This is a civil action filed pursuant to 42 U.S.C. § 1983 by Plaintiff, Telly Royster, an inmate presently incarcerated by the Commonwealth of Pennsylvania, Department of Corrections ("the Department") at the State Correctional Institution at Camp Hill ("SCI-Camp Hill") for 1St Degree Murder. 2. The named Defendants are Sgt. Edward Ayers; CO John Britton; CO Clint Brosius; Unit Manager Chris Chambers; Sgt. Thomas Cook; Retired Superintendent Jeffrey Ditty; LPN Lisa Duncan; RN Evirta Gadsden; Lt. Brian Gardner; LPN Erica Gipe; RN Judith Hamovitz; LPN Mary Henderson; Deputy Superintendent Timothy Henry; RN Beth Herb; Lt. Plaintiffs Complaint appears to have been filed on April 3, 2013 and served by Sheriff on April 19, 2013. Factual Allegations 4. Plaintiff alleges that he has been diagnosed as suffering from severe migraines at least three times per week, lasting for several hours. See Complaint, T 6, 7. 5. When Plaintiff experiences a migraine, he avers that the established procedure is for him to notify a staff member, who then relays the information to the medical staff, who then delivers Plaintiff s migraine medication. Id. at TT 8-11. 6. Plaintiff contends that between March of 2011 and April of 2012 there were approximately 45 separate instances in which Plaintiff requested his migraine medication but did not receive it. Id. at 12. Plaintiff also seeks to name Prison Health Services and Corizon as Defendants in this action, though their inclusion as "people" is likely improper under 42 U.S.C. § 1983 and they are not represented by the undersigned DOC counsel. 2 7. Plaintiff further alleges that in April of 2012 Plaintiffs migraine medication order was modified— from "as needed" to "twice daily" — in retaliation for his complaints regarding undelivered medication. Id. at T 18. 8. Plaintiff additionally avers that the Defendants have been negligent towards his medical needs and have committed medical malpractice. Id. at T¶ 30- 34. 9. Plaintiff further contends that several Defendants are liable for damages pursuant to theories of respondeat superior or vicarious liability due to the supervisory nature of their positions. M. at¶ 35. Relief Requested 10. As relief, Plaintiff has requested declaratory relief, compensatory damages, punitive damages and an injunction. Id. at¶¶ 37-43. Demurrer 11. Pennsylvania Rule of Civil Procedure No. 1028(a)(4) provides that a preliminary objection may be filed for legal insufficiency of a pleading, i.e. demurrer. " 12. When ruling on a demurrer, a court may sustain the objections and dismiss the case only when such relief is clear and no doubt exists that the law will not permit a recovery. See Stone and Edwards Insurance Agency, Inc. v. Department of Insurance, 616 A.2d 1060, 1063 (Pa. Cmwlth. 1992). 3 13. A demurrer will not be sustained unless the face of the complaint shows that the law will not permit recovery, and any doubts should be resolved against sustaining the demurrer. Id. 14. In coming to such determination, the court must accept as true all well-pled allegations in the complaint and all inferences reasonably deduced therefrom. See Doxsey v. Commonwealth, 674 A.2d 1173, 1174 (Pa. Cmwlth. 1996). Preliminary Objection: Eighth Amendment Deliberate Indifference 15. To establish an Eighth Amendment claim for a denial of adequate medical care, an inmate must demonstrate deliberate indifference to a serious medical need on the part of the prison officials. Estelle v. Gamble, 429 U.S. 97, 104-106 (1976) ("It is only such indifference that can offend 'evolving standards of decency' in violation of the Eighth Amendment."). 16. Deliberate indifference exists "where the prison official: (1) knows of a prisoner's need for medical treatment but intentionally refuses to provide it; (2) delays necessary medical treatment based on a non-medical reason; or (3) prevents a prisoner from receiving needed or recommended medical treatment." Rouse v, Plantier, 182 F.3d 192.7 197 (3d Cir. 1999). 17. A mere difference of opinion between the prison's medical staff and the inmate as to the diagnosis and subsequent treatment that the inmate receives 4 does not establish a claim of deliberate indifference. Kretchmar v. Com., 831 A.2d 793 (Pa. Cmwlth. 2003); Farmer v. Carlson, 685 F. Supp. 1335, 1339 (M.D. Pa. 1988). Further, neither negligent misdiagnosis nor an inadvertent failure to provide care establishes a claim of deliberate indifference. Estelle, 429 U.S. at 105-106. 18. When assessing the sufficiency of an Eighth Amendment deliberate medical indifference claim, "[t]he key question . . . is whether [the defendant] provided plaintiff with some type of treatment, regardless of whether it is what plaintiff desires." Farmer v. Carlson, 685 F. Supp. 1335, 1339 (M.D. Pa. 1988) (quoting Lamb v. Maschner, 633 F. Supp. 351, 353 (D. Kan. 1986)). 19. Moreover, the Court of Appeals for the Third Circuit in Durmer v. O'Carroll, 991 F.2d 64, 69 (3d Cir. 1993), established that a non-physician defendant cannot be considered deliberately indifferent for failing to respond to an inmate's medical complaints when he is receiving treatment by the prison's medical staff. 20. The reasoning of Durmer is simple: if differences in opinion between two medical professionals cannot be a basis for an Eighth Amendment claim, then a medically, untrained corrections official cannot be found liable if he relies on the opinions of a medical professional. Id. at 69. 21. Likewise,, in Spruill v. Gillis, 372 F.3d 218, 236 (3d Cir. 2004), the court explained, "[i]f a prisoner is under the care of medical experts . . . a non- 5 medical prison official will generally be justified in believing that the prisoner is in capable hands." The court further concluded in Spruill that "absent a reason to believe (or actual knowledge) that prison doctors or their assistants are mistreating (or not treating) a prisoner, a non-medical prison official . . . will not be chargeable with the Eighth Amendment scienter requirement of deliberate indifference." Id. at 236. 22. Plaintiff alleges only that on approximately 45 dates during a time span of more than a year, his migraine medication was unusually delayed or not delivered. 23. Plaintiffs allegations amount to nothing more than a simple difference of opinion between the type of treatment he wished to receive, the and type and frequency of treatment that was offered by the prison medical staff; this is exactly the difference of opinion that fails to state a claim for an Eighth Amendment violation in Durmer. 24. Plaintiffs Complaint essentially admits that, but for the approximately 45 days within a year that his migraine medication was unusually delayed he typically received treatment as offered by the prison medical staff. 25. As such, Plaintiffs' allegations —that the treatment he was offered was not to his satisfaction — does not rise to the level of an Eighth Amendment violation and should be dismissed accordingly. 6 26. Additionally, many of the individuals named as Defendants in Plaintiffs Complaint, including Defendants Ayer, Britton, Brosius, Chambers, Cook, Ditty, Gardner, Henry, Kuzar, Law, Santucci, Shoop, Southers and Stum, are not medical professionals, and under Spruhill cannot be liable for an Eighth Amendment violation relative to deliberate medical indifference. Preliminary Objection; Retaliation 27. To prevail on a claim of retaliation, Plaintiffs must first prove that his conduct leading to the alleged retaliation was constitutionally protected. Rauser v. Horn, 241 F.3d330, 333 (3dCir. 2001). 28. Next, they must show that they suffered some adverse action from the prison officials. Id. Specifically, they must show that the adverse action which they allegedly suffered was "sufficient to deter a person of ordinary firmness from exercising his First Amendment rights." Allah v. Seiverling, 229 F.3d 220, 224-25 (3d Cir. 2000) (internal quotation and citation omitted). Finally, Plaintiffs must prove that there is a causal relationship between the exercise of their rights and the adverse action taken against them. Rauser, 214 F.3d at 333-334. 29. With regard to the third prong of the Rauser test, the Rauser court adopted the burden-shifting analysis as set forth in Mount Healthy Bd. of Ed. v. Doyle, 429 U.S. 274, 287 (1977), where the Supreme Court held that "the plaintiff bore the initial burden of proving that his constitutionally protected conduct was 'a 7 substantial or motivating factor' in the decision to discipline him. The burden then shifted to the defendant to prove by a preponderance of the evidence that it would have taken the same disciplinary action even in the absence of the protected activity."Rauser, 214 F.3d at 333. 30. In other words, Rauser held, that as to the third prong of the retaliation claim, "once a prisoner demonstrates that his exercise of a constitutional right was a substantial or motivating factor in the challenged decision, the prison officials may still prevail by proving that they would have made the same decision absent the protected conduct for reasons reasonably related to a legitimate penological interest." Id. at 334. 31. In establishing those elements of a retaliation claim, a plaintiff must produce more than "general attacks" upon the defendant's motivations. A plaintiff must produce "affirmative evidence" of retaliation from which a jury could find that he carried his burden of proving the requisite motive. See Crawford-El v. Britton, 523 U.S. 574, 600 (1998) (internal citations omitted). Because many inmates have a tendency to raise retaliation claims when they are confronted with disciplinary action, courts must examine prisoners' retaliation claims skeptically to avoid becoming entangled in every disciplinary action taken against an inmate. Cochran v. Morris, 73 F.3d 1310, 1317 (4h Cir. 1996). 8 32. In the instant matter, Plaintiff has produced only "general attacks" upon the Defendants' motivations with regard to the modification of his medication frequency. 33. Plaintiff alleges that Defendants retaliatorily modified his medication scheduled based upon his complaints regarding the delivery of his migraine medication, but Plaintiff has not established the third element of the Rauser test — that the alleged retaliatory conduct was motivated by his exercise of a constitutional right. 34. Plaintiff does not allege and cannot show that the modification of his medication frequency was motivated by anything other than the interest of his medical care. 35. As such, Plaintiffs claim of retaliation should be dismissed accordingly. Preliminary Objection: NeWhzence/Medical Malpractice 36. The Commonwealth and its employees acting within the scope of their duties enjoy sovereign and official immunity and are immune from suit except where the legislature specifically provides otherwise. See I Pa.C.S. § 2310. 37. The affirmative defense of sovereign immunity may be raised by preliminary objection in the nature of a demurrer where such defense "is apparent 9 on the face of the pleading..." Wurth v. City of Philadelphia, 584 A.2d 403, 407 (Pa. Cmwlth. 1990). 38. In other words, it must be apparent that the cause of action does not fall within one of the statutorily defined exceptions to immunity. Id. See also State Workman's Ins. Fund v. Caparo Real Estate Inc., 635 A.2d 705, 706 n. 2 (Pa. Cmwlth. 1993). 39. At 42 Pa.C.S. § 8522(b), the legislature specifically waived sovereign immunity for negligence claims in nine areas: (1) operation of any motor vehicle in the possession or control of a Commonwealth party; (2) acts of health care employees of Commonwealth agency medical facilities or institutions; (3) care, custody or control of personal property in the possession or control of Commonwealth parties; (4) dangerous condition of Commonwealth agency.real estate and sidewalks; (5) dangerous condition of highways under the jurisdiction of Commonwealth agency created by potholes or sinkholes or other similar conditions created by natural elements; (6) care, custody, or control of animals in the possession or control of a Commonwealth party; (7) sale of liquor at Pennsylvania Liquor stores; (8) acts of a member of the Pennsylvania military forces; and (9) administration, manufacture and use of toxoid or vaccine. See 42 Pa.C.S. § 8522(b). See also Faust v. Commonwealth Dept. of Revenue, 592 A.2d 835, 840, n. 7 (1991). 10 40. Plaintiff alleges that the named Defendants were negligent with regard to his medical care, and that medical malpractice was committed. 41. The closest exception which applies to Petitioner's claim is the exception relating to medical professional liability. See 42 Pa.C.S § 8522(b)(2). But, the medical professional liability exception to sovereign immunity only applies in cases where a medical professional causes the Petitioner's injuries. 42. In this case, with respect to many of the aforementioned non-medical Defendants, these individuals are not medical professionals, and the negligence claim against them should be dismissed. See Williams v. Syed, 782 A.2d 1090 (Pa. Cmwlth. 2001) (inmate failed to allege medical malpractice claim against prison superintendent). 43. With respect to the Defendants who are medical professionals, to the extent that they are medical professionals and the medical professional exception applies, Plaintiff still fails to state a claim of negligence against them. See id. at 1096 (prison health care administrator is properly classified as a health care employee within the meaning of the medical professional liability exception to sovereign immunity). 44. "[T]o state a prima facie cause of action for negligence, a plaintiff must allege (1) a legal duty or obligation to conform to a certain standard of conduct; (2) a failure to conform to that standard; (3) a reasonably close causal 11 connection between the conduct and resulting injury; and (4) actual damage or loss." See Id. at 1093-1094 (citing Wareham v. Jefifes, 564 A.2d 1314 (Pa. Cmwlth. 1989)). 45. Pro se litigants who choose to litigate in state court must adhere to Pennsylvania's "fact-pleading system of jurisprudence." Cimaszewski v. Board of Probation and Parole, 868 A.2d 416, 422 (Pa. 2005). 46. Petitioner's allegations are insufficient to state a claim of negligence by the medical professional Defendants particularly because Plaintiff fails to allege how they breached any duty owed to Plaintiff where he was being treated, albeit not to his satisfaction, and accordingly, any purported negligence claim against those Defendants should be dismissed. Preliminary Objection: Vicarious Liability/Respondeat Superior 47. To state a prima facie claim under the Civil Rights Statute, 42 U.S.C. § 1983, a plaintiff must allege a violation of rights secured by the United States Constitution and the laws of the United States, and he must show that the alleged deprivation was committed by a person acting under the color of state law. West v. Atkins, 487 U.S. 42, 48-57 (1988). 48. For Section 1983 claims, the allegations in the complaint must demonstrate that the defendant was personally involved in the conduct of which the plaintiff complains or that the defendant had actual knowledge of or acquiesced 12 in the commission of the wrong. See Rizzo v. Goode, 423 U.S. 362 (1976); Rode v. Dellarciprete, 845 F.2d 1195, 1207 (3d Cir. 1988); Hampton v. Holmesburg Prison Officials, 546 F.2d 1077, 1082 (3d Cir. 1976). 49, Liability cannot be premised on a theory of respondeat superior. Hampton, 546 F.2d at 1082. 50. Because the language of 42 U.S.C. § 1983 requires a causal relation between the conduct of the defendant and the plaintiffs constitutional deprivation, the doctrine of respondeat superior may not be used to impose liability against a government or supervisor solely by virtue of his position. Monell v. Department Of Social Services, 436 U.S. 658, 690-695 (1978). 51. Thus, to state a cause of action against a defendant in a civil rights action, a plaintiff must make some showing of personal involvement by the supervisory personnel. See Rizzo v. Goode, 423 U.S. 362 (1976). 52. The supervising official's misconduct cannot have been simply a failure to act, but the official must have played an "affirmative part" in the alleged misconduct. Chinchello, v. Fenton, 805 F.2d 126, 133 (3d Cir. 1986). 53. However,, the mere allegation that an official ignored a prisoner's letter of protest and request for an investigation of allegations made in the letter is insufficient to hold that official liable for the alleged violations. See, e.g., Garrido v. Coughlin, 716 F. Supp. 98, 100 (S.D.N.Y. June 27, 1989). 13 54. Likewise, a Defendant cannot be considered to have personal involvement in any alleged wrongdoing by virtue of upholding an appeal. See, e.g., Bey v. Pennsylvania Dept. of Corrections, 98 F.Supp.2d 650, 664 (E.D. Pa. 2000) (official who upheld decisions with respect to misconduct charges against a prisoner was not liable under Section 1983). 55. Plaintiff attempts to hold many of the Defendants liable based upon a theory of respondeat superior•, however, based upon the above-cited cases, such a theory of liability is prohibited in actions brought pursuant to Section 1983. 56. As such, Plaintiff's claims should be dismissed accordingly. Preliminary Obiection: Statute of Limitations 57. The Third Circuit held that Section 1983 actions brought in Pennsylvania are subject to Pennsylvania's two-year statute of limitations for personal injury actions. See 42 Pa. C.S. § 5524. 58. The statute of limitations begins to run when the cause of action accrues, and accrual of Section 1983 claims is governed by federal law. Long v. Board of Educ. of Philadelphia, 812 F. Supp. 525, 530 (E.D. Pa. 1993). 59. A civil rights action accrues when the plaintiff"knew or had reason to know of the injury that constitutes the basis of [the] action." Id. (quoting Sandutch v. Muroski, 684 F.2d 252, 254 (3d Cir. 1982)). 14 60. Plaintiff alleges violations beginning in March of 2011 and ending in April of 2012. See Complaint, 61. However, Plaintiff's Complaint was not filed until April of 2013. Id. 62. As such, any violations occurring beyond the two-year statute of limitations — that is, those violations alleged to have occurred between March of 2011 and April 3, 2011, should be dismissed as barred by the statute of limitations. 15 WHEREFORE, for the reasons cited above, the Defendants respectfully request that this Honorable Court dismiss the Plaintiff's complaint accordingly. In support of this removal, the defendants aver the following: 1. Attached as Exhibit "A" is a copy of the pro se complaint in this action, which originated in the Court of Common Pleas of Cumberland County, PA where the Plaintiff resides imprisoned as an inmate of the State Correctional Institution at Camp Hill (a/k/a SCI —Camp Hill). 2. Docket no. 13- 1731 reveals that plaintiff commenced this action in the Court of Common Pleas of Cumberland County against numerous defendants on or about April 3, 2013; however, proper service upon the moving defendants herein was never made. 3. The Plaintiffs certificate of service of the complaint in this matter is attached as Exhibit"B." 4. The defendant therefore avers that service of original process was not properly effected under the PA Rules of Civil Procedure'within the previous thirty (30) days or otherwise. 5. Pursuant to the provisions of 28 U.S.C. §1331, the United States district courts shall have original jurisdiction of all civil actions arising under the Constitution, laws, or treaties of the United States. 6. In his complaint (Exhibit "A"),the Plaintiff asserts that during his present incarceration he has been intentionally denied adequate and proper medical care, which is a claim sounding in a violation of his Eighth Amendment rights (the states may not subject a person to cruel and unusual punishment). 7. Pursuant to 28 U.S.C. §1441,this civil action is properly removable to the Middle District of Pennsylvania, which has jurisdiction over actions filed in the Court of Common Pleas of Cumberland County, PA, where such actions involve federal laws and questions. 8. All other parties (represented by Joseph Fulginiti, Esquire)consent to the removal of this civil action to the United States District Court. 9. Pursuant to 28 U.S.C. §1446(d),the moving defendant will promptly file a copy of this notice of removal with the Clerk of Courts of the Court of Common Pleas of Cumberland County, and will serve a copy of same on counsel all adverse parties. 1 PA Rule of Civil Procedure no.402 holds that original service of process within the Commonwealth of Pennsylvania must be made by the Sheriff by hand delivering the complaint to an authorized representative of the defendant.
