MECHANICS' LIEN CLAIM
AND NOW, comes the Plaintiff, E.F. Couvrette Company, Inc. d/b/a Couvrette Building
Systems (hereinafter referred to as "Couvrette"), by and through its undersigned counsel,
Houston Harbaugh, P.C., and pursuant to the Mechanics' Lien Law, 49 P.S. ~I10I, et seq.,
hereby files this Mechanics' Lien Claim against Respondents Franklin Financial Services
Corporation tJdlb/a F&M Trust and Carlisle Realty Partners, LP, the Owners, Reputed Owners
and/or Beneficial Owners, Lessees, Reputed Lessees and/or Beneficial Lessees as their interests
may appear against the real property, structure and premises described (the "Property") for the
payment of the debt in the principle amount of $20,281.00 plus interest, costs, penalties and
attorney fees, as applicable, and in support theroofavers as follows:
I. E. F. Couvrette, Inc. (hereinafter referred to as "Couvrette") is a corporation
registered in California. E. F. Couvrette operates a manufacturing division, "Couvrette Building
Systems," which designs, builds and installs ATM enclosures for banks around the country.

C'ouvrelle maintains the C'ou\'relle Building Systems corporate offices at 565 Electric Road,
Salem. VA 24153.
2. C'ouvrelle files the within Mechanic's Lien in its capacity as the contractor which
erected the ImprO\"ement on which payment rcmains due and owing.
3. Franklin Financial Ser\'ices C'orporation t/d/b/a F&M Trust r'F&M Trust'') is a
Pennsylvania corporation with a principal place of business located at 20 South Main Street.
C'hambersburg. P A 17201. F&M Trust is the owner and operator of the Improvement underlying
this lien.
4. Upon infomlation and belief. the address and/or location of the Improvement
erected and/or constructed by C'ouvrette is 700 East High Street, Carlisle, PA 17013 (the
"Property").
5. Upon information and belief, the Property upon which the Improvement was
erected and/or constructed by Couvrette is owned by Carlisle Realty Partners, LP ("Carlisle"), a
Pennsylvania Limited Partnership with a principal place of business at 2500 Brooktree Drive,
Suite 300, Wexford, PA 15090. Upon information and belief, F&M Trust leases the 700 East
High Street Property from Carlisle.
6. On or about December I, 2003, Couvrette and F&M Trust entered into a contract
whereby F&M Trust agreed to purchase, and Couvrette agreed to erect, one "Neighborhood
Branch with Three Lane Canopy" at the 700 East High Street location (hereinafter referred to as
the "Neighborhood Branch Structure"). A true and correct copy of the contract for the
construction of the Neighborhood Branch is attached hereto as Exhibit A ("December I, 2003
Contract").

7. Pursuant to the December 1,2003 Contract. F&M Tmst agreed to pay C'ouvrette
$208,810.00 for the erection and/or construction of the Neighborhood Branch Structure.
8. C'oU\'rette provided all labor and materials necessary for the complete erection
and/or construction of the Neighborhood Branch Structure. A complete description of the
materials and labor provided to F&M Trust by Cou\'rette is contained in the Exhibit attached
hereto as Exhihit A.
9. Pursuant to the tenns of the December I. 2003 Contract. F&M Tmst agreed that
30% of the purchase price was due upon the signing of the contract, 30% was due within the
earlier of 30 days from the contract date or upon completion of the Improvement, 30% was due
upon completion of the Improvement and 10% was due upon delivery of the Improvement. (See
Exhibit A).
10. F&M Tmst tendered the initial three (3) payments but has refused, despite
repeated requests, to tender the final 10% of the purchase price to Couvrette. The principle
amount remaining due and owing under the December I, 2003 Contract is $20,281.00. The
prices charged for Couvrette's services, labor and material were fair and reasonable and in an
amount which F&M Tmst agreed to pay under the December I, 2003 Contract. A copy of
Invoice OI70732-IN, the invoice evidencing the unpaid amount remaining under the December
1,2003 Contract, is attached hereto as Exhibit B.
II. Couvrelte last perfonned work on the Property on or about July 10, 2004. This
claim is therefore timely filed under 49 P.S. ~ 1502(a).
12. Upon infonnation and belief, Carlisle consented in writing to the Improvement to
the Property erected by Couvrette and otherwise acknowledged that the Improvement to the
Property was for the immediate use and benefit of Carlisle. Accordingly, Couvrelte claims this

lien against the fee simple interest. beneficial interest, direct and indirect ownership and/or
possessory interest of Carlisle. In the alternative. Couvrelle claims the lien against the leasehold
interest ofF&M Trust.
WHEREFORE. the Contractor/Claimant, Couvrctte Building Systems. claims to have a
Mechanics' Lien in the amount of $20,281.00 together with interest and costs against the
Owners/Respondents and the Property described herein. To the extent applicable. Couvrelle
Building Systems also asserts a claim and lien for interest, penalties and attorneys' fees pursuant
to Pennsylvania's Contractor and Subcontractor Payment Act. 73 P.S. *501. el seq.

1. Franklin Financial Services Corporation t/dlb/a F &M Trust was served by
personal service on Sandra Small at F&M Trust by the Franklin County Sheriff on November 16,
2004 at 2:35 pm.
2. A Notice of Filing of the Mechanics' Lien claim was transmitted and accepted on
behalf of Carlisle Realty Partners, L.P. by Guy DiRienzo via Federal Express on November 23,
2004.
3. Proper servIce of the Notice of Filing of the Mechanics' Lien claim was
