BROWN, OF THE PENNSYLVANIA COMMONWEALTH COURT NOW COMES Kristen W. Brown, Prothonotary of the Pennsylvania Commonwealth Court, by and through undersigned counsel, who moves this Honorable Court to enter a Protective Order from pre-Complaint discovery in the above-captioned case and in support thereof avers as follows: 1. Plaintiff Ricky Tejada, acting pro se, commenced this action by filing and serving upon named Defendant Kristen Brown, Pennsylvania Commonwealth Court Prothonotary, a document entitled "PRE-COMPLAINT DISCOVERY: WRITTEN INTERROGATORIES," attached hereto as Exhibit "A" and made a part hereof. 2. Plaintiff has failed to file or serve in this matter a Writ of Summons, Complaint or any document that sets forth a cause of action or any factual basis therefor. 3. The proposed Interrogatories, which are unnumbered and confusingly worded, contain questions such as "are you compelled to perform under specific terms and conditions pursuant to Pa.R.A.P. 103.31 Id, 31124, 3113d and 31144 in accordance with 42 Pa.C.S.A. 2701 et seq.. - and does non-compliance thereof render you liable express and/or implied for the office of prothonotary for the Commonwealth Court and/or said office staff." 4. The Interrogatories reference Commonwealth Court case No. 247 MD 2012, the Docket for which, attached hereto as Exhibit T," reveals that the Court dismissed that matter and marked its status "closed" on April 19, 2012; the Pennsylvania Supreme Court affirmed the dismissal on October 16, 2012 at 47 MAP 2012. 5. Under Pennsylvania law, although pre-Complaint discovery may be appropriate to obtain factual information to aid in the preparation of pleadings, such as the proper parties or the whereabouts of witnesses, it is not proper for "a fishing expedition" to determine whether a cause of action exists or whether a pleading shall be prepared in the first instance. See Luckett v. Blaine et al., 850 A.2d 811, 818 (Pa. Cmwlth. 2004) 6. In this case, Plaintiffs pre-Complaint Interrogatories do not target factual information such as names and addresses to aid in preparing pleadings,but are confusing, far- reaching, vague, irrelevant, and geared toward the proverbial "fishing expedition" which is disallowed under Pennsylvania law. 7. Pre-complaint discovery is proper if and only if a plaintiff has set forth aprima facia case, McNeil v. Jordan, 814 A.2d 234, 246 (Pa. Super. 2002), which has not been done in this case,particularly since Plaintiff has not filed either a Writ of Summons or a Complaint. 8. A Court is "authorized to enter discovery orders 'for the convenience of parties and in the interest of justice,"' neither of which would be served by requiring Prothonotary 3 Bizzoso to respond to Plaintiffs Interrogatories in this case. Pa.R.C.P. 4007.3, Explanatory Comment. 9. Moreover, the Commonwealth Court has exclusive jurisdiction over actions against the Commonwealth and its officers, including prothonotaries to whom quasi-judicial immunity has been extended, under 42 Pa.C.S.A. § 761(a)(1); See also McKnight v, Baker, 415 F.Supp.2d 559, 563 (E.D. Pa. 2006), afl7d 244 Fed. Appx. 442 (3rd Cir. 2007); Leiber v. County of AlledLeny, 654 A.2d 11 (Pa. Cmwlth. 1994). 10. In this case, because Prothonotary Brown is a state official, Plaintiffs claims against her, if any exist, are not properly raised in this Court,but rather jurisdiction lies in the Commonwealth Court. 11. Further, Courts apply the doctrine of judicial immunity to bar civil rights actions against clerks and prothonotaries, court reporters, and administrators, See Lockhart v. Hoenstine,411 F.2d 455, 460 (3d Cir. 1969), cert. denied, 396 U.S. 941 (1969); Davis v. Philadelphia County, et al., 195 F-Supp.2d 686, 689 (E.D.Pa. 2002) (holding that quasi-judicial immunity applies to court staff, such as clerks of judicial records and court reporters, who are acting in their official capacities) 12. For these reasons, a strong likelihood exists that this Honorable Court will dispose of this case based upon Preliminary Objections, thus rendering discovery unnecessary. 13. Strong policy considerations protect Court personnel from burdensome, time- consuming discovery demands in lawsuits where a meritorious defense exists, with the goal of curtailing the deflection of public resources for unfounded claims. 4 WHEREFORE,Defendant Kristen Brown, Prothonotary of the Pennsylvania Commonwealth Court, requests that this Honorable Court enter an Order of Protection from Pre- Complaint Discovery in this matter. In response to Plaintiffs Interrogatories, Defendant files this Motion for a Protective Order on the ground that the questions posed are vague, overly-broad, and fail to target basic factual information to aid in the preparation of a Complaint, but extend far afield into the impermissible territory known as a "fishing expedition" that is prohibited under Pennsylvania law. 11. ARGUMENT Although pre-Complaint discovery may be appropriate in rare cases to obtain information to aid in the preparation of pleadings, such as the proper parties or the whereabouts of witnesses, it is not proper for a "fishing expedition" to determine whether a cause of action exists or whether a pleading shall be prepared in the first instance. See Luckett v. Blaine et al., 850 A.2d 811, 818 (Pa. Cmwlth. 2004) In this case, Plaintiff does not merely seek factual information as to names and addresses, but rather has geared his discovery toward a fishing expedition, which is not perrnissible under the law in this Commonwealth. This is particularly true because Plaintiff in this case has in no way identified what rights he claims have been violated. In that regard, pre-Complaint discovery is proper if and only if a plaintiff has set forth a 7 prima facia case. McNeil v. Jordan, 814 A.2d 234, 246 (Pa. Super. 2002). Plaintiff in the instant case has failed to do so, and has not even filed or served upon Defendant a Writ of Summons, Complaint or any other document that sets forth a cause of action or any right that Defendant has allegedly violated. Further, the Commonwealth Court has exclusive jurisdiction over actions against the Commonwealth and its officers, including prothonotaries to whom quasi-judicial immunity has been extended, under 42 Pa.C.S.A. § 761(a)(1); See also McKnight v. Baker,415 F.Supp.2d 559, 563 (E.D. Pa. 2006), affd 244 Fed. Appx. 442 (3rd Cir. 2007); Leiber v. County of Allegheny, 654 A.2d 11 (Pa. Cmwlth. 1994). For this reason,in this case,because Prothonotary Bizzoso is a state official, Plaintiffs claims against her,if any exist, are not properly raised in this Court, but rather jurisdiction lies in the Commonwealth Court. Courts apply the doctrine of judicial immunity to bar civil rights actions against clerks and prothonotaries, court reporters, and administrators. See Lockhart v. Hoenstine, 411 F.2d 455, 460 (3d Cir. 1969), cert. denied, 396 U.S. 941 (1969); Ginsburg v. Stem, 125 F. Supp 596 (W.D. Pa. 1954), aff d per curiam on others,225 F.2d 245 (3d Cir. 1955). See also, Marcedes v. Barrett, 453 F.2d 391, (3d Cir. 197 1) (holding that judicial or quasi-judicial immunity applied to clerk of courts, a supervisor on the staff of the clerk of courts, an administrative assistant to the president judge and a court reporter); Davis v. Philadelphia County, et al., 195 F.Supp.2d 686, 689 (E.D.Pa. 2002) (holding that quasi-judicial immunity applies to court staff, such as clerks of judicial records and court reporters, who are acting in their official capacities) (citation omitted); DeFerro v. Coco, 719 F.Supp. 379, 381 (E.D.Pa. 1989) (court held that defendant Coco, a court clerk who was carrying out his normal duties, was entitled to absolute immunity against civil rights action filed by plaintiff). In Guarrasi v. Scott, 25 A.3d 394, 405 n.11 (Pa. Cmwlth. Ct. 8 2011), the Commonwealth Court found that"a court administrator acting under direction of a common pleas judge in a Bucks Common Pleas proceeding has quasi-judicial immunity from Plaintiffs constitutional and civil rights claims." One reason for extending the judicial immunity doctrine to those who perform a quasi-judicial function is to prevent litigants who cannot sue a judge directly from "vent[ing] their wrath on clerks, court reporters, and other judicial adjuncts." Gallas v. The Supreme Court of PA, 211 F.3d 760, 763 (3d Cir. 2000). A Court is "authorized to enter discovery orders 'for the convenience of parties ... and in the interest of justice." PaR.C.P. 4007.3, Explanatory Comment. The grant of protective order is fully within the discretion of this Court and is especially advised where, as here, time- consuming Court resources are involved. Strong policy considerations protect Court personnel from burdensome discovery demands in lawsuits where a meritorious defense exists in order to curtail the deflection of public resources from unfounded claims. "Pretrial matters [such] as discovery are to be avoided if possible, because '[i]nquiries of this kind can be peculiarly disruptive of effective government."' Mitchell v. Forsyth, 472 U.S. 511 (1985), quoting Harlow v. Fitzgerald, 457 U.S. 800, 817, (1982). Courts have repeatedly recognized the propriety of staying discovery. Compelling Prothonotary Brown to participate in discovery at this stage of the proceeding would undoubtedly amount to no more than a meaningless exercise, particularly in light of the immunity defense to which she is entitled. Thus,public policy is served by preventing burdensome and time-consuming discovery in this instance. In fact, even if Prothonotary Brown were not afforded judicial immunity, it is clear that Plaintiffs proposed Interrogatories do not target basic factual information to aid in the preparation of his Complaint, but extend into far- reaching, prohibited territory under the law in this Commonwealth. 9 III. CONCLUSION Because Plaintiffs proposed Interrogatories are improper under the law in this Commonwealth, Pennsylvania Commonwealth Court Prothonotary Kristen W. The Interrogatories reference Commonwealth Court case No. 247 MD 2012, which was closed on April 19, 2012, aff d by the Pennsylvania Supreme Court on October 16, 2012 at 47 MAP 2012. In response to Plaintiffs Interrogatories, Defendant filed a Motion for a Protective Order on the grounds set forth below. H. ARGUMENT Defendant's Motion for a Protective Order was based upon the following grounds: a) Plaintiffs pre-Complaint Interrogatories do not target factual information such as names and addresses to aid in preparing pleadings,but are confusing, far-reaching, vague, irrelevant, and geared toward the proverbial "fishing expedition" which is disallowed under Pennsylvania law. See Luckett v. Blaine et al., 850 A.2d 811, 818 (Pa. Cmwlth. 2004). b) Pre-complaint discovery is proper if and only if a plaintiff has set forth a prima facia case, McNeil v. Jordan, 814 A.2d 234, 246 (Pa. Super. 2002), which has not been done in this case, particularly since Plaintiff has not filed either a Writ of Summons or a Complaint. A Court is "authorized to enter discovery orders 'for the convenience of parties ... and in the interest of justice." Pa.R.C.P. 4007.3, Explanatory Comment. The grant of protective order is fully within the discretion of this Court and is especially advised where, as here, time- consuming Court resources are involved. Strong policy considerations protect Court personnel from burdensome discovery demands in lawsuits where a meritorious defense exists in order to curtail the deflection of public resources from unfounded claims. "Pretrial matters [such] as discovery are to be avoided if possible,because '[i]nquiries of this kind can be peculiarly disruptive of effective government."' Mitchell v. Fors t�h, 472 U.S. 511 (1985), quoting Harlow v. Fitzgerald, 457 U.S. 800, 817, (1982). Despite this Court's May 31, 2013 Rule upon Plaintiff to show cause as to why the Defendant's Motion for Protective Order should not be granted, Plaintiff has failed to take any action whatsoever. III.
