It is my opinion that Mildred Lawler has a severe impairment due to psychiatric disorder/dementia This impairment prevents her frorn receiving and evaluating information and formulating decisions to the point that she is unable to manage her financial affairs or meet essential requirements for her physical health and safety on a daily basis, It is my opinion that Mildred Lawler needs a higher level of personal and custodial care in order to safely meet her psychiatric, neurological and general medical care needs. It is suggested that placement in a long-term care facility be undertaken, which meets 24 hour supervision requirement. In view of her lacking a current residence and having no family members in this immediate area this placemellt should be considered of an emergency nature. It does not appear that MS. Lawler due to her lack of capacity, will cooperate with this process, therefore, it is suggested that the Cumberland County Office of Aging pursue emergency guardianship. DeLuca, Esquire, who represents and avers as follows: 1. The Petitioner is the Area Agency on Aging, in and for Cumberland County, with its office located at 16 West High Street, Carlisle, Cumberland County, Pennsylvania. 2. The alleged incapacitated person is Mildred Lawler, age 80, who up until recently, resided at Outlook Pointe Assisted Living, 129 Walnut Bottom Road, Shippensburg, Cumberland County, Pennsylvania. 3. The only known relatives of the alleged incapacitated person are: ao bo Co Frances Dingier - Daughter 3305 Hutchinson Road, Apartment 17102 Cummings, Georgia 30040 Suzette Sachs - Granddaughter 982 Williamson Lane Snellville, Georgia 30078 Micci Naegele - Granddaughter 6845 Wood Spring Way Cummings, Georgia 30040 Mildred Lawler has, for at least three (3) months, been incapable of managing and caring for herself and her financial affairs. 5. Mildred Lawler exhibits symptoms of mental incapacity, including but not limited to bipolar disorder, mixed dementia, Alzheimer's type. A copy of a letter from Ali Ahmed, M.D., Staff Psychiatrist for Holly Spirit Hospital dated March 13, 2002 is attached hereto marked as Exhibit "A", and incorporated herein by reference. 6. Mildred Lawler's mental incapacity prevents her from managing and caring for the affairs of her person and estate. 7. The alleged incapacitated person, Mildred Lawler, had resided at Outlook Pointe Assisted Living in Shippensburg from December 5, 2001 to March 6, 2002 when her behavior escalated to the point that Outlook Pointe could no longer take care of her due to: a. b. C. d. Her making threats of wanting to die; Her being extremely agitated and confused; Her refusing to eat; and Her refusing to accept assistance with her care. 8. On or about March 6, 2002, Mildred Lawler was transported by a representative of the Area Agency on Aging, in and for Cumberland County, Pennsylvania from Outlook Pointe to Carlisle Hospital and, while on the way, she attempted to unlock the door, was pulling on her seat belt and stated that she wanted to die. 9. While at the emergency room at Carlisle Regional Medical Center, she agreed to inpatient treatment at Holy Spirit Hospital where she was subsequently transported. 10. While at Holy Spirit Hospital, she was examined by Ali Ahmed, M.D., the Staff Psychiatrist for Holy Spirit Hospital. 11. On or about March 13, 2002, the Petitioner was notified by Holy Spirit Hospital that Mildred Lawler was ready for discharge and that her level of care indicated that she was now nursing home appropriate. 12. Subsequently, the Petitioner contacted ManorCare, a nursing home facility, in Carlisle and was advised that ManorCare was willing to accept her as a resident of that facility contingent upon a Guardian being appointed for her. 13. Holy Spirit Hospital has advised the Petitioner that it can no longer keep Mildred Lawler as a patient at their facility. 14. Mildred Lawler has a daughter by the name of Frances Dingler who has a number of difficulties which prevent her from being able to take care of herself let alone caring for her mother. 15. The Petitioner believes and therefore, avers that Frances Dingler moved from Pennsylvania to the state of Georgia where her daughters reside after her mothers latest admission to the hospital. 16. Petitioner believes and, therefore avers that neither Frances Dingler nor the two (2) granddaughters are willing or able to assume Guardianship of Mildred Lawler. 17. Discharge of Mildred Lawler by Holy Spirit Hospital shall place her in immediate and irreparable harm. 18. The Petitioner believes and, therefore, avers that Emergency Guardians of the Person and Estate of Mildred Lawler should be appointed. 19. Less restrictive alternatives are not available because there is no one able to care for her. 20. The Area Agency on Aging, in and for Cumberland County, Pennsylvania, is willing to accept the appointment of Emergency Guardians of the Person and Estate of Mildred Lawler. 21. No other Court has ever assumed jurisdiction in any proceeding to determine the incapacity of Mildred Lawler. 22. The failure to appoint the Petitioner as Emergency Guardians of the Person and Estate of Mildred Lawler will result in irreparable harm to the person and estate of Mildred Lawler. Whitman, Aging Care Manager II On Apri] 12, 2002, Permanent Guardianship of Person and Estate for Mildred Lawler was granted by Judge Kevin Hess to Cumberland County Office of Aging. Prior to this appointment Mildred resided at Outlook Pointe of 129 Walnut Bottom Road - Shippensburg, Pennsylvania. She was admitted to Manor Care of Carlisle on 3/20/02 after the outcome of an emergency Guardianship hearing. Mrs. Lawler has been diagnosed with depression, bi-po1ar disorder, hypertension, chronic obstructive pulmonary disease and Alzheimer's dementia with delusions, increased confusion, diabetes and urosepsis. Client continues to be incapacitated to the point she required hands on assistance with all her activities of daily living. She also requires 24 hour supervision and medical treatment provided by the nursing staff. During the past year client has resided in the Arcadia Unit which is the dementia unit at Manor Care. Mildred has the opportunity to participate in activities that are more appropriate to her dementia diagnosis. Mildred attends 4.5 activities a day on a regular basis. Mildred and her roommate get along very well and enjoy each other's company. Client continues to receive regular psychological therapy services from Summit Behavioral Health. Client is emotionally stable and displays no behavioral issues at this time. Presently, client is doing well. She likes the staff and is cooperative with her care. Mildred spends a part of each day sitting out at the nurses' station conversing with others and at times shows signs of great amusement. She has a good appetite and is on a total liquid diet which is honey thickened. This is due to her difficulty swallowing which has increased and she recently had a modified barium swallow test. Her meal intake is 25% but her weight remains stable. Celebrating 30 Years of Service to Cumberland County's Seniors 1973 - 2003 vl/ Mildred is visited every 30-60 days by care management staff. In addition to visiting client, they review the medical record and discuss Mrs. Lawler's condition with the nursing staff. All required care plan meetings are attended every 90 days. It is the request of the Cumberland County Office of Aging that the Agency retains Guardianship of Person and Estate for Mildred Lawler. Manor Care has demonstrated an adequate quality of care for client by managing her daily needs and continuously monitoring her medical conditions. Whitman, Aging Care Manager II On April 12, 2002, Permanent Guardianship of Person and Estate for Mildred Lawler was granted by Judge Kevin Hess to Cumberland County Office of Aging. Mrs. Lawler is incontinent of bowel and bladder and receives a moisture barrier after each incontinence episode. She also requires 24 hour supervision and medical treatment provided by the nursing staff. During the past year client has resided in the Arcadia Unit which is the dementia unit at Manor Care. Mildred has the opportunity to participate in activities that are more appropriate to her dementia diagnosis. Mildred attends 5.5 activities a day on a regular basis.
