IN WITNESSETH: WHEREAS, lane and Shanholtz own, as tenants in ommon, real estate situate in the Borough of New Cumberland, Cumberland County, Pe nsylvania, known and numbered as 321 Third Street, New Cumberland, Pennsyl ania, which is more particularly bounded and described in a Deed into them dated 8 Augus 1990 and recorded in the Recorder of Deeds Office in and for Cumberland County, P nnsylvania, in Deed Book S, Volume 34, at Page 550, a copy of which said Deed is att ched hereto and marked as Exhibit A (hereinafter the "Property"); and WHEREAS, lane and Shanholtz have agreed to mak a certain disposition of the Property upon the death of the first of them and wish to h ve the terms of that agreement reduced to writing for their mutual protection. Upon the death of the first of the parties to this greement to die, the surviving party shall have the right to the exclusive possession and u e of the Property and all of its rents, profits, and benefits, the same as if the surviving par y owned a life estate in the Property, for the remainder of his or her life. During the tim that the survivor shall have exclusive use and occupancy of the Property he or she shall not be obligated to pay rent for such use or occupancy but shall pay all expenses associ ted with or arising out of the ownership, use, or occupancy of the Property, including, wi hout limitation, the annual real estate taxes, all costs to maintain the Property, all utilit and related expenses, and the cost to insure the Property for liability and casualty loss. The su viving party shall, however, give reasonable access to the Property to the personal re resentatives of the estate of the deceased party for purposes of removing the personal pro erty of the deceased party and otherwise performing those duties necessary to properly dminister the estate of the deceased party. 2. As long as either of the parties own an interest n the Property, the parties, or the survivor of them, will keep the Property insured again t all casualty losses, in an amount of at least $213,000.00 and shall maintain Iiabilit insurance on the Property, insuring both of the parties hereto as owners, in an amou t of not less than $100,000.00 per occurrence and $300,000.00 in total. Upon the deat of either of the parties, the survivor shall maintain such insurance for the benefit of hi self or herself and the estate, personal representative, heirs, or legatees of the survivor. 3.
