MICHAEL D. PAINTER and CHERYL L. PAINTER, Defendants COMPLAINT 1 . Plaintitl'is Mortgage Electronic Registration Systems, Inc. 2. The Defendants are Michael D. Painter and Cheryl L. Painter whose last known addresses are: Michael D. Painter 2250 Dusty Lane Enola, P A 17025 Cheryl L. Painter j 17 Wye Road Essex. MD 21221 3. The Defendants are the Mortgagors and real owners of the Premises. hereinafter described. 4. ()n April 3. \99X Defendants made. executed and delivered a mortgage upon the Premises hereinafter described and commonly known as 110 Mountain Road. Newville. Lower Miftlin. Township. Cumberland County. Pennsylvania which Mortgage is recorded in the Recorder's Office tor Cumberland County in Book 1445. Page 965. See Exhibit "A" attached hereto and incorporated herein. 5. The Mortgage was assigned to Conti Mortgage Corporation herein by virtue of au Assignment dated April 3, 199R and recorded in the aioresaid Recorder's Office in Book 587. Page 477" a copy of which is attached hereto and incorporated herein as Exhibit "B". 6. The Mortgage was assigned to Christiana Bank & Trust Company as owner trustee It)}" Security National Funding Trust herein by virtue of an Assignment dated June 9, 2003 and recorded in the altm~said Recorder's Oftice in Book 709, P~lge ()()2, a copy of which is attached hereto and incorporated herein as Exhibit "C"". 7. The Mortgage was assigned to Mortgage Electronic Registration Systems, Inc. herein hy virtue of an Assignment dated September 2, 2004 and recorded in the aforesaid Recorder's Oftice in Book 711, Page 2663, a copy of which is attached hereto and incorporated herein as Exhibit "D'". R. The mortgaged Premises are attached as part of Exhibit "A"", 9. The mortgage is in default in that monthly payments of $811.16 are due for the month of June 2001 and for each month thereafter are due and unpaid. Such failure to make monthly payments constitutes a default under the terms ofthe mortgage, entitling Plaintiffto demand payment of the entire principal balance, together with interest. costs and fees. 10. The following amounts are due on thc mortgage: Principal balance: $96,045.24 Interest from 6/15/01 through 9/3/04 $29,334.85 Attorneys fees 10% $13,659.22 Late Charges $632.71 Costs of Suit to date $250.00 Title Search $150.00 Escrow Deficit $10.179.38 Returned Check Fee -0- Delinquent Real Estate Taxes $0.00 Per Diem interest of $24.27 from ()/]/04 accrumg Total $150,251.40, plus accruals II. The attorneys fees set forth above are pursuant to the mortgage documents and will he collected at Sheriffs sale. Defendants' application for assistance has been denied by the Pennsylvania Housing Finance Agency.
