THIS AGREEMENT made thi y of
and between Qualcraft Construction LLC, of n ee
Wellsville, PA 17365, hereinafter referred to as Contractor,
Qualcraft Construction LLC, hereinafter referred to as Owners,
whereby the contractor undertook and agreed to erected and
construct a dwelling on the certain lot of ground situate in North
Middleton Township, Cumberland County, Commonwealth of
Pennsylvania, known as 70R The Village of Creek Creek, Carlisle,
Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract of land situate in North Middleton Township,
Cumberland County, Pennsylvania, designated as Lot No. 70R on the Final
Subdivision Plan for Phase A of the Village of Cross Creek dated March 15, 2002,
and recorded April 4, 2002 in the Office of the Recorder of Deeds in and for
Cumberland County in Plan Book 85, Page 20, more particularly bounded and
described, as follows:
BEGINNING at a point on the southern right-of-way of Manada Creek Circle, said
point being the northwestern corner of Lot #71R; thence, along the right-of-way by
a curve to the left having a radius of 225.00', an arc length of 60.00' and a chord
bearing of N 46°26'02'' W a distance of 69.72' to a point; thence, along Lot #69R N
42°41'14'' E a distance of 121.89' to appoint; thence, along Lot OS-4R S 44019'24" E
a distance of 90.24' to a point; thence, along Lot #71R S 52°28'44'' W a distance of
120.00' to a point the place of BEGINNING.
BEING Lot No. 70R on the Final Subdivision Plan for Phase A of the Village of
Cross Creek dated March 15, 2002, recorded April 4, 2002 in the Office of the
Recorder of Deeds in and for Cumberland County in Plan Book 85, Page 20.
