HomeMy WebLinkAbout13-0656Stipulations Against Liens FG•J.SC The Rutt Family Sonshine, LP Keystone Custom Homes, Inc. ~tt tCje court of Q~ommou ~Cea~ QCountp of Cumberland OH~ner ,Pennsylvania Docket Number ~ ~ CP J W ~ (/~ Term 2012 Contractor Page Number ~Cjerea~, The Rutt Family Sonshine, LP, hereinafter called the Owner, is about to execute contemporaneously with Keystone Custom Homes, Inc. of 227 Granite Run Drive, Suite 100, Lancaster, PA 17601, hereinafter called the Contractor, a contract for the erection or construction of a SINGLE FAMILY DWELLING upon the lot of ground known as 18 Hunt Place, Mechanicsburg, PA 17050, Foxwood, Silver Spring Township, Mechanicsburg, Cumberland County, Pennsylvania, described in Exhibit "A" hereof, of which The Rutt Family Sonshine, LP is the title holder of record, as more particularly described in Deed Book ,Page ;and .~obu, •5 ~ 7iU ~ , at the time of and immediately before the execution of the principal contract, and before any authority h~ been given by the Owner to the Contractor to commence work on said building or improvement, to purchase materials for the same, it is hereby stipulated and agreed by and between said parties as part of said contract and for the consideration therein set forth, nether the undersigned Contractor, any Sub-contractor or material man, nor any other person furnishing labor or materials to the said Contractor under the contract entered into between said parties shall file a lien for work done or material furnished to said building, improvements or any part thereof. ~1)is stipulation is made and intended to be filed with the Prothonotary within 10 days after date in accordance with the requirements of the Act of August 24, 1963, P.L. 497, as amended, ,31n ~rtne~s Whereof, the said parties have hereunto set their hands and seal the day and year aforesaid. Herr, Assistant Vice President c~~9 ~~agC~2a3 File No. FWS002 All that certain lot or tract of ground situate in Silver Spring Township, Cumberland County, PA, more particularly bounded and described as follows, to wit: Beginning at a point on the eastern right-of-way line of Foxwood Boulevard at the northwest corner of Lot #1 on the southern line of a 50' Atlantic Pipeline Easement; thence along said right-of-way line and through said easement N04-04-34E 33.73 feet to a point; thence along and through the same N09-30-11 E 97.42 (Erroneously set forth as 88.91 in Plan Book 90, Page 18) feet to a point; thence along the same by a curve to the right, said curve having a chord bearing and distance of N54-30-11 E 26.87 feet, a radius of 19.00 feet and an arc distance of 29.85 feet to a point on the southern right-of-way line of Hunt Place at its intersection with the eastern right-of-way line of Foxwood Boulevard; thence along said southern right-of-way line S80-29-49E (Erroneously set forth as S79-55-44E in Plan Book 90, Page 18) 103.20 feet to a point being the northwest corner of Lot #3; thence along Lot #3 and through said 50' Atlantic Pipeline Easement S09-30-11 W 150.00 feet to a point on the northern line of Lot #1; thence along Lot #1 and said easement N80-29-49W 119.05 feet to a point, being the place of beginning. Containing 18,198 square feet. (0.42 acres) Being Lot #2 on a Preliminary Final Subdivision Plan for Foxwood, prepared by R. J. Fisher and Associates, Inc., recorded in Plan Book 90, Page 18.
