NO.: CIVIL ACTION -COMPLAINT IN MORTGAGE FORECLOSURE And now comes Farmers and Merchants Trust Company of Chambersburg, by its attorneys, James, Smith, Dietterick & Connelly LLP, and files this Complaint in Mortgage Foreclosure as follows: The Plaintiff is Farmers and Merchants Trust Company of Chambersburg, which has its principal place of business at P.O. Box 6010, Chambersburg, Pennsylvania 17201. 2. The Defendants, Gordon Holl a/k/a Gordon D. Holl and Amy Holl a/k/a Amy H. Holl, are adult individuals whose last known address is 355 Hunters Road, Newville, Pennsylvania 17241. 3. On or about June 1, 2000, Defendants executed a Note in favor of Plaintiff in the original principal amount of $430,000.00. A true and correct copy of said Note is marked Exhibit "A", attached hereto and made a part hereof. 4. On or about June 1, 2000, as security for payment of the aforesaid Note, Defendants made, executed and delivered to Plaintiff a Mortgage in the original principal amount of $430,000.00 on the premises hereinafter described, with said Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on June 5, 2000, in Mortgage Book Volume 1616, Page 452. A true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "B", attached hereto and made a part hereof. 5. Defendants are the record and real owners of the aforesaid mortgaged premises. 6. Defendants are in default under the terms of the aforesaid Mortgage and Note for, inter alia, failure to pay the monthly installments of principal and interest when due, being due for the March 5, 2010 monthly payment and all payments thereafter, with a past due amount as of January 5, 2013 of $97,412.04. 7. Plaintiff was not required to send Defendants' Notice of Homeowners' Emergency Mortgage Assistance Act of 1983 pursuant to 35 P.S. §1680.401 et. seq. ("Act 91") based on the exception provided for in 35 P.S. §1680.403c (f), which states: Notwithstanding any other provisions of this section, a mortgagee shall not be required to send the uniform notice provided in subsection (b): (1) to any mortgagor who is more than twenty-four (24) consecutive or nonconsecutive months in arrears on the residential mortgage in question, no matter what the reason therefore; or (2) where the aggregate amount of arrearages due to a mortgagee pursuant to the terms of the mortgage, without regard to any acceleration under the mortgage including, but not limited to, the amount of principal, interest, taxes, assessments, ground rents, hazard insurance, any mortgage insurance or credit insurance premiums, exceeds the sum of sixty thousand ($60,000) dollars. 35 P.S. § 1680.403c. 8. Plaintiff was also not required to send Defendant a Notice of Intention to Foreclose Mortgage, in compliance Act 6 of 1974, 41 P.S. § 101, et seq., prior to the commencement of this action for the reason that the original principal balance of the aforesaid Mortgage is more than the "base amount" threshold of the Act, and therefore: (a) said Mortgage is not a "residential mortgage" as defined in 41 P.S. §101; (b) the Defendant(s) is/are not "residential mortgage debtor(s)" as defined in 41 P.S. § 1 O 1, and; (c) the mortgage premises is not "residential real property" as defined in 41 P.S. §101. 9. The total amount due and owing Plaintiff by Defendants is as follows: Principal $ 170,029.99 Interest through 1/5/13 $ 16,332.32 Late Charges $ 5,672.70 TOTAL ~ 192,035.01 plus interest on the principal sum from January 5, 2013, at the contractual rate, plus additional late charges, and costs (including additional escrow advances), additional attorneys' fees and costs and for foreclosure and sale of the mortgaged premises. WHEREFORE, Plaintiff demands judgment in mortgage foreclosure for the amount due of $ 192,035.01, with interest thereon at the contractual rate from January 5, 2013, plus additional late charges, and costs (including additional escrow advances), additional attorneys' fees and costs and for foreclosure and sale of the mortgaged premises. Gordon Holl and Amy Holl ("borrower") promise to pay to FARMERS AND MERCHANTS TRUST COMPANY OF CHAMBERSBURG ("Lender"), or order, in lawful money of the United States of America, the principal amount of Four Hundred Thirty Thousand &00/100 Dollars ($430,000.00), together with interest on the unpaid principal balance from June 1, 2000, until paid in full. PAYMENT. Subject to any payment changes resulting from changes in the Index, Borrower will pay this loan in accordance with the following payment schedule: 6 consecutive monthly interest payments, beginning July 5, 2000, with interest calculated on the unpaid principal balances at an interest rate of 8.900% per annum; 54 consecutive_ monthly principal and interest payments of 53,636.60 each, beginning January 5, 2001, with interest calculated on the unpaid principal balances at an interest rate of 8.900% per annum; 119 consecutive monthly principal and interest payments in the initial amount of $3,796.13 each, beginning Juty 5, 2005, with interest calculated on the unpaid principal balances at an interest rate of 0.00 percentage points over the Index described below; and 1 principal and interest payment in the initial amount of 5295,406.06 on June 5, 2015, with interest calculated on the unpaid principal balances at an interest rate of 0.00 percentage points over the Index described below. This estimated final payment is based on the assumption that alt payments will be made exactly as scheduled and that the Index does not change; the actual final payment will be for all principal and accrued interest not yet paid, together with any other unpaid amounts under this Note. The annual interest rate for this Note is computed on a 3651360 basis; that is, by applying the ratio of the annual interest rate over a year of 360 days, multiplied by the outstanding principal balance, multiplied by the actual number of days the principal balance is outstanding. Borrower will pay Lender at Lender's address shown above or at such other place as Lender may designate in writing. Unless otherwise agreed or required by applicable law, payments will be applied first to accrued unpaid interest, then to principal, and any remaining amount to any unpaid collection costs and late charges. VARIABLE INTEREST RATE. The interest rate on this Note is subject to change from time to time based on changes in an independent index which is the New York Prime Rate as published in the Wall Street Journal. When a range of rates has been published, the higher of the rates will be used. (the "Index"). The Index is not necessarily the lowest rate charged by Lender on its loans. If the Index becomes unavailable during the term of this loan, Lender may designate a substftute index after notice to Borrower. Lender will tell Borrower the current Index rate upon Borrower's request. Borrower understands that Lender may make loans based on other rates as well. The interest rate change will not occur more often than each time there has been a change in the Index. The Index currently is 9.500% per annum. The interest rate or rates to be applied to the unpaid principal balance of this Note will be the rate or rates set forth above in the "Payment" section. NOTICE: Under no circumstances will the rc~terest rate on this Note be more than the maximum rate allowed by applicable law. Whenever increases occur in the interest rate, Lender, at its option, may do one or more of the following: (a) increase Borrower's payments to ensure Borrower's -loan will pay off by its original final maturity date, (b) increase Borrower's payments to cover accruing interest, (c) increase the number of Borrower's payments, and (d) continue Borrower's payments at the same amount and increase Borrower's final payment. PREPAYMENT. Borrower agrees that all loan fees and other prepaid finance charges are earned fully as of the date of the loan and will not be subject to refund upon early payment (whether voluntary or as a result of default), except as otherwise required by law. Except fa the foregoing, Borrower may pay without penalty all or a portion of the amount owed earlier than it is due. Early payments will nct, unless agreed to by Lender in writing, relieve Bonower of Borrower's obligation to continue to make payments under the payment schedule. Rather, they will reduce the principal balance due and may result in Borrower making fewer payments. LATE CHARGE. If a payment is 16 days or more late, Borrower will be charged 6.000% of the regularly scheduled payment. DEFAULT. Borrower wilt be in default 'rf any of the following happens: (a) Borrower fails to make any payment when due. (b) Borrower breaks any promise Borrower has made to Lender, or Borrower fails to comply with or to pertorm when due any other term, obligation, covenant, or condition contained in this Note or any agreement related to this Note, or in any other agreement or loan Borrower has with Lender. GENERAL PROVISIONS. Lender may delay or forgo enforcing any of its rights or remedies under this Note without losing them. Borrower and any other person who signs, guarantees or endorses this Note, to the extent allowed by law, waive presentment, demand for payment, protest and notice of dishonor. Upon any change in the terms of this Note, and unless otherwise expressly stated in writing, no party who signs this Note, whether as maker, guarantor, accommodation maker or endorser, shall be released from liability. All such parties agree that Lender may renew or extend (repeatedly and for any length of Ume) this loan, or release any party or guarantor or collateral; or impair, fail to realize upon or perfect Lender's security interest in the collateral; and take any other action deemed necessary by Lender without the consent of or notice to anyone.
