WHEREAS, Kanubhai Patel and Shilpa Patel of 2317 Forest Lane, Harrisburg, PA 17112, is
about to execute contemporaneously herewith, a contract, with Tiday Property Management,
LLC of 2 W. Mulberry Hill Rd., Carlisle, PA, for the erection of a building upon premises
commonly known as 7 Europeana Circle, Township East Pennsboro, Cumberland County,
Pennsylvania, as set forth in the deed dated 01/22/88, recorded at Deed Book D -33, Page
952 (part of), in the Recorder's Office for Cumberland County, Pennsylvania, as more
specifically described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, March 28, 2013, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor
to commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract with Contractor and the further consideration of One Dollar
($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the
building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen
or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly
waived.

ALL THAT CERTAIN piece or parcel of land situate in East Pennsboro Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point located on the southern right -of -way line of Europeana Circle cul -de -sac at
the dividing line between Lots F14 and F15 on the hereinafter referenced Plan; thence along the western
boundary line of Lot F 14, South 38 degrees 47 minutes 10 seconds West, a distance of 152.48 feet to a point
on the eastern boundary line of Lot F29, Phase I, Section 103 of Floribunda Heights; thence along the
eastern boundary line of Lots F29, F28 and F27, North 17 degrees 46 minutes 45 seconds West, a distance of
241.39 feet to a point at the southeast comer of Lot F26, Phase I, Section 103 of Floribunda Heights; thence
along the eastern boundary line of Lot F26, North 26 degrees 19 minutes 35 seconds East, a distance of
28.96 feet to a point at the southwest comer of Lot F16 on the hereinafter referenced plan; thence along the
southern line of Lot F16, South 62 degrees 25 minutes 55 seconds East, a distance of 161.74 feet to a point
on the southern right -of -way line of Europeana Circle; thence along Europeana Circle by a curve to the right,
having a radius of 50.00 feet and an arc length of 68.75 feet to a point, the point and place of BEGINNING.
BEING Lot F15 on the Final Subdivision Plan of Floribunda Heights, Phase I, Section 10.A and
recorded in the Cumberland County Recorder of Deeds Office at Instrument No. 200819929.
UNDER AND SUBJECT to a stormwater easement along the eastern boundary line as well as a
snow dump easement at the northeast comer of said lot.
ALSO UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions, encumbrances
and other matters of record or that which a physical inspection or survey of the premises would reveal.
