GIANT FOOD STORES, LLC 1149 Harrisburg Pike Carlisle, PA 17013 IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA Plaintiff NO. , 2013 CIVIL ACTION -LAW JURY TRIAL DEMANDED Defendant COMPLAINT 1. Plaintiff is James H. Hess, an adult individual who resides at 7928 Moyer Road, Harrisburg, Pennsylvania 17112. 2. Giant Food Stores, LLC is a Delaware limited liability company with its registered office located at 1149 Harrisburg Pike, Carlisle, Pennsylvania 17013. 3. On May 29, 2011, Plaintiff, James H. Hess, was a customer of Giant Food Store, LLC, (hereinafter "Giant") at the Hershey Store, on Route 39, Hershey Pennsylvania with an address of 277 Hershey Road, Hummelstown, Pennsylvania. 4. Mr. Hess was at the store to purchase some hamburger. 5. Mr. Hess made his way to the rear of the store near the meat department, deli and display case containing individual items. 6. As Plaintiff, James H. Hess, began to walk towards the rear of the store, he slipped and fell on a large area of wet floor, the existence of which was not apparent to him. He landed on his left knee. 1 7. Two Giant employees were in the vicinity, one of whom had been mopping. 8. A MRI was completed and shown that he had a small compression fracture in the left medial femoral condyle and an incomplete radial tear in the left medial menisuce. 9. On October 27, 2011, Mr. Hess underwent surgery performed by Dr. Robert Kaneda. 10. The pre-operative diagnosis was acute medial meniscal tear left knee, acute lateral meniscal tear left know. 11. Post-operatively the diagnosis was chondromalacia in the patellar formoral joint left knee and acute tear involving the mid-body and posterior horn of the medical meniscus left knee. 12. Plaintiff, James H. Hess had a left knee replacement on December 3, 2012. 13. Mr. Hess is attending physical therapy. 14. As a result of the tortious conduct of the Defendant as set forth herein, James H. Hess has suffered serious injuries, some of which may be permanent. 15. As a direct and proximate result of the tortious conduct of the Defendant, Plaintiff, James H. Hess, has suffered a chondromalacia in the patellar formoral joint left knee and acute tear involving the mid-body and posterior horn of the medical meniscus left knee, and has undergone extensive medical care, treatment including a left knee replacement and therapy that is continuing, for which he had incurred and will continue to incur medical expenses and expenses related thereto for which he claims herein. 16. As a direct and proximate result of the tortious conduct of the Defendant, Plaintiff, James H. Hess, has suffered and continues to endure pain and suffering, a loss of life's pleasures, mental anguish, emotional distress, scarring and disfigurement. 2 Liabili 17. The premises at issue herein are owned, operated, possessed and/or controlled by Giant. 18. At all times relevant hereto, Plaintiff, James H. Hess, was a business invitee. He was a patron on the day of this incident. 19. Defendant was negligent and careless in that: (a) It knew or should have known of the dangerous condition of the floor on the premises; (b) It knew or should have known that customers and others were shopping near or at the place of accident. (c) Defendant failed to properly maintain the premises by failing to put caution sign or warning signs where Mr. Hess fell. (d) Defendant failed to properly inspect and maintain the premises for dangerous conditions and correct the dangerous conditions that existed in the store or post proper warning. (e) Defendant failed to properly maintain the property. (f) Defendant created and permitted the dangerous conditions to exist. 3 WHEREFORE, Plaintiff, James H. Hess, demands judgment in his favor in the amount in excess of the amount requiring referral of this matter to arbitration pursuant to local rules.
