Cumberland County Aging and Community Services was appointed Dorothy Deaven's
Permanent Plenary Guardian of Person and Estate. Ms. Deaven had been a resident of
Golden Living-West Shore at the time of the hearing and continued to reside there
She was diagnosed with COPD, HTN, atrial fib, cardiac dysrhythmias, congestive heart
failure, esophageal reflux, muscle weakness, osteoarthritis, diabetes, renal cell cancer,
dementia and a history of a stroke. She was also extremely hard of hearing. She
needed assistance with her personal care and other activities of living as well as
instrumental activities of living such as laundry and meal preparation. She was
wheelchair bound and a lift was need for all transfers.
On October 18, 2012 this Agency gave permission to have Dorothy moved to the
dementia unit of the nursing home. She had been experiencing a decline in her
cognitive status. She was also beginning to have some behavioral issues related to her
level of dementia, including a recent altercation with her roommate. It was felt she
would benefit from the additional activities on that unit. However before they moved her
she began to experience a physical decline.
On December 13, 2012 the Agency was notified that Dorothy had been lethargic the last
few days. Her lab work revealed she was dehydrated and may have had an infection.
We gave permission to insert an IV and catheter. On December 17, 2012 the nursing
home called asking if we wanted her changed to a Do Not Resusitate. Before the
decision was made, she was transported to Holy Spirit Hospital because she had
become unresponsive. An agency staff member visited her there. She was totally
unresponsive and her breathing was extremely laborious. We conferred with the
daughter and she was in agreement with the DNR and comfort measures only. At the
hospital we agreed to comfort measures only which included an antibiotic. Her
daughter, Donna, assured us that funeral arrangements had been made previously with
Parthermore's in New Cumberland. The next morning we called the funeral home to
verify arrangements and were notified Dorothy had passed away during the night.

ESTATE
A guardianship account had been set up at Metro Bank where she had her account
previously. The Agency applied for and was accepted to be the representative payee for
her Social Security and the federal employee annuity. The house was appraised for
$107,000.00 by Diversified Appraisals. We hired Bendinsky and Co. as auctioneers and
the sale was held on October 8, 2011. We required a reserve on the real estate. It sold
for $96,318.35. A mortgage that was held by Orrstown Bank for $26,092.02 was paid
off and $4857.52 for settlement charges leaving a balance of $65,368.63 which was
deposited in Ms. Deaven's account. She started paying the nursing home at the private
pay rate from this point on.
At the time of her death, her income sources were Social Security for $1072 and a
pension annuity of $1493.87. Her monthly expenses were $7291.57 to the nursing
home at the private pay rate and $150 as a guardianship fee to Cumberland County
Aging, also at the private pay rate. The final balance in the account is $4432.34. The
agency is in the process of notifying the Estate Recovery Office of the Department of
Public Welfare.
A summary of Dorothy Deaven's income and expenses are attached. Also included is a
copy of the check register.

On June 14, 2011 a final guardianship hearing was held before Judge Kevin Hess.
Cumberland County Aging and Community Services was appointed Dorothy Deaven's
