PREECE of R.R. #1, Box 348A, Morrisdale, Clearfield County, Pennsylvania, 16858, the ~ mother of TAMMY LYNN RANEY, the alleged incompetent. 19 ,-~~ 2. TAMMY LYNN RANEY is ,7e~ years of age having been / born on April 6, 19?3 and resides with the Petitioner at R.R. #1, Box 348A, Morrisdale, Pennsylvania, 16858. 3. The names and addresses of the next of kin of the alleged incompetent are as Poll 's: Luanne M. Preece, mother R.R. #1, Box 348A Morrisdale, FA 16858 Ronnie G. Raney, father R.R. #1 Carmi, IL fi2821 4. Hundred Eight ($408.00) Dollars a month in SSI, which is paid to the mother on her behalf. 6. The alleged incompetent was never a member of the Armed Services of the United States nor is she receiving any benefits from the United states veterans Administration. 7. That the alleged incompetent has been in the legal and physical custody of her mother, Petitioner herein, throughout her life except for a period of approximately one (1) year in 1988 when she resided with hc~r father. -- 8. The alleged incompetent has been residing with the Petitioner, her mother, since May of 19$9 as well as the earlier periods of her life. 9. The alleged incompetent has a mental state where she is unable to manage her property or make responsible decisions concerning her person or estate, and is liable to ,=~~'. become the victim of designing persona. ~' >" 10. The alleged incompetent is a patient of Beverly C. ~: Blaisure, M.D. of Geisinger Medical Group - Moshannon Valley, who '~x `*~ has been her primary treating physician. The alleged incompetent has certain physical liffiitations which prevent her from carrying weight in addition to the fact that her gross motor skills are not fully developed and her fins motor skills are somewhat limited. 13. The alleged incompetent will never be able to drive. 14. The alleged incompetent is expected to bs able to develop some type of semi-independent living skills but is never expected to be able to live or work strictly on her own independently. 15. The proposed Guardian of the Person and of the Estate of the alleged incompetent is LUANNE M. PREBCE of R.R. ~l, Box 348A, Morrisdale, Pennsylvania, 16858, who is the mother of the alleged incompetent. 16. That the Petitioner has been performing the activities performed by a Guardian of the Person and the Estate as the mother of this child prior to her turning 18. 19. The proposed Guardian has no interest adverse to the alleged incompetent. - 18. Preece to Adjudicate Tammy Lynn Raney an incapacitated person and appoint a Guardian on July 8, 1992, the Court makes the following Findings of Fact: 1. That Ta~mny Lynn Raney is a nineteen (19) year old mentally retarded female. 2. That Notice of Hearing was given to Luanne M. Preece, Tammy Lynn Raney and Ronnie G. Raney. 3. That Tammy Lynn Raney is presently enrolled in spacial education classes. 4. That tha school in cooperation with Tammy and her mother, Luanne M. Preece, has developed an Individual Educational Plan designed to work on certain skills to permit Tammy to be able to take care of her basic living needs such as food preparation, laundry and handling small sums of money. 5. That Tammy Lynn Raney is able to take care of her own personal Hygiene and grooming needs. 6. That Tammy Lynn Raney is not able to make decisions relating to her medical Heads independently. 11. That Tammy Lynn Raney may only be maintained vn the health insurance policy of h.er mother, Luanne M. Preece, if her mother is her legal guardian. 12. Preece, Tammy Lynn Raney has resided with the Petitioners at 105 Park Place, Camp Hill, Cumberland County, Pennsylvania (hereinafter "Park Place residence'. 7. The only other party in interest in the guardianship matter of Tammy Lynn Raney is Ronnie G. Raney, her father, an adult individual residing at 1335 County Road, 1175 East, Carmi, Illinois. 8. Ronnie G. Raney has been given notice of Petitioners' desire to become successor guardians and has signed an affidavit consenting to the appointment of Melissa A. Dixon and Jason M. Dixon as Guardians of the Person and the Estate of Tammy Lynn Raney (a true and correct copy of which is attached as part of Exhibit A). 9. Melissa A. Dixon and Jason M. Dixon intend to reside in Cumberland County for the foreseeable future. 10. It is the desire of Melissa A. Dixon and Jason M. The appointment of Jason M. Dixon as a second guardian will offer stability, given that the Petitioners reside together with Tammy Lynn Raney, and will also be a safeguard in the event of emergency. 12. It is out of love and affection that Melissa A. Dixon and Jason M. Dixon wish to serve as guardians of Tammy Lynn Raney, and Petitioners believe they have no interest adverse to the interest of Tammy Lynn Raney. 13. The failure to appoint Melissa A. Dixon and Jason M. Dixon as guardians will result in irreparable harm to the person and estate of Tammy Lynn Raney. 14. Tammy Lynn Raney receives approximately $823.00 per month in the form of a Social Security payment because she has been determined to be a dependent adult child. I5. Melissa A. Dixon is the representative payee of Tammy Lynn Raney's monthly Social Security payment. 16. Petitioners assert, upon information and belief, that a comparable living arrangement for Tammy Lynn Raney, at the Cumberland Vista assisted living center, would cost about $1,643.30 per month, $1,143.30 of which can be covered by Supplemental Security Income (SSI) or Social Security benefits, with an additional $500.00 per month made up from private funding sources. 17. With this in mind, it would be both reasonable and appropriate to allow Petitioners to be compensated any remainder of Tammy Lynn Raney's monthly Social Security payment once her expenses axe met. 18. Extraordinary expenses incurred for the care of Tammy Lynn Raney can be covered by the approximately $24,000.00 available in the Raney Family Special Needs Trust, of which Melissa A. Dixon is trustee. 19. To the extent that the remainder of Tammy Lynn Raney's Social Security payment, after her reasonable expenses, is less than $200.00 per month, the Petitioners request that they would be compensated, beyond reimbursement for their expenses, that amount from the Raney Family Special Needs Trust, or such other trust as may be established for the benefit of Tammy Lynn Raney. 20. Petitioners previously filed a Petition to Transfer Venue in the Orphans' Court Division of the Court of Common Pleas of Clearfield County, Pennsylvania, in order to bring the present Petition in the Orphans' Court Division of the Court of Common Pleas of Cumberland County, Pennsylvania, which Petition has been granted. WHEREFORE, the Petitioners respectfully request that: 1. The Court appoint Melissa A. Dixon and Jason M. Dixon as successor guardians to Luanne M. Preece; 2.
