NOW COMES the Borough of Mechanicsburg Cumberland County,
Pennsylvania, by its attorney Lisa Marie Coyne, Esquire, and files the withi ink,
for charges assessed with respect to sewer and /or refuse rates against ab v o
named owner or owners and against the hereinafter described real estate as
follows:
STATEMENT OF CLAIM
1. This claim is filed by the Borough of Mechanicsburg, a borough
organized and existing in accordance with the laws of the
Commonwealth of Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and /or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. §
2231, as amended.
4. Plaintiff has made demands for payment for services; however,
Defendant(s) have not made payments for the services provided.
5. The authority under which this claim is filed is the Act of May 16, 1923
P.L. 207,. Section 9, et seq ., 53P.S. §7143, as amended. ^,

6. A description of the property against which this claim is filed is:

7. This claim has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and /or
refuse charges.
8. The total amount of the charges for which this claim is filed is one
thousand fifteen dollars and thirty cents ($1015.30), plus costs and
reasonable attorney's fees.
9. The time period for which these charges are filed is July 1, 2011 to
March 31, 2013 on Sewer and Refuse Account 2753 -0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in its
favor and against the Defendant in the amount of one thousand fifteen dollars
and thirty cents ($1015.30), plus cost and reasonable attorney's fees.

THIS INDENTURE, made this 1 7 day of 0e,VS7' 2009, between
JOANNA MILLER, EXECUTRIX FOR THE ESTATE OF CATHERINE MILLER, late
of the Borough of Mechanicsburg, Cumberland County, Pennsylvania, party of the
first part, Grantor
AND
JOANNA R. MILLER of Mechanicsburg, Pennsylvania, party of the second part,
Grantee
WITNESSETH:
WHEREAS, the said Catherine Miller a /k/a Catherine L. Miller a/k/a Cathryn L. Miller,
became in her lifetime seized, of and in certain tracts and parcels of land lying and being in the
Borough of Mechanicsburg, Cumberland County, Pennsylvania, which are more particularly
described hereafter; and being so thereof seized, Catherine Miller, a widow, died testate on
September 18, 2008. Letters Testamentary for the Estate of Catherine Miller were duly issued to
Joanna Miller by the Register of Wills of Cumberland County on October 27, 2008 to Estate No.
2208 - 01063.
NOW THIS INDENTURE WITNESSETH, that the said Grantor, for and in consideration of
the sum of ONE ($1.00) DOLLAR to her in hand paid by the said Grantee at or before the sealing
and delivery hereof, receipt whereof is hereby acknowledged, has granted, bargained, sold, aliened,
released and confirmed, and by these presents does grant, bargain, sell, alien, release and confirm
unto the said Grantee, her heirs and assigns,

ALL THAT CERTAIN tract or parcel of land, with the buildings thereon
erected, situate on the South side of East Marble Street in the Borough of
Mechanicsburg, County of Cumberland and State of Pennsylvania, and known as
Lot Number Fifteen on the Plan of Lots as laid out by Lamb and Coover, bounded
and described as follows, to wit:
BEGINNING at a point at the property line of said East Marble Street and
comer of Lot Number Fourteen as described on the said Plan of Lots hereinafter
described, now or late of R. Bruce Mowery; thence Esswardly along the said
property line Forty and One -Tenth (40.1) feet, more or less, to a point on line of
property formerly of Nesbit Heirs, now or late of Victor L. C. Hasskarl; thence
Southwardly along the line of property now or late of Victor L. C. Hasskad, One
Hundred Thirty -Eight and Eighty -Five One - Hundredths (138.85) feetto a point on the
line of Beech Alley; thence Westwardly along the line of said alley, Forty -Nine and
Five - Tenths (49.5) feet, more or less, to a point, the corner of said Lot Number
Fourteen, aforesaid, now or late of R. Bruce Mowery; thence Northwardly along the
line of Lot Number Fourteen, One Hundred Thirty -Eight and Fifty -Five One -
Hundredths (138.55) feet to said property line of East Marble Street, the place of
BEGINNING.
BEING Lot No. 15 on the Plan of Lamb and Coover, aforementioned, which
said Plan is recorded in the Cumberland County Recorder's Office, in Plan Book No.
1, Page 57.
BEING the same premises which Shannon M. Geiger, single woman, by her
Deed dated February 2, 2001 and recorded March 9, 2001, in the Recorder of Deeds
Office of Cumberland County, Pennsylvania in Deed Book 240, Page 742, granted
and conveyed unto Cathryn L. Miller a/k/a Catherine Miller a/k/a Catherine L. Miller.
THE said Catherine Miller died testate on September 18, 2008 and on
October 27, 2008, the Cumberland County Register of Wills granted Letters
Testamentary to Joanna Miller to Estate No. 2208 - 01063. Pursuant to Item IV of
Catherine Miller's Last Will and Testament, she devised her real estate to her
daughter, Joanna R. Miller.
TOGETHER with all and singular, the buildings, improvements, ways, streets, alleys,
passages, waters, water - courses, rights, liberties, privileges, hereditaments and appurtenances
whatsoever, thereunto belonging or in any wise appertaining and the reversions and remainders,
rents, issues and profits thereof, and all the estate, right, title, interest, property, claim and demand
whatsoever of her, the said Catherine Miller, at and immediately before the time of her decease, in
law, equity, or otherwise howsoever, of, in, to or out of the same.

TO HAVE AND TO HOLD the said lot or piece of ground above described, with the buildings
and improvements thereon erected, hereditaments and premises hereby granted or mentioned, and
intended so to be, with the appurtenances, unto the said Grantee, her heirs and assigns, to and for
the only proper use and behoof of the said Grantee, heirs and assigns, forever.
AND, the said Grantor, does covenant, promise and agree to and with the said Grantee, her
heirs and assigns, that she, the said Grantor, has not heretofore done, committed or knowingly or
willingly suffered to be done or committed any act, matter orthing whatsoever whereby the premises
hereby granted, or any part hereof, is, are, shall or may be impeached, charged, or encumbered in
title, charge, estate of otherwise howsoever.
IN WITNESS WHEREOF, the said Grantor has hereunto set her hand and seal, in her
fiduciary capacity as aforesaid, the day and year first above written.
