumbrances and other matters of record or that which a physical inspection or survey of the premises would reveal. ALSO UNDER AND SUBJECT, NEVERTHELESS, to the Declaration, and all amendments thereto; to any and all covenants, conditions, rights-of--way; and to matters or record or that which a physical inspection or survey of the Unit and Common Elements would disclose. THE GRANTEE, for and of behalf of the Grantee and the Grantee's heirs, personal representatives, successors and assigns, by the acceptance of this deed, covenants and agrees to pay such charges for maintenance, repair, replacement and other expenses in connection with the Common Elements, as maybe assessed against him, her, them, it, or against the said Unit, from time to time by the Executive Board of Hampden Summit Homeowners Association in accordance with the Pennsylvania Uniform Planned Community Act, 68 Pa. C.S. §5101 et seq. (the "Act"), and further covenants and agrees that the Unit conveyed by this deed shall be subject to a lien for all amounts so assessed, except insofar as §5407(c) of the Act may relieve a subsequent unit owner of liability for prior unpaid assessments. This covenant shall run with and bind the Unit hereby conveyed and all subsequent owners thereon. BEING THE SAME premises which F.A.S.T. Partners, L.P., a Pennsylvania Limited Partnership, by its deed dated October 24, 2012 and recorded November 9, 2012 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Instrument No.: 201234896, granted and conveyed unto Christopher K. Napier and Amy D. Napier, husband and wife. NOW, the ~~ day of December, 2012, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Christopher K. Napier and Amy D. Napier, husband and wife, to the said Carlson Construction, Inc., - 2 - a Pennsylvania Corporation to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Carlson Construction, Inc., a Pennsylvania Corporation and the further consideration of One Dollar, to Carlson Construction, Inc., a Pennsylvania Corporation paid by Christopher K. Napier and Amy D. Napier, husband and wife, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
