COMPLAINT
1. The Plaintiff is WESLEY A. TATS, an adult individual,
residing at 598 Zion Road, Carlisle, Cumberland County, PA
17013.
2. Defendant RYAN S. MARSH, is an adult individual, residing
at 1242 Rebert Drive, Mechanicsburg, Cumberland County, PA
17039.
3. Defendant JENNIFER R. MARSH, is an adult individual,
residing at 1242 Rebert Drive, Mechanicsburg, Cumberland County,
PA 17039.
4. Ryan S. Marsh and Jennifer R. Marsh are husband and wife.
5. On or about Thursday, October 20, 2011, at approximately
05:56 a.m., Plaintiff Wesley A. Tate was a passenger in a 2007
Chevrolet Trailblazer being driven by his son, Andrew N. Tate.
6. At the afore-stated date and time, Defendant Ryan S.
Marsh was the driver of a 1993 Honda Accord.
7. Jennifer R. Marsh is named as a Defendant in this action

as owner of the 1993 Honda Accord. (See Police Crash Report,
page 2, attached as Exhibit "F".)
8. At the afore-stated date and time, Ryan Marsh was
traveling southeast on Locust Point Road (State Highway 1007)
just north of Boiling Springs Road (State Highway 174), in
Monroe Township, Cumberland County, PA.
9. At the afore-stated date and time, Andrew N. Tate was
driving northeast on Boiling Springs Road, conveying his
passenger, Wesley A. Tate.
10. At the afore-stated date and time, Ryan Marsh failed to
stop at a stop sign at the intersection of the Locust Point Road
and Boiling Springs Road.
11. At the afore-stated date and time, the Marsh vehicle
entered upon Boiling Springs Road, into the path of the Tate
vehicle, causing a collision.
12. The Tate vehicle had the right of way, being upon the
dominant highway, and having no stop sign or other traffic
control signal at the mishap intersection.
13. Plaintiff Wesley A. Tate sustained injuries resulting
from the aforementioned collision, said injuries being described
hereinafter, in subsequent paragraphs.

NEGLIGENCE

14. The averments of paragraphs 1 through 13 of the
Plaintiff's complaint are incorporated herein by reference
thereto as though set forth in their entirety.
15. Ryan Marsh owed a duty to all motorists and pedestrians,
including Plaintiff, to operate his vehicle safely and to avoid
a collision by being attentive to his driving, and observing
official traffic signs, signals, and rules regarding right-of-
way.
16. Ryan Marsh admitted to the investigating PSP trooper that
he "was not paying attention" and that he "ran the stop sign".
(See Police Crash Report, attached as Exhibit "F").
17. Defendant Ryan Marsh failed in his duty to operate his
vehicle safely by failing to be attentive, running the stop
sign, and failing to yield the right of way to a vehicle on
Boiling Springs Road. This failure constitutes negligence.
18. Defendant Ryan Marsh's negligence was the direct and
proximate cause of the severe bodily injury incurred by Wesley
A. Tate. But for Defendant's action in running the stop sign the
injury to Plaintiff would not have occurred.
19. Plaintiff Wesley A. Tate was injured in the following
particulars:
a. Severe tendon and ligament strains to the left hip
joint .
b. Lumbar spine injuries to include ruptured discs.
c. Injury to nerves in the lumbar, hip, and lower
extremity areas.

20. The above injuries caused Plaintiff a pronounced limp due
to severe pain in the left hip area, and that limp and pain may
be permanent.
COUNT II
WESLEY A. TATE VS. JENNIFER R. MARSH
NEGLIGENCE
21. The averments of paragraphs 1 through 20 of the
Plaintiff's complaint are incorporated herein by reference
thereto as though set forth in their entirety.
22. Defendant Jennifer Marsh owed a duty to all motorists and
pedestrians, including Plaintiff, to entrust her vehicle only to
a person who would operate it safely by being attentive to his
driving and observing all official signs, signals, and rules
regarding right-of-way.
23. By entrusting Ryan Marsh with the use and operation of
her automobile, Defendant Jennifer Marsh failed in her afore-
said duty. Her failure in this regard constitutes negligence.

DAMAGES
24. The averments of paragraphs 1 through 23 of the
Plaintiff's complaint are incorporated herein by reference
thereto as though set forth in their entirety.
25. Plaintiff has incurred medical expenses amounting to over
$28,325.00 as of date of this complaint (See Summary of Medical
Expenses, attached as Exhibit "A").
26. Plaintiff has incurred incidental expenses for medical

treatment amounting to over $6,115.00 as of date of this
complaint. (See Summary of Incidental Expenses, attached as
Exhibit "B").
27. Plaintiff has been unable to work at his job as a
delivery driver and loader of commercial refrigeration equipment
at Remco, Inc., Mechanicsburg, PA. To date, Plaintiff has lost
289 days of employment as a result of the herein-stated
injuries. He has lost at least $26,664.00 in pre-tax income.
(See Summary of Lost Income from Employment, attached as Exhibit
„C„) .
28. Without full recovery from his injuries, Plaintiff will
not be able to return to Remco, Inc., as his duties require
heavy physical labor, and therefore, he will lose potentially
seven years of wages from that employment. The future lost wages
amount to $167,904 (not adjusted for inflation, nor reduced to
Net Present Value). (See Summary of Lost Income from Employment,
attached as Exhibit "D")
29. Plaintiff has experienced severe and chronic pain and
suffering, and loss of enjoyment of life, for which he is
entitled to compensation, in an amount to be determined by the
jury or the Court.
30. Plaintiff's pain and suffering, and loss of enjoyment of
life, may last well into the future, for which he is entitled to
compensation, in an amount to be determined by the jury or the
Court.
31. Plaintiff's non-economic damages are not limited by the
Limited Tort provisions of Pennsylvania's MVFRL, as he owned, at
the time of the collision, Full Tort insurance coverage. (See

declarations page of his policy, attached as Exhibit "E".)
32. Plaintiff's damages exceed the arbitration limit of the
Court.
33. Plaintiff reserves the right to amend his claim for
damages to add any and all other damages that he has incurred,
or may incur, up to the date of presenting such damages to the
court or jury.
34. WHEREFORE, Plaintiff Wesley A. Tate demands judgment
against the Defendants Ryan S. Marsh and Jennifer R. Tate for
all damages and/or costs of suit allowed by law and demonstrated
by the proof.

generally, PMVFRL applies to Plaintiff' s claims. Denied that
Plaintiff' s claims for non-economic damages are subject to
"limited tort" provisions of PMVFRL, as the Plaintiff' s proof
will show that he elected the full tort option on his insurance
coverage. Denied that Plaintiff' s claim for recovery of medical
expenses may be reduced or barred by PMVFRL.
