THIS AGREEMENT made this day o 2013, by
and between Claypool III /Tiday, LLC, herein fter referred to as
Contractor,
AND
Joshua J. Dill and Brenda R. Dill, husband and wife, hereinafter
referred to as Owner, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot cf ground
situate in Middlesex Township, Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot 131,
Meadowbrook Farms, Phase VII, 8 Bellwood Court, Carlisle, PA 17013.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract of land situated in Middlesex Township, Cumberland
County, PA, being Lot No. 131, as shown on a plan entitled "Meadowbrook Farms,
Final Subdivision Plan, Phase VII", dated April 10, 2008 by PennTerra
Engineering, Inc. State College, PA recorded January 25, 2010 as instrument
number 201002071, bounded and described as follows:
BEGINNING at an iron pin being a northerly corner of Lot 130 and lying in a
southerly right of way line of Bellwood Court (50' R/W); thence along said right of
way North 80 degrees 04 minutes 40 seconds East 40.00 feet to an iron pin; thence
continuing along said right of way along a curve to the left having a chord bearing
of North 71 degrees 57 minutes 50 seconds East, a chord distance of 63.51 feet, a
radius of 225.00 feet, and an arc length of 63.73 feet to an iron pin lying along said
right of way and being a westerly corner of Lot 132; thence along said lot South 26
degrees 08 minutes 59 seconds East 181.99 feet to an iron pin being a southerly
corner of said lot and lying in a westerly line of Lot 133; thence along Lot 133 South
31 degrees 31 minutes 22 seconds West 70.76 feet to an iron pin being a
southwesterly corner of said lot and lying in a northerly line of Open Space; thence
along said Open Space South 72 degrees 35 minutes 34 seconds West 107.82 feet to
an iron pin lying in a northerly line of Open Space and being an easterly corner of
Lot 130; thence along Lot 130 North 09 degrees 55 minutes 20 seconds West 232.86
feet to an iron pin, being the Place of BEGINNING.
BEING part of the same premises which Mary Verdelli by her deed dated January
4, 1989 and recorded January 5, 1989 in the Office of the Recorder of Deeds in and
for Cumberland County in Deed Book T -33, Page 296, granted and conveyed unto
Pamay Development Co., Inc.
