THIS AGREEMENT made this ~, day of

HOME DESIGNS UNLIMITED, hereinafter called the ~Contractor",
AND
JEFFREY A. MILLAR and BETH A. HEINTZELMAN, adult individuals, hereinafter called the
~Owners"
WITNESSETH THAT, The Contractor, by instrument dated August 3, 2004, entered into an
Agreement with the Owner for the erection and construction of a single family dwelling, situated at
Lot #255, Kuhn Road, Boiling Springs, PA 17007, more specifically described as follows:
ALL that certain tract of land situate in Monroe Township, Cumberland County,
Pennsylvania, bounded and described in accordance with a plan prepared by Robert E.
Stifler, R. $., and recorded in the Office of the Recorder of Deeds for Cumberland County in
Plan Book 34, Page 113. BEGINNING at a point in the southern right-of-way line of Kuhn
Road at Lot No. 256; thence along Lot No. 256, South 14° 35' 06" East, 397.79 feet to a
point; thence South 49° 22' 12" West, 414.00 feet to a point; thence along Lot No. 254, North
06° 59' 37" East, 608.24 feet to a point in southern right-of-way line of Kuhn Road; thence
along southern right-of-way line of Kuhn Road by a curve to the left having a radius of 359.67
feet, an arc distance of 150.00 feet on a chord beadng of North 70° 02' 09" East to a point,
the place of beginning.
AND WHEREAS, the Contractor has covenanted and agreed therein to enter into additional
agreements with the Owner stipulating that no lien or liens of any kind shall be filed against the
above premises, lot or dwelling or the appurtenances thereto.
NOW, THIS AGREEMENT WlTNESSETH, that the Contractor, for and in consideration of
the awarding to him of the said contract as for the sum of ONE DOLLAR ($1.00) to him in hand paid
by the Owner, the receipt of which is hereby acknowledged, promises and agrees that no
Mechanics' Lien or Liens shall be filed against the aforesaid premises, lot or dwelling, or the
appurtenances thereto by any subcontractor, subcontractors, material-men, mechanics, laborers or
anyone for materials furnished, work done or services rendered of any kind whatsoever, for or
about, or on account of the aforesaid building or on the credit thereof.
IN WITNESS WHEREOF, the said parties hereunto set their hands and seals the day and
year aforesaid.
