STATEMENT OF CLAIM
1. This claim is filed by the Borough of Mechanicsburg, a borough
organized and existing in accordance with the laws of the
Commonwealth of Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and /or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. §
2231, as amended.
4. Plaintiff has made demands for payment for services; however,
Defendant(s) have not made payments for the services provided.
5. The authority under which this claim is filed is the Act of May 16, 1923
P.L. 207, Section 9, e t seq ., 53P.S. §7143, as amended.

6. A description of the property against which this claim is filed is:
439 S York Street

Pennsylvania 17055
TAX PARCEL NUMBER 20- 24- 0785 -414
7. This claim has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and /or
refuse charges.
8. The total amount of the charges for which this claim is filed is
one thousand thirty four dollars and eleven cents ($1034.11), plus costs
and reasonable attorney's fees.
9. The time period for which these charges are filed is October 1, 2011 to
March 31, 2013 on Sewer and Refuse Account 5569 -0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in its
favor and against the Defendant in the amount of one thousand thirty four dollars
and eleven cents ($1034.11), plus cost and reasonable attorney's fees.

That said party of the first part, for and in consideration of the sum
of ONE DOLLAR ($1.00) DOLLARS, lawful money of the United States of
America, well and truly paid by the said party of the second part to
the party of the first part, at and before the sealing and delivery of
these presents, the receipt whereof is hereby acknowledged, have
granted, bargained, sold, alien, enfeoff, released, conveyed and
confirmed unto the said party of the second part, her heirs and
assigns.
ALL THAT CERTAIN messuage or tract of land situate
in the Borough of Mechanicsburg, Cumberland
County, Pennsylvania, bounded and described as
follows, to wit:
BEGINNING at a post corner of York and Marble
Streets; thence north by said York Street seventy
(70) feet, four (4) inches to lot of Jacob Zinn;
thence east by said lot one hundred sixty -two
(162) feet six (6) inches to a twenty (20) foot
alley; thence south by said alley fifty -two (52)
feet, six (6) inches to Marble Street; thence west
by said Marble Street one hundred sixty -three
(163) feet to the place of BEGINNING.
HAVING thereon erected and now being a dwelling
house, 439 S. York Street, with necessary
outbuildings.

BEING the same lands and premises that A. Hilary
Payne Kelly conveyed by Deed dated April 9, 1996
and recorded in Deed Book 137, Page 860, hereby
granted and conveyed to A. Hilary Payne Kelly and
Michael R. Kelly, Grantors herein.
TOGETHER with all and singular the tenements, hereditament
and appurtenances to the same belonging, or in anywise appertaining,'
and the revision and reversions, remainder and remainders, rents,
issues and profits thereof: AND ALSO all the estate, right, title,
interest, property, claim and demand whatsoever, both in law and
equity, of the said party of the first part, of, in, to or out of the
said premises, and every part and parcel thereof.
TO HAVE AND TO HOLD the said premises, with all and singular
the appurtenances, unto the said party of the second part, her heirs
and assigns, to and for the only proper use and behoof of said party of
the second part, her heirs and assigns forever.
AND the said party of the first part, his successors and
assigns, does by these presents, covenant, grant and agree to and with
the said party of the second part, her heirs and assigns, that the said
party of the first part, its successors and assigns, all and singular
the hereditament and premises herein above described and granted, or
mentioned and intended so to be, with the appurtenances unto the said
party of the second part, her heirs and assigns, against the said party
of the first part, his successors and assigns, and against all and
every other person or persons, whomever, lawfully claiming or to claim
the same or any part thereof, shall and will, by these presents,
WARRANT AND FOREVER DEFEND.
