COMPLAINT
The Plaintiff, C A CURTZE, CO., by its attorneys, KODAK LAW OFFICES, P.C.,
brings this action of Assumpsit against the Defendant(s) to recover the sum of THIRTEEN
THOUSAND NINE HUNDRED TWENTY-ONE DOLLARS AND FIFTY-THREE CENTS
($13,921.53), along with interest thereon at the statutory rate from April 7, 2012, together
with any and all court costs incurred by Plaintiff, upon a cause of action of which the
following is a statement:
1. The Plaintiff, C A CURTZE, CO., is a corporation organized and existing under the
laws of the Commonwealth of Pennsylvania, having its principal office and place of
business at 1717 East 12th Street, Erie, Pennsylvania 16511.
2. The Defendant, TSITSIRIS ENTERPRISES, INC. dba Summer Dale Diner, is a
corporation having its principal office and place of business at CIO: Jimmy
Tsitsiris, President, 1124 Powderhorn Road, Mechanicsburg, Cumberland
County, Pennsylvania 17050.
3. The Defendant, JIMMYTSITSIRIS, Personal GuarantorforTsitsiris Enterprises, Inc.

dba Summer Dale Diner, is an adult individual residing at 1124 Powderhorn Road,
Mechanicsburg, Cumberland County, Pennsylvania 17050..
4. Defendant, TSITSIRIS ENTERPRISES, INC. dba Summer Dale Diner, is a
corporation organized and existing under the laws of the Commonwealth of
Pennsylvania, as more fully set forth on the Pennsylvania Department of State
Corporation Bureau print outs attached hereto, collectively marked Exhibit "A"and
made a part hereof.
5. Defendant(s) submitted a Credit Application and Personal Guaranty to Plaintiff,
which credit was granted to Defendant(s), a true and correct copy of which is
attached hereto, marked Exhibit "B" and made a part hereof.
6. On the dates, in the amounts, and for the prices set forth in a true and correct copy
of the Plaintiff s hereto attached, marked Exhibit "C" and made a part hereof,
Plaintiff, at the special instance request of the Defendant(s), sold and delivered
goods, wares and merchandise and/or performed labor and provided services of the
kind and description set forth on said Exhibit to the total amount of Eleven
Thousand Six Hundred One Dollars and Twenty-Eight Cents ($11,601.28).
7. The prices charged for said goods, wares and merchandise and/or labor and
services provided were just and reasonable, were the legal and market prices
therefor and were the prices which the Defendant(s) promised and agreed to pay
to Plaintiff.

8. Due to the default of Defendant(s), and pursuant to the terms and conditions of the
Credit Application and Personal Guaranty executed by Defendant(s) hereto
attached as Exhibit "B", attorney's fees in the total amount of Two Thousand
Three Hundred Twenty Dollars and Twenty-Five Cents ($2,320.25) have been
added to said account.
9. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature
of same and have previously been provided to Defendant(s).
10. Plaintiff frequently demanded payment from Defendant(s) of said amount due and
owing as aforesaid, but Defendant(s) refused and neglected and still refuse and
neglect to pay said amount or any part thereof.
WHEREFORE, Plaintiff brings this suit to recover from Defendant (s) the sum of
THIRTEEN THOUSAND NINE HUNDRED TWENTY-ONE DOLLARSAND FIFTY-THREE
CENTS ($13,921.53), together with interest as set forth herein, together with any and all
court costs incurred by Plaintiff.
