principal residence at 1331 Church Street, Carlisle, Mouroe Township.
Decedent, then 80 years of age, died October 28, 2004, at Cumber laud Crossings Retirement
Community, One LongsdorfWay, Carlisle, PA 17013.
Except as follows, decedent did not marry, was not divorced and did not have a child born or
adopted after execution of the will offered for probate; was not the victim of a killing and was never

LAST WILL AND TESTAMENT
OF
FLORENCE A. CLAIR
I, FLORENCE A. CLAIR, a legal resident of Allen, Cumberland COllllty, P -
sylvania, being of sound and disposing mind, memory and understanding, do hereby
make, publish and declare this as and for my Last Will and Testament, hereby
revoking all other wills and codicils heretofore made by me.
FIRST: I direct that all my just debts and funeral expenses, in-
cluding my grave marker, shall be paid from the assets of my estate as soon as
practicable after my decease.
SECOND: I devise and bequeath the residue of my estate, of every
nature and wherever situate, to my husband-, WILLIAM L. CLAIR, providing he shall
survive me by thirty (30) days. Should my husband, William L. Clair, predecease
me or die on or before the thirtieth day following my death, I devise and be-
queath the residue of my estate, of every nature and wherever situate, to my son
ROBERT L. CLAIR.
lliIRD: I direct that all taxes that may be assessed in consequenc
of my death, of whatever nature and by whatever jurisdiction imposed, shall be
paid from my residuary estate as a part of the expense of the administration of
my estate.
FOURlli : I nominate, constitute and appoint my husband, William L.
Clair, Executor of this my Last Will and Testament. In the event of the renun-
ciation, death, resignation, or inability to act for any reasos whatsoever of my
said husband, I nominate, constitute and appoint my son, Robert L. Clair, Execu-
tor of this my Last Will and Testament. I hereby relieve my Executor from the
necessity of posting security in connection with his duties as such in any juris
diction in which he or she may be called upon to act insofar as I am able by law
to do so.
IN WITNESS WHEREOF, I have hereunto set my hand and seal to this, my

make, publish and declare this as and for my Last Will and.Testarnent., hereby
revoking all other wills and codicils heretofore made by me.
FIRST: I direct that all my just debts and funernd expenses, in-
cluding my grave marker, shall be paid from the assets of my estate as soon as
practicable afterroy decease.
SECOND : I devise and bequeath the residue of my estate, of every
nature and wherever situate, to my husband, WILLIAM 1. CLAIR, providing he shall
survive me hy thirty (30) days. Should my husband, William L. Clair, predecease
me or die on or hefore the thirtieth day fOllowing my death, 1 devise and he-
queath the residue of my estate, of every nature and wherever situate, to my son
ROBERT L. CLAIR.
THIRD: I direct that all taxes that may be assessed in consequenc
of my death, of whatever nature and by whatever jurisdiction imposed, shall be
paid from my residuary esta.te as a part of the expense. of the administration of
my estate.
FOURTH: I nominate, constitute and appoint my husband, William 1.
Clair, Executor of this my Last Will and Testament. In the event of the renun-
ciation, death, resignation, or inability to act for any reasos whatsoever of my
said husband, I nominate, constitute and appoint my son, Robert 1. Clair, Execu-
tor of this my Last Will and Testament. I hereby relieve my Executor from the
necessity of posting security in connection with his duties as such in any juris

DEFINITION OF MARKET VALUE: The most probable price which a property should bring in a competitive and open market

affected by undue stimulus. Implicit in this definition is the consummation of a sale as of a specified date and the passing of title from
seller to buyer under conditions whereby: (1) buyer and seUer are typically motivated; (2) both parties are well informed or well advised,
and each acting in what he considers his own best interest; (3) a reasonable lime is allowed for exposure in the open market; (4) payment
is made in terms of cash in U.S. dollars or in terms of financial arrangements comparable thereto; and (5) the price represents the normal
consideration for the property sold unaffected by special or creative financing or sales concessions* granted by anyone associated with the
sale.
*Adjustments to the comparables must be made for special or creative financing or sales concessions. No adjustments are necessary for

CONTINGENT AND LIMITING CONDITIONS: The appraiser's certification that appears In the appraisal report is subject to the
following conditions:
1. The appraiser will not be responsible for matters of a legal nature that affect either the property being appraised or the title to it. The
appraiser assumes that the title is good and marketable and, therefore, will not render any opinions about the title. The property is appraised
on the basis of it being under responsible ownership.
2. The appraiser has provided a sketch in the appraisal report to show approximate dimensions of the improvements and the sketch is
included only to assist the reader of the report in visualizing the property and understanding the appraiser's determination of its size.
3. The appraiser has examined the available flood maps that are provided by the Federal Emergency Management Agency (or other data
sources) and has noted in the appraisal report whether the subject site is located in an identified Special Flood Hazard Area. Because the
appraiser is not a surveyor, he or she makes no guarantees, express or implied, regarding this determination.
4. The appraiser will not give testimony or appear in court because he or she made an appraisal of the property in question, unless specific
arrangements to do so have been made beforehand.
5. The appraiser has estimated the value of the land in the cost approach at its highest and best use and the improvements at their

4. t have no present or prospective interest in the property that is the subject to this report, and I have no present or prospective personal
interest or bias with respect to the participants in the transaction. I did not base, either partially or completely, my analysis andfor the
estimate of market value in the appraisal report on the race, color, religion, sex, handicap, familial status, or national origin of either the
prospective owners or occupants of the subject property or of the present owners or occupants of the properties in the vicinity of the
subject property.
5. I have no present or contemplated future interest in the subject property, and neither my current or future employment nor my
compensation for performing this appraisal is contingent on the appraised value of the property.
6. I was not required to report a predetermined value or direction in value that favors the cause of the client or any related party,
the amount of the value estimate, the allainmenl of a specific result, or the occurrence of a subsequent event in order to receive my
compensation and/or employment for performing the appraisal. I did not base the appraisal report on a requested minimum valuation, a
specific valuation, or the need to approve a specific mortgage loan.
7. I performed this appraisal in conformity with the Uniform Standards of Professional Appraisal Practice that were adopted and
promulgated by the Appraisal Standards Board of The Appraisal Foundation and that were in place as of the effective date of this appraisal,
with the exception of the departure provision of those Standards, which does not apply. I acknowledge that an estimate of a reasonable
time for exposure in the open market is a condition in the definition of market value and the estimate I developed is consistent with the
marketing time noted in the neighborhood section of this report, unless I have otherwise stated in the reconciliation section.
8. I have personally inspected the interior and exterior areas of the subject property and the exterior of all properties listed as comparables
in the appraisal report. I further certify that I have noted any apparent or known adverse conditions in the subject improvements, on the
subject site, or on any site within the immediate vicinity of the subject property of which I am aware and have made adjustments for these
adverse conditions in my analysis of the property value to the extent that I had market evidence to support them. I have also commented
about the effect of the adverse conditions on the marketability of the subject property.
9. I personally prepared all conclusions and opinions about the real estate that were set forth in the appraisal report. If I relied on
significant professional assistance from any individual or individuals in the performance of the appraisal or the preparation of the appraisal
report, I have named such individuat(s) and disclosed the specifiC tasks performed by them in the reconciliation section of this appraisal
report. I certify that any individual so named is qualified to perform the tasks. I have not authorized anyone to make a change to any item in
the report: therefore, if an unauthorized change is made to the appraisal report, I will take no responsibility for it.

First and Final Account and Statement of Proposed Distribution of Robert L. Clair, Executor of the
Estate of Florence A. Clair, late of Monroe Township, Cumberland County, Pennsylvania, have been
filed and advertised in accordance with law and rules of Court and the same have been confirmed
by the Orphans' Court ofCumber\and County, Pennsylvania, on June 21, 2005, and it appearing that
said Executor, Robert L. Clair in his Statement of Proposed Distribution claims the distribution of
the real estate in kind to Robert L. Clair, it is ordered, adjudged and decreed that the hereinafter
described real estate is hereby awarded to Robert L. Clair and his assigns:

ALL THAT CERTAIN tract of land situate in Momoe Township, Cumberland
County, Pennsylvania, more particularly described as follows:
BEGINNING at a pin located on the public road leading from Churchtown to Boiling
Springs; thence by lands now or formerly of Mildred Sheaffer, South 59 degrees 5
minutes East 80 feet to a pin; thence along lands now or formerly of Blain L.
Wickard, et ux, South 42 degrees 5 minutes West 60 feet to a pin; thence by lands of
the same, North 59 degrees 5 minutes West 114 feet to a point in the center line of
the public road leading from Churchtown to Boiling Springs; thence along the center
line of said public road North 63 degrees 30 minutes East 44.1 feet to a point in the
center of said public road; thence South 25 degrees East 16.5 feet to an iron pin on
the Southern boundary of the said public road leading from Churchtown to Boiling
Springs; thence North 43 degrees 30 minutes East 34.4 feet to an iron pin located in
the same public road leading from Churchtown to Boiling Springs and being the
place of BEGINNING
CONTAINING .13 acre, more or less.
BEING the same premises which Bessie M. Dunkleberger, widow, by Deed dated
August 10, 1977, and recorded in Cumberland County, PA, Deed Book "I" Volume
27, Page 765, granted and conveyed unto William L. Clair and Florence A. Clair, his
wife. William L. Clair died May 27,2001. The said Florence A. Clair having died
