HomeMy WebLinkAbout04-5448Emergency Petition Presented to the Court of Common Pleas of Cumberland County, Pennsylvania, by Brock Bender Evans, aged 18, resident of Cumberland County, on this twenty-eighth day of October, 2004. Anticipating my 18th birthday on October 1, 2004, during the early part of the week of September 26th, 2004, I completed an application to register to vote in Cumberland County. My mother, Mary Ann Evans, placed the correctly addressed and stamped application in our home mailbox, with the flag on the mailbox raised, so that our mail carder would pick up the application and ultimately have it delivered to the Bureau of Elections and Voter Registration in Cumberland County. My mother called the Bureau on approximately October 7 or 8, 2004 to inquire about an absentee ballot for my brother. She also stated that I had not received a voter registration card yet and asked when to expect it. My mother and the woman at the Bureau spoke in general terms, they were not talking about my specific registration. My mother was told that all absentee ballots and voter registration cards would be mailed in mid-October. My mother called the Bureau again on either October 20 or 21, 2004. This time she made specific inquiries about my brother's ballot and my registration card. She was told that my brother's ballot had been mailed to him the previous day, but my application for registration could not be found. The woman at the Bureau said that she would keep looking and would call back to my mother. On October 22, 2004, my mother received a message from ~e Bureau that my application could not be found at all. On October 25, 2004, my mother called the Bureau and was told that there was nothing to be done to allow me to exercise my right to vote for this election, even though I had fulfilled my part in the application process. My mother also contacted the United States Post Office in Newville, Pennsylvania and inquired about my application that had been picked up by a postal worker at the Newville Post Office. She was told that because the mail from Newville is routed to Harrisburg and then to its destination, that a piece of mail could not be tracked, and it could have been "lost" anywhere between Newville, Harrisburg and Carlisle. Today, I am submitting this emergency petition to the Court, .hopeful that the Court will recognize that I have fulfilled the requirements to be permitted to become a registered voter in Cumberland County, Pennsylvania before the registration deadline of October 4, 2004, and will grant that I will have the fight to vote in Cumberland County in the election on November 2, 2004. Now that this petition has been heard, I am asking that a Judge, in Cumberland County, Pennsylvania, with the authority to do so, sign this petition, which will permit me to become a registered voter in Cumberland County, Pennsylvania, before November 2, 2004 w~i~h will allow m~vo~ct~n on November 2, 2004.
