GROUP, INC., Defendant JURY TRIAL DEMANDED COMPLAINT 1. Plaintiff is Down East Fabrication, Inc., a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, and having offices at 215 Salem Church Road, Mechanicsburg, Cumberland County, Pennsylvania, 17050. 2. Defendant is Pennsylvania Office Service Group, Inc., a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, and having a place of business at 309 South 10`h Street, Lemoyne, Cumberland County, Pennsylvania, 17043. 3. Plaintiff's business includes the fabrication of table tops and countertops, from Corian and other products. 4. On May 24, 2012, Defendant issued to Plaintiff a purchase order for 21 Corian countertops, for a total price of $24,307.15. A copy of the aforesaid purchase order is attached hereto, made a part hereof, and labeled Exhibit "A". 5. Defendant ordered the countertops for delivery and installation to the Pennsylvania Department of Military and Veterans Affairs as a part of Defendant's contract or subcontract with the Department. 6. In compliance with the purchase order, Plaintiff fabricated the countertops and delivered them to Defendant, and then issued to Defendant an invoice dated June 15, 2012, in the total amount of $24,307.15. A copy of the invoice is attached hereto, made a part hereof, and labeled Exhibit "B". 7. Defendant received payment for the countertops from its vendor, but has failed and refused, despite numerous demands, to pay Plaintiff's invoice. 8. The countertops were delivered by Plaintiff to Defendant in good and proper condition, and in complete compliance with Defendant's request and specifications, and Plaintiff has never received any complaint from Defendant that the countertops were not properly fabricated or were not in satisfactory condition upon delivery. - 2 - 9. Plaintiff claims all remedies available to it under the Contractors and Subcontractors Payment Act (73 P.S. 501, et seq.), including penalties, interest and attorneys' fees. WHEREFORE, Plaintiff demands judgment against Defendant in the amount of $24,307.15, together with penalties, interest, attorneys' fees and costs.
