On March 3, 2005 plaintiffs counsel noticed the dep sition of Laura Davis, acting in her capacity as president of Salon Trends, Inc, d/b/a Your air Connection, for Monday, March 28, 2005. The notice of deposition also included an Exhibi "A" requesting that certain documents be brought to the deposition. The aforementioned notice f deposition was sent to Laura Davis by first class mail. The notice of deposition was also se t by certified, registered mail with return receipt requested but has since been returned to p aintiffs counsel as 247711 i , , I "unclaimed". A true and correct copy of the notice of deposition and docurent request is attached hereto, made a part hereof and marked as Exhibit "A". A true an correct copy of the proof of service by certified, registered mail with return receipt requested unclaimed enveloped is attached hereto, made a part hereof and marked as xhibit "B". 3. On March 18,2005 plaintiffs counsel again mailed he same notice of deposition in aid of execution by first class mail with proof of service. Ate and correct copy of the proof of service is attached hereto, made a part hereof and marked E hibit "C". 4. Counsel for plaintiff knows the address used for Lau a Davis is correct because that is the address she told him recently was her address. 5. Defendant failed to appear at the time and date desig ated for her deposition or offer any excuse for not appearing. 6. The court may, on motion, make an appropriate orde if a party fails to submit to discovery, pursuant to Pa.R.C.P. 4019(a)(1)(viii). 7. Plaintiffrequests that this Court direct defendant to a low plaintiff to take her deposition in aid of execution and provide the documentation responsiv to the notice of deposition within 15 days of this Court's Order. 8. In addition, plaintiff requests an award of reasonable ttorneys' fees for preparation of the within motion in the sum of$500.00. 9. Without defendant's deposition, plaintiff will be subs ntially impaired in executing on the judgment which it has obtained. 10. This Motion is filed pursuant to Pa.
