SUN YI CHON individually and trading as COUNTRY INN & SUITES and OCEAN HOSPITALITY :CIVIL ACTION -LAW Defendant(s) COMPLAINT The Plaintiff, SYSCO GUEST SUPPLY, LLC., by its attorneys, KODAK LAW OFFICES, P.C., brings this action of Assumpsit against the Defendant(s) to recover the sum of FIFTEEN THOUSAND EIGHT HUNDRED NINETY THREE DOLLARS AND EIGHTY FIVE CENTS ($15,893.85), along with interest thereon at the statutory rate from April 30, 2012, together with any and all court costs incurred by Plaintiff, upon a cause of action of which the following is a statement: 1. The Plaintiff, SYSCO GUEST SUPPLY, LLC., is a Limited Liability Company organized and existing under the laws of the State of New Jersey, having its principal office and place of business at 4301 US HIGHWAY, MONMOUTH JUNCTION NJ 08852-0910. 2. The Defendant, SUN YI CHIN, individually and trading as COUNTRY INN & SUITES and OCEAN HOSPITALITY, is an adult individual with a place of business at 4943 GETTYSBURG ROAD, MECHANICSBURG, CUMBERLAND COUNTY, PENNSYLVANIA 17055. F:\USER\Z-MASTER CMP FILES\COMPLAINTS\S\SYSCO GUEST SUPPLY LLC 38T77 akr.wpd 2 3. COUNTRY INN & SUITES and OCEAN HOSPITALITY are not entities duly organized and existing under the laws of the Commonwealth of Pennsylvania or State of New Hampshire. As such they are deemed sole proprietorships. True and correct copies of the Commonwealth of Pennsylvania and State of New Hampshire Corporation Bureau search print outs are attached hereto, collectively marked Exhibit "A" and made a part hereof. 4. On or about March 23, 2005 Defendant(s) submitted a Credit Application and to Plaintiff, which credit was granted to Defendant(s), a true and correct copy of which is attached hereto, marked Exhibit "B" and made a part hereof. 5. On the dates, in the amounts, and for the prices set forth in a true and correct copy of the Plaintiff Statement of Account hereto attached, marked 'Exhibit "C" and made a part hereof, Plaintiff, at the special instance request of the Defendant(s), sold and delivered goods, wares and merchandise and/or performed labor and provided services of the kind and description set forth on said Exhibit to the total amount of Fourteen Thousand Nine Hundred Ninety Four Dollars and Twenty Cents ($14,994.20). 6. The prices charged for said goods, wares and merchandise end/or labor and services provided were just and reasonable, were the legal and market prices therefor and were the prices which the Defendant(s) promised and agreed to pay to Plaintiff. 7. Due to Defendant(s) default in payment of said amount due and owing as aforesaid, F:\USER\Z-MASTER CMP FILES\COMPLAINTS\S\SYSCO GUEST SUPPLY LLC 38777 akr.wpd 3 interest has been added to said account in the total amount of Eight Hundred Ninety Nine Dollars and Sixty Five Cents ($899.65). 8. The balance due and owing by Defendant(s) to Plaintiff is the sum of Fifteen Thousand Eight Hundred Ninety Three Dollars and Eighty Five Cents ($15,893.85). 9. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature of same and have previously been provided to Defendant(s). 10. Plaintiff frequently demanded payment from Defendant(s) of said amount due and owing as aforesaid, but Defendant(s) refused and neglected and still refuse and neglect to pay said amount or any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendant (s) the sum of FIFTEEN THOUSAND EIGHT HUNDRED NINETYTHREE DOLLARSAND EIGHTY FIVE CENTS ($15,893.85), together with interest as set forth herein, together with any and all court costs incurred by Plaintiff.
