Brenneman, Cumberland County Assistant Solicitor, files this Petition for Rule For Judicial Sale, as follows: 1. Your Petitioner is the County of Cumberland through its Tax Claim Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S. §5860.101, et seq. 2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents as follows: a. Taxes upon which the property was exposed for sale: 2010, 2011 and 2012 Cumberland County, Library and Middlesex Township real estate taxes. 2010-11, 2011-12 and 2012-13 Cumberland Valley School District real estate taxes. Total amount of taxes, including penalty, interest, and cost as of date of tax sale: $677.63. b. Neither the owner, his, her, their, or its heirs, successors, assigns, or legal representatives, or any lien creditor, or his, her, their or its heirs, successors or legal representatives, or any other person interested, has caused discharge of tax claim or removal from tax sale. c. The property was exposed to public sale pursuant to 72 P.S. §5860.601 on: December 13, 2012. Petition for Judicial Sale(Parcel No. 21-04-0371-046 TR05677 Achenbach) Page 1 d. Before exposing the property to public sale the Bureau fixed the upset sale price, pursuant to 27 P.S. §5860.605, which upset price was $677.63. e. Your Petitioner, the Bureau, was unable to obtain a bid at the public sale sufficient to pay the said upset price. 3. Attached hereto, marked Exhibit "A," and incorporated herein by reference as if fully set forth herein, is a vehicle record abstract from the Pennsylvania Department of Transportation, Bureau of Motor Vehicles, referencing the mobile home by V.I.N. number TWINCGS12446 and owner as William T. & Nicole A. Achenbach. The tax parcel number of the property as recorded in the assessment office is 21-04-0371-046 TR005677 and owner as William & Nicole Achenbach. The property is situated in the Township of Middlesex, Cumberland County Pennsylvania, and is known as 57 Regency North. 4. The names and addresses of known parties holding tax and municipal claims, liens, mortgages, ground rents, charges and estates against the property are as follows: a. Cumberland County Tax Claim Bureau One Courthouse Square Carlisle, Pennsylvania 17013 Delinquent taxes as of April 1, 2013: $710.16 (Includes 2010, 2011 and 2012 county/municipal real estate taxes and 2010-11, 2011-12, and 2012-13 School real estate taxes). The last known address of the owner of the property as set forth in the assessment records of Cumberland County is: William & Nicole Achenbach, 57 Regency Woods North MHP, Carlisle, PA 17015. Certified correspondence sent to said address has been returned as unclaimed and unable to forward. Correspondence sent to an additional address obtained by the Bureau of 6405 Glenwood Street, Apt 6, Mechanicsburg, PA, 17050, has also been returned as return to sender, attempted — not known. The Bureau has made reasonable effort to locate the owner as evidenced by the Address verification form attached hereto as exhibit "B". In said effort, the Bureau has obtained another address for William at 73 Sunnyside Drive, Carlisle, i Petition for Judicial Sale(Parcel No. 21-04-0371-046 TRO5677 Achenbach) Page 3 PA 17015 and for Nicole at 10 Sycamore Dr., Mechanicsburg, PA 17050. Regular mail sent to William was not returned to the Bureau. No correspondence was sent to Nicole at the Sycamore Drive address. Because of the uncertainty of the addresses for the Respondents, your Petitioner requests that the Court's Rule to Show Cause be served upon William Achenbach, by personal service to said address and upon both William and Nicole Achenbach by publication of the advertisement hereto attached as Exhibit "C" once in the Cumberland Law Journal, and once in the Patriot News at least fifteen days prior to the rule returnable date, pursuant to PA R.C.P 430. 1 VHEREFORE, Your Petitioner prays your Honorable Court to grant a rule upon all interested parties, including those listed at paragraphs four and five of the within Petition; to show cause why a decree should not be made that the property be sold, freed a6d cleared of tax and municipal claims, liens, mortgages, charges and estates, except separately taxed ground rents, pursuant to Section 612 of the Real Estate Tax Sale Larv. 72 P.S. §5860.612(a).
