He received minimal care and was financially exploited. He had previously attempted suicide on November 20, 2010 by drinking antifreeze. On November, 1, 2011 a temporary Guardianship hearing was held before Judge Edward Guido. He appointed the Cumberland County Aging and Community Services as Mr. Harvey's Temporary Guardian of Person and Estate. The Permanent guardianship hearing was held on December 2, 2011 and the Agency was appointed. PERSON On November 11, 2011 Mr. Harvey was taken to the Keller Senior Apartments by his son. These arrangements were made by Holy Spirit Hospital. The Agency had contacted numerous personal care homes but were unsuccessful in finding placement. We continued to pursue personal care placement because we felt Donald was not receiving sufficient care. He had to pay extra to get assistance with bathing and medication administration. On May 29, 2012 we transported Donald to fhe Stonehedge Retirement Home in East Waterford, Perry County. Donald did well at the Home. He enjoyed watching the big screen TV. He refused to go to the Sr. Center. At the time of his admission, he was diagnosed with hypertension, coronary artery disease, s/p coronary artery bypass, edema, hx stomach ulcers, ambulatory dysfunction, arthritis, s/p spinal fusion, hx prostate cancer, high cholesterol, major recurrent major depression, suicide ideation. Donald's personal care physician also wanted him to follow up with a specialist because on his record. it stated that he had an aortic aneurysm and there didn't seem to be any follow-up. On July 27, 2012 Donald was seen by Dr. Guthrie of Summit Health in Chambersburg who felt surgery was necessary. Dr. Guthrie ordered him to be seen by a cardiologist prior to the surgery which was scheduled for October 4, 2012. After consulting with Dr. Guthrie Donald was going to be admitted to the hospital a few days early in order to give him Lasix IV to reduce the fluid that Donald was retaining. Donald came through the surgery fine and after his hospitalization he was transferred to Claremont Nursing and Rehab center for his rehab. Upon arrival Donald was exhibiting behaviors he had not had in the past. He was kicking and biting. It was hoped that these behaviors may be from the anesthesia. It was also found he had some teeth that had become abscessed and were becoming painful. Because Donald was not independent after his rehab stay he was admitted to the nursing home as a long term resident. After the teeth were pulled in October 22, 2012 his behavior slowly started to improve. Staff visits with Donald every 30-60 days. Staff also attends the quarterly care plan meetings with nursing home staff from nursing, activities, social services, and the dietician. It is the request of the Cumberland County Office of Aging that the agency retain Guardianship of Person for Donald Harvey. The Claremont Nursing and Rehabilitation Center has demonstrated an adequate quality of .care for his medical problems. We believe, therefore, that Donald Harvey should continue to reside in that nursing facility. ESTATE Upon becoming Guardian, we went to Metro Bank to have the ATM card canceled as this would be the only access the alleged perpetrator would have to his account since her. name was not on the account. After the final hearing we opened a guardianship account at Metro. We filed a change of address with the Post Office. His income from three pension checks, CUNA Mutual, PA State and Teamsters come to $839.50. His Social Security is currently $1367. We were unable to prepare a case for criminal charges against the, alleged perpetrator as her whereabouts were unknown. Fortunately, when Don was in the nursing home under Medicare, we were able to collect his income checks. It was from these. funds we were able to pay most of the bills for the house, except for the reverse mortgage. A reverse mortgage for $245,000 was taken out in June of 2009 with no monies being paid back to date. Due to his financial situation, it was necessary for us to begin the foreclosure process on the mortgage. When Donald was in the Keller Senior Apartments, he was charged $1600 a month. (for a room approximately 8' x 12'). We fell behind because there just was not enough money to pay. We are slowly paying off the monies due which are down to approximately $1500.00. When Donald was at Stonebridge Personal Care Home he was paying $1400.00. a month. The owners graciously did not make us give 30 day notice. Now that he is in Claremont Nursing home and on Medical Assistance, he is required to pay his income less $100 dollars for guardianship fee to Cumberland County Aging and y Community Services as directed in the court order, $45 for personal expenses and an insurance premium so monthly payments to Claremont Nursing should be $1871.00. In addition to his rent and room and board, two other larger expenses included a purchase of a recliner/lift chair for $741.99. Donald could sleep better on a recliner than in a bed and payments made toward the $640 charged by Barric and Scherer who represented him at the hearing. We were ordered by the court to pay this legal bill and it has been totally paid. There were also numerous medical bills. Attached is a financial summary of .Donald Harvey income and expenses.
