Explanation of Compromise Offer: The reasoning behind the compromise offer is as follows: File Number 21-11-0642 The trust provides for discretionary payments of principal and income to the deceased' 88 year old sister and 60 year old niece. Upon the death of both, the remainder passes to numerous charities. Since the inception of the estate, payments of $4500 per month have been made to the sister for nursing home expenses. We do not expect the niece to make any significant oi• regular invasions into principal. Accordingly, we have calculated an annuity interest for the sister based on her receiving $4500 per month for the remainder of her life. We then calculated a life estate interest for the balance of the fund for the niece. The difference between the total value of the future interest and the sum of the values of the annuity and life estate interests is being taken as a charitable deduction. The actuarial factor and annuity factor were obtained from the Department of Revenue (Holly Moore) using the 3% variable rate table. PETITION FOR ADJUDICATION FOR THE ESTATE OF MARY CATHERINE COBLE Exhibit "B"for Paragraph 14A; The following matter requires adjudication by the Court. 1. The Last Will and Testament of Mary Catherine Coble devises and bequeaths the residue of the estate to a trust created by the deceased on July 21, 1972, as amended. 2. By amendment to the trust on March 4, 2002, the decedent directed the distribution oP the trust estate at the death of the life tenants to 11 different charities in varied percentage amounts. Item III.B.(3) distributes 71/2 percent to "Professional Hospice Care". Note also that Item III.B.(2) distributes 71/2 percent to Hospice of Central Pennsylvania. 3. Petitioner has determined that neither at the time of the decedent's death nor on March 4, 2002, the date of the First Amendment to the Mary Catherine Coble Revocable Trust Agreement, did there exist an organization or entity by the name "Professional Hospice Care." 4. After investigation, Petitioner has learned that there existed on March 4, 2002, four hospice organization in Central Pennsylvania: AseraCare Hospice, 75 S. Houcks Road, Suite 101, Harrisburg, PA 17109 Crossings Hospice of the VNA, 3315 Derry Street, Harrisburg, PA 17111 Compassionate Care Hospice, 1513 Cedar Cliff Drive, Camp Hill, PA 17011 Hospice of Central Pennsylvania, 1320 Linglestown Road, Harrisburg, PA 17110 (See the attached letter from Susan Coble, Director of Bureau of Community Program Licensure and Certification, Department of Health, of January 24, 2013, evidencing the same.) 5.
