COMPLAINT
1. Plaintiffs, Richard Fleck and Pamela Fleck, are adult individuals who reside
together as husband and wife at 77 Clouser Road, Mechanisburg, Cumberland County,
Pennsylvania.
2. Plaintiffs, Richard Fleck and Pamela Fleck, are the parents and natural guardians
of Tyler Fleck, a minor.
3. The Minor Plaintiff, Tyler Fleck, who was born on June 14, 1992, is currently 12
years old.
4. At all times relevant to this Complaint, the Minor Plaintiff, Tyler Fleck, resided
with his parents at 77 Clouser Road, Mechancisburg, Cumberland County, Pennsylvania.
5. At all times relevant to this Complaint, Plaintiffs were insured by an Erie Auto
Insurance policy that provided for the Full-Tort Option.
6. Defendant Mertie Dieterick is an adult individual who resides at 13 South Road,
Mechanicsburg, Cumberland County, Pennsylvania.
7. The facts and occurrences hereinafter related took place on or about July 1,2004,
at approximately 12:45 p.m., on Clouser and Brindle Roads in Mechanicsburg, Cumberland
County, Pennsylvania.
8. At said time and place, Minor Plaintiff Tyler Fleck was the operator of a bicycle
that was traveling West on Clouser Road.
9. At said time and place, Defendant Mertie Dieterick was the operator of a 2000
Buick Park Avenue that was traveling West on Clouser Road directly behind the Minor
Plaintiff s bicycle.
10. At said time and place, as the Minor Plaintiff approached the intersection of
Clouser and Brindle Roads, he signaled his intention to make a left hand turn onto Brindle Road.
11. At said time and place, the Minor Plaintiff turned left onto Brindle Road.
12. At said time and place, Defendant Mertie Dieterick, while still traveling directly
behind the Minor Plaintiff s bicycle, also turned left onto Brindle Road.
13. Shortly after the Minor Plaintiff and the Defendant turned onto Brindle Road, the
Defendant's vehicle struck the Minor Plaintiffs bicycle from behind.
14. The force of the collision knocked the Minor Plaintiff to the ground.
15. The Defendant then proceeded to run over the Minor Plaintiff with her 2000
Buick Park Avenue.
16. The Minor Plaintiff suffered serious injuries, including, but not limited to, pelvic
fractures that required operative treatment, a sacral fracture, a pulmonary contusion and a rib
fracture as a direct result of the aforesaid accident.

17. At all times relevant to this Complaint, the Minor Plaintiff was exercising due
care and was operating his bicycle in accordance with the laws of the Commonwealth of
Pennsylvania.
COUNT I
TYLER FLECK, A MINOR, BY RICHARD FLECK AND PAMELA FLECK,
HIS PARENTS AND NATURAL GUARDIANS V. MERTlE DIETERlCK
18. Paragraphs 1 through 17 of this Complaint are incorporated herein by reference as
if set forth at length.
19. The aforementioned accident, and all of the injuries and damages sustained by
Minor Plaintiff Tyler Fleck as set forth herein, were a direct and proximate result of the negligent
conduct of Defendant Mertie Dieterick as set forth in paragraphs 21 through 30 below.
20. As a direct and proximate result of her negligence as set forth in paragraphs 21
through 30 below, Defendant Mertie Dieterick is liable to Minor Plaintiff Tyler Fleck for the
injuries alleged herein.
21. Defendant Mertie Dieterick pennitted the vehicle that she was operating to strike
the Minor Plaintiffs bicycle.
22. Defendant Mertie Dieterick failed to have her vehicle under such control so as to
have been able to stop within the assured clear distance ahead.
23. Defendant Mertie Dieterick failed to keep alert and failed to maintain a proper
watch for the presence of other vehicles on the roadway.
24. Defendant Mertie Dieterick failed to apply her brakes in sufficient time to avoid
striking the Minor Plaintiff s bicycle.
25. Defendant Mertie Dieterick pennitted the vehicle that she was operating to strike
the rear of Minor Plaintiffs bicycle.

26. Defendant Mertie Dieterick failed to keep proper and adequate control over the
vehicle that she was operating at the time of the aforesaid incident.
27. Defendant Mertie Dieterick attempted to pass the Minor Plaintiffs bicycle despite
the fact that conditions were such that it was not safe for her to do so.
28. Defendant Mertie Dieterick failed to yield the right of way to the Minor Plaintiff.
29. Defendant Mertie Dieterick followed the Minor Plaintiffs bicycle too closely and
in such a fashion so as to have prevented her from being able to stop within the assured clear
distance ahead.
30. Defendant Mertie Dieterick drove the vehicle that she was operating upon the
roadway in a reckless manner with careless disregard for the rights and safety of others in
violation of the motor vehicle code of the Commonwealth of Pennsylvania.
31. As a direct and proximate result of Defendant Mertie Dieterick's negligence as set
forth above, Minor Plaintiff Tyler Fleck has suffered serious injuries, including, but not limited
to, pelvic fractures that required operative treatment, a sacral fracture, a pulmonary contusion
and a rib fracture.
32. As a direct and proximate result of the aforesaid injuries, Minor Plaintiff Tyler
Fleck has incurred, and will in the future incur, medical and rehabilitative expenses, and claim is
made therefor.
33. As a direct and proximate result of the aforesaid injuries, Minor Plaintiff Tyler
Fleck has undergone, and in the future will undergo, great physical and mental pain and
suffering, great inconvenience in carrying out his daily activities, and a loss of life's pleasures
and enjoyment, and claim is made therefor.

34. As a direct and proximate result of the aforesaid injuries, Minor Plaintiff Tyler
Fleck has been, and in the future will be, subject to great humiliation and embarrassment, and
claim is made therefor.
35. Minor Plaintiff Tyler Fleck continues to be plagued by nerve pain and therefore
avers that his injuries may be of a permanent nature, causing residual problems for the remainder
of his life, and claim is made therefor.
36. Minor Plaintiff Tyler Fleck has undergone surgery for the treatment of his
accident-related injuries, which has resulted in scarring and disfigurement, and claim is made
therefor.
37. As a direct and proximate result of the aforesaid injuries, Minor Plaintiff Tyler
Fleck may sustain a loss of earning power and earning capacity, and claim is made therefor.
WHEREFORE, Plaintiff, Tyler Fleck, a Minor, by Richard Fleck and Pamela Fleck, his
Parents and Natural Guardians demand judgment against Defendant Mertie Dieterick for damages
in an amount of Twenty-Five Thousand ($25,000.00) Dollars, exclusive of interest and costs, and in
excess of any jurisdictional amount requiring compulsory arbitration.
COUNT II
RICHARD FLECK AND PAMELA FLECK, INDIVIDUALLY AND IN
THEIR OWN RIGHT V. MERTlE DIETERICK
38. Paragraphs 1 through 17 and Count I of this Complaint are incorporated herein by
reference.
39. As a direct and proximate result of the Defendant's negligence and the aforesaid
injuries of the Minor Plaintiff, Plaintiffs have incurred, and will in the future incur, medical and
rehabilitative expenses for the treatment of the Minor Plaintiffs accident-related injuries, and
claim is made therefor.

40. Plaintiffs also claim all other damages to which they are entitled pursuant to
Pennsylvania law.
WHEREFORE, Plaintiffs, Richard Fleck and Pamela Fleck, Individually and in their
Own Right demand judgment against Defendant Mertie Dieterick for damages in an amount of
Twenty-Five Thousand ($25,000.00) Dollars, exclusive of interest and costs, and in excess of any
jurisdictional amount requiring compulsory arbitration.

42. That the Plaintiffs' alleged injuries and damages were not caused by any acts,
omissions, or breaches of duty by Defendant.
43. That Plaintiffs' claims and/or alleged losses may be limited and/or barred by the
doctrine of comparative and/or contributory negligence.
44. That if it should be found that there is any negligence on the part of the
Defendant, which negligence is expressly denied, any such nE~gligence was not a proximate
cause of any damages by the Plaintiffs.
45. That this accident may have been unavoidable.
46. That Plaintiffs may have assumed the risk of their injuries allegedly sustained.

47. Plaintiff, Tyler Fleck, failed to operate his bicycle in a reasonable and prudent
manner and any alleged injuries are directly and proximately caused by Defendant, Tyler
Fleck's negligence in the operation of his bicycle.
WHEREFORE, the Defendant respectfully requests that Plaintiffs' Complaint be
dismissed and that judgment be entered in her favor.

AND NOW, come the Petitioners, Richard Fleck and Pamela Fleck, as parents and
natural guardians of Tyler Fleck, a minor, and individually and in their own right, by and through
their attorneys, Navitsky, Olson & Wisneski, LLP and hereby aver as follows:
I. Petitioners Richard Fleck and Pamela Fleck are the parents and natural guardians
of Tyler Fleck, a minor. They reside with Tyler Fleck at 77 Clouser Road, Mechanicsburg, P A
17055.
2. The Minor Plaintiff, Tyler Fleck is currently 13 years old. He was born on June
14,1992.
3. On or about July I, 2004, Tyler Fleck was riding his bicycle on Clouser and
Brindle Roads in Mechanicsburg, Cumberland County, Pennsylvania, when he was struck by a
2000 Buick Park Avenue Buick that was owned and being operated by Defendant Mertie
Dieterick. A copy ofthe police accident report is attached hereto as Exhibit "A".
4. The Minor Plaintiff suffered multiple injuries, including a pelvic fracture, a sacral
fracture, a front parietal contusion and a rib fracture as a result of the accident A copy of the
"
minor's discharge summary from The Milton S. Hershey Medical Center is attached hereto as
Exhibit "B".
5. Tyler Fleck has made a good recovery from his accident-related injuries, but
continues to have weakness of his left lower extremity (left foot and ankle), for which he
continues to receive physical therapy. See, Milton S. Hershey Medical Center Outpatient Note
dated August 3, 2004 and report of Helen Gold, D.P.M. dated September 29, 2005, attached
hereto as Exhibit "C".
6. Richard Fleck and Pamela Fleck, as the parents and natural guardians of Tyler
Fleck, and individually and in their own right, asserted a personal injury claim against Mertie
Dieterick for the injuries that Tyler sustained in the aforesaid accident.
7. Defendant's insurance carrier initially denied all liability for this claim. See,
October 8, 2004 letter from Erie Insurance Group, attached hereto as Exhibit "D".
8. Following discovery and the taking of numerous depositions, the Defendant,
through her attorney, John Ninonsky, Esquire, has agreed to compromise the disputed claims
arising from the incident for the total sum of$IOO,OOO.OO, subject to Court Approval.
9. The $100,000.00 offered by Defendant Dieterick represents the per person
liability limits of her Erie Insurance auto policy. It is also the total of all insurance coverage
available to her with respect to this claim. See, Defendant's Answer to Plaintiffs' Interrogatory
number 6 and the attached auto policy declarations page, all of which is attached hereto as
Exhibit "E".
I O. At the time of the accident, the Minor Plaintiff was entitled to underinsured
motorist's coverage under his parents' Erie Insurance auto policy. That policy provided for a

maximum of $100,000.00 in underinsured motorist's benefits. See, Declarations Page of
Richard and Pamela Fleck's Erie Insurance auto policy attached hereto as Exhibit "F".
11. Erie Insurance Group agreed to tender its $100,000.00 underinsured motorist's
limits in settlement of the Plaintiffs' underinsurance claim.
12. In view of the disputed nature of the liability aspect of this case, the nature ofthe
Minor Plaintiffs injuries, and the fact that all available third-party and underinsurance coverage
has been tendered, Your Petitioners consider the offer to be a fair, just and equitable settlement
and to be in the best interest of the minor Plaintiff.
13. Your Petitioners retained the law firm of Navitsky, Olson & Wisneski LLP to
prosecute this action, and entered into a Contingent Fee Agreement with said attorneys for their
professional services, plus expenses. A copy of the Power of Attorney and Fee Agreement is
attached hereto as Exhibit "G".
14. Although said attorneys would normally be entitled to a fee of thirty-five (35%)
percent of the amount recovered, they have agreed to reduce their contingency fee to twenty-five
(25%) percent of the amount recovered because the Plaintiff is a minor.
15. Navitsky Olson & Wisneski LLP on behalf of Petitioners have incurred expenses
for investigation, medical records and miscellaneous items totaling $2,812.13. An itemization of
the incurred expenses is attached hereto as Exhibit "H".
16. No liens have been asserted in this matter.
17. There are no outstanding medical expenses that must be paid out of the minor
Plaintiff s proposed settlement

18. Plaintiffs Richard Fleck and Pamela Fleck have agreed to waive any claim that
they might have for reimbursement of out-of-pocket medical or other expenses that they incurred
as a result of the minor Plaintiff's injuries.
19. However, as the minor Plaintiff continues to receive physical therapy services
which Richard Fleck and Pamela Fleck are currently paying out-of-pocket (approximately
$400/month - see, recent invoices/receipts for Tyler's medical expenses, attached hereto as
Exhibit "I") and as the minor Plaintiff will continue to need follow-up medical visits to his
physicians and various medical services or devices (such as orthotics for his shoes), Richard and
Pamela Fleck respectfully request that the court direct that $25,000 of the settlement proceeds be
paid to them pursuant to Pa. R.C.P. 2039(b)(I) to be used solely for the benefit of the minor
Plaintiff, particularly the payment of his ongoing medical expenses. Please note that, pursuant
to Dr. Gold's report of September 29, 2005 (Exhibit "C"), it is anticipated that Tyler will
continue to require therapy for the foreseeable future.
20. Since the Minor Plaintiff, Tyler Fleck, will not reach the age of majority until
June 14,2010, the settlement proceeds due to Tyler Fleck in the amount of$122,177.87 will be
deposited in a federally insured savings accounts and/or one or more accounts investing only in
securities guaranteed by the United States Government or a Federal Government Agency
managed by responsible financial institutions pursuant to Pa.R.C.P. 2039(b)(2). No withdrawal
shall be made from the accounts until Minor Plaintiff, Tyler Fleck, attains the age of majority (18
years of age), except as authorized by Court Order.
21. Accordingly, Petitioners respectfully request that This Honorable Court approve a
distribution ofthe settlement proceeds as follows:

Open reduction internal fixation of pelvic fracture with external fixation stabilization.
ADMISSION DIAGNOSIS: Multiple injuries secondary to trauma.
PRINCIPAL DIAGNOSES: Pelvic fracture, sacral fracture, frontal parietal contusion, first
rib fracture.
BRIEF COURSE: This l2-year-old male presented to the Penn State Children's Hospital
after being struck by a vehicle on his bicycle. X-rays of the cervical spine, chest, and
pelvis revealed right first rib fracture, right pulmonary contusion, pubic rami fracture,
and sacral fracture. Due to the inadequacy of cervical spine film, a CAT scan was
performed and revealed no bony abnormalities. The CAT scan of the head suggested diffuse
axonal injury. Thoracic and lumbar spine reconstruction did not reveal any abnormalities
on CAT scan. CAT scans of the chest, abdomen, and pelvis were also performed and
confirmed the injures stated above, as well as a left iliacus and parailiac hematoma. X-
rays of the bilateral femurs, right knee, bilateral tibia and fibula, and right scapula
were performed due to visible overlying abrasions, injury, and/or deformity, tenderness,
and revealed no additional abnormalities. The patient did sustain a small perianal
laceration at the time of trauma. A Foley catheter was placed during resuscitation. The
patient was stabilized and admitted. The patient underwent irrigation and debridement of
the perianal laceration and initial external fixation of his open pelvic fracture on July
1, 2004. He subsequently underwent an open reduction internal fixation of the pelvic
fracture with external fixation stabilization on July 6, 2004. The patient progressively
improved during his stay; pain was well controlled. The Foley was removed after a
cystogram revealed no injury. He was tolerating oral intake, in no respiratory distress,
a-febrile, vital signs stable, and able to slide transfer from bed to chair with
assistance. His weight on discharge was 55 kg.
DISCHARGE MEDICATIONS: Tylenol with Codeine 1-2 tablets by mouth every 4-6 hours for
pain, Co lace as needed for constipation, and 1 baby aspirin every day until follow-up at
clinic. The patient will require multiple services, including physical therapy,
occupational therapy, social services, and visiting nurse assistance for pin care. He
will also require a wheelchair and a hospital bed at home.
ORDERS AND INSTRUCTIONS ARE AS FOLLOWS:
1. Diet as tolerated.
2. Activity. No weight-bearing to bilateral lower extremities. Slide transfer from bed
to chair.

DATE OF SERVICE: August 3, 2004
This is the second postop followup for Tyler Fleck. Tyler returns for followup evaluation
after removal of an external fixator. Tyler sustained an open pelvis fracture on the 1st
of July in a pedestrian versus motor vehicle accident. He underwent irrigation and
debridement and placement of 2 iliac crest pins anteriorly on the 1st of July. On the 6th
of July, he underwent an open reduction through anterolateral approach. The fixation of
the pelvis required a symphysis plating through a Pfannenstiel approach. An iliosacral
screw was placed as well as a pelvic recon plate anteriorly.
A 1 pin 1 pin fixator was then retained using AIlS screws. The patient returned following
discharge with evidence of a pin tract osteomyelitis and an acute cellulitis over the
anterolateral side on the left hemipelvis. This was treated with removal of the external
fixator, pin debridement, and he was placed on rifampin and dicloxacillin as p.o.
antibiotics in consultation with Pediatric Infectious Disease Specialist. Tyler also had
a lumbosacral plexus, neuropraxia evident following his extended open reduction internal
fixation attempt. Since then, he has demonstrated a slow but progressive neurotization
with increasing toe extensors and ankle dorsiflexion strength. He is taking Neurontin for
occasional intermittent but quite severe neurogenic pain. He describes his pain now as 2-
3/10. He has been in a wheelchair and nonweightbearing.
Tyler relates that his symptoms are steadily improving.

PLAN: I reassured the parents that Tylerls clinical case is proceeding nicely. I expect
a protracted course of recovery of the lumbosacral plexus, but it is likely he will
recover full motor strength. He should continue with the Neurontin. He also should
continue to follow the advice of the Pediatric Infectious Disease Specialist with regard
to the duration and type of antibiotic coverage. I would like to keep him
nonweightbearing for an additional 4 weeks. At that time, we will advance his
weightbearing. I will see him back around the 1st week of September with repeat
radiographs at which time I anticipate that he may be able to begin an advance to regular
unrestricted activity.

Dear Mr. Wisneski,
This correspondence is in reference to Tyler Fleck, who presented to the office on March
10f 2005, wIth his mother and his father. They presented with a history of pelvic surgery in
Ju y 2004, which resulted in partial paralysis of the L4 nerve. He had been experiencing
weakness along the medial aspect of the foot and ankle on the left side since July 2004. He
had some increased strength trom initial physical therapy, but he was significantly unstable
with ambulation and his gait pattern was noticeably abnormal. There was no other report
of significant past medical history, medication usage or allergies to medications at that tIme.
On March 10,2005, Tyler Fleck was evaluated and there was noted to be muscle weakness
along the medial aspect of the leg and foot associated with L4 neuropathy. He had
significant weakness at the posterior tibial tendon and no ability to resist muscle testing on
examination and no ability to move the foot in the direction of inversion or dorsiflexion. ~His
gait pattern was noted to be significantly abducted with the forefoot turned out and the
reartoot in an everted or collapsed position. He wa~ walking in a very unstable fashion with
a steppage or staggering gait. He was treated initially with custom-molded orthoses, which
were tabricated to mamtain a more perpendicular position of the rearfoot and offer him
greater stability and strength in the rearroot structures. He was seen for continuing follow
up on April 21, 2005, at which time he was noted to be tolerating the orthoses well with
improvea function of his lower extremities. He was walking sliglitly better and there was
less instability noted on examination. He was seen again then on June 21, 2005, at which
point he had liad an EMG performed and there was shown to be improved nerve conduction
associated with the weak muscle groups. At that pointf I recommended physical therapy to
increase the strength and range of motion of the musc es on the medial ana anterior aspect
of the left ankle and he was sent to Joyner Physical Therapy.

Periodic correspondence from Joyner Physical Therapy indicates that he is improving
significantly and he is showing increased strength of the medial muscles as wen as the
intrinsic muscles of the left side. He was seen for last evaluation on September 13, 2005.
Examination on September 13,2005 still revealed a steppage or abnonnal gait pattern during
evaluation and weakness of the medial and anterior musc1es. His improvement, however,
has been significant and he walks much more normally and has no evidence of instability
during standing or slow walking.
Tyler has improved dramatically over the last few months and I am hopeful that he will
continue to improve over the upcoming months. He will most likely retain some residual
weakness and loss of mobility on the left side due to the nerve injury. I would expect him
to need ongoing strengthening and physical therapy activities as well as continuing use of
bracing and support devices in his sIioes for the foreseeable future. It is very likely that he
will require continuing care for the remainder of his life to maintain the strength and
mobility on the left side and avoid recurrence of the weakness due to the severity of the
trauma.

4. Iffor any reason I (we) take my (our) case to another attorney or law firm or handle it myself (ourselves), I (we) recognize
that NOW has, in good faith, expended money and time for my (our) benefit and I (we) therefore agree to pay, or have my
(our) new attorney pay, immediately, upon severing the NOW attorney/client relationship, all the out-of-pocket expenses
incurred on my (our) case plus interest at the rate of 6% per annum from the date of each expenditure. In addition, when
the case is successfully concluded, I (we) agree to pay or to direct my (our) new attorney to pay as a fee 20% of the gross
recovery to NOW.
5. In the event that any settlement is made on a structured or deferred payment basis, NOW shall be entitled to receive their

RELEASE OF ALL CLAIMS
KNOW ALL PERSONS BY THESE PRESENTS, that we, Richard Fleck and Pamela
Fleck, individually and as parent and natural guardian of Tyler Fleck, a minor, intending to be
legally bound hereby, and in consideration of the payment of One Hundred Thousand
($100,000.00) Dollars and other good and valuable consideration, receipt whereof is hereby
acknowledged, have remised, released and forever discharged, and by these presents do for
ourselves, our agents, assigns, and heirs hereby remise, release and forever discharge, Mertie
Dieterick, her executors, administrators, personal representatives, successors, attorneys, agents,
or their assigns and Erie Insurance Company, its officers, directors, workmen, employees, and
insurers, of and from all actions, causes of action, claims, suits, controversies, trespasses,
damages, judgments, and demands in any form whatsoever, including attorneys fees, at law or in
equity, arising from or by reason of any and all known or unknown, foreseen or unforeseen
injuries or damages relating to an automobile accident which occurred on July 1, 2004, on
Brindle Road, Mechanicsburg, Cumberland County, Pennsylvania which resulted in the certain
civil action filed in the Court of Common Pleas of Cumberland County to Number 04-5579
which is hereby discontinued with prejudice. We also hereby waive the provisions ofPa.R.C.P.
229.1.
This Release does not release Highmark Blue Shield, Direct Blue, Blue Cross, or any
private or public health insurance provider, from any obligation to provide medical coverage
benefits to Tyler Fleck for treatment of the injuries sustained in, or arising out of, the above-
mentioned incident.
This Release does not release any medical care provider from any medical negligence
claim that Richard Fleck, Pamela Fleck and/or Tyler Fleck have, or may have, arising out of the
medical care that has been provided, or that may in the future be provided, to Tyler Fleck for the
treatment of his injuries sustained in, or arising out of, the aforesaid accident.
This Release does not release Erie Insurance Group or any insurance company from any
claim that has been, or may be, asserted for underinsured motorist's benefits in connection with
the aforesaid accident.
It is understood and agreed that this is the compromise of a disputed claim, and that this
Release and payment is not to be construed as an admission of liability on the part of the party
released, and that the Releasee denies liability therefore and intends merely to avoid further
litigation and buy her peace.
The undersigned declare and represent that no promise, inducement or agreement not
stated herein has been made to the undersigned and that this Release contains the entire
agreement between the parties hereto, and that the terms of this Release are contractual and
not a mere recital.
In further consideration of the above payment we do for ourselves, our son Tyler Fleck,
our heirs, next of kin, executors, administrators, successors or assigns, covenant and agree to
indemnify and hold harmless Mertie Dieterick, her agents, employees, insurance carriers and
attorneys from all claims, demands and suits for damages, costs, loss of services, expenses or
compensation which we, son Tyler Fleck, or our heirs, insurers, next of kin, executors,
administrators, successors or assigns have or may have in the future on account of or in any way
growing out of the injuries or damages sustained in this incident.
It is further understood and agreed that each and every person, attorney, carrier, entity or
association which claims to have a lien on the proceeds of this settlement arising our of this

incident, lawsuit, or litigation, is aware of this Release and its terms and we understand that said
released parties hereunder are relying expressly upon this unconditional express warranty in
making payment hereunder.
It is further understood, agreed and made a part hereof that no party, nor their attorney or
other representatives will in any way publicize or cause to be publicized to any person, or in any
news communication media, including but not limited to newspapers, magazines, journals, radios
or television the fact of or the terms and conditions of this settlement. All parties to this
agreement expressly agree to decline comment on any aspect of this settlement to any person or
member of the news media. This paragraph is intended to become part of the consideration of the
settlement of this action.

(1) Approval of the settlement of this minor's claim for $200,000 for Tyler
Fleck, a minor, born June 14, 1992, IS GRANTED.
(2) From the settlement, a counsel fee of $50,000, IS APPROVED.
(3) Costs of $2,822.13 are approved to be paid to plaintiff's counsel,
Navitsky, Olson & Wisneski, LLP.
(4) The sum of $25,000 shall be placed in a federally insured interest
bearing account in the name of the Tyler Fleck's guardians, Richard Fleck and
Pamela Fleck, to be used by them solely for the payment of medical expenses
incurred and continuing treatment and care of Tyler as a result of injuries he
received on the July 1, 2004. If any funds remain in this account upon Tyler
reaching the age of majority, those funds shall be turned over to him.
(5) The amount of $122,177.87 shall be placed in federally insured
interest bearing investments in Integrity Bank, in the nam,!! of Tyler Fleck, born
June 14, 1992.

(6) The account shall contain the following notation: "NO WITHDRAWAL
CAN BE MADE PRIOR TO TYLER FLECK, BORN JUNE 14, 1992,
OBTAINING HIS MAJORITY EXCEPT BY AN ORDER OF A COURT OF
COMPETENT JURISDICTION."
(7) Richard Fleck and Pamela Fleck are authorized to sign any release
necessary to effectuate this settlement, and to then settle and satisfy the docket.
(8) Counsel for plaintiff, David Wisneski, Esquire, shall file with the
Prothonotary, and forward a copy to this chambers, proof of compliance with this
order.
