For the renovation of premises known as 900 Grantham Road, Mechanicsburg, P~'
Now, January 1$, 2013, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Charles Babcock and Laurel
Babcock to the said Melhorn Builders, Inc. to commence work on the said building, or
purchase materials for the same in consideration of the marking of the said contract with
Charles Babcock and Laurel Babcock and the further consideration of one Dollar, to
Melhorn Builders, Inc., paid by Charles Babcock and Laurel Babcock is agreed that no lien
shall be filed against the building by the contractor, or any sub-contractor, or by any of the
material men or workmen or any other person for any labor, or materials purchased, extra
labor or materials purchased for the erection of said building, the right to file such liens
being expressly waived.

ALL THAT CERTAIN tract of land, situate in the Township of Upper Allen, County of
Cumberland, and Commonwealth of Pennsylvania, being more particularly bounded and
described in accordance with a survey made by R.J. Fisher & Associates, Inc., dated
April 24, 2008, as follows, to wit:
BEGINNING at a rebar set in the northern line of Grantham Road, (50' right of way) at
its point of intersection with the western line of McCormick Alley; thence along the
northern line of said Grantham Road, North eighty-seven (87) degrees six (06) minutes
fifty-eight (58) seconds West, for a distance of ninety and four tenths (90.4) feet to a
rebar set; thence along lands now or formerly of William W. and Peggy Ann Price,
thence along lands of Price, North two (02) degrees fifty-three (53) minutes two (02)
seconds West, for a distance of one hundred thirty-nine and eighty-nine hundredths
(139.$9) feet to a rebar set; thence along lands now or formerly of Robert P. Woodring,
II, North eighty-seven (87) degrees six (06) minutes fifty-eight (58) seconds East, a
distance of sixty-one and twenty-two hundredths (61.22) feet to a rebar set; thence along
McCormick Alley, South fourteen (14) degrees forty (40) minutes two (02) seconds East,
a distance of one hundred forty-two and ninety hundredths (142.90) feet to a point, the
point and place of BEGINNING.
BEING Lot #4 on a Plan of Lots known as "West Grantham Annex," recorded in the
Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan
Book 6, at page 34.
BEING THE SAME PREMISES which Robert S. Getty, III and Susan K. Getty,
husband and wife, conveyed unto Charles Babcock and Laurel Babcock, husband and
wife by deed dated May 28, 2008 and recorded June 3, 2008 in the Recorder's Office in
and for Cumberland County, Pa. in Instrument #200818309.
