MURDOCH, III, presently residing at Country .Meadows, Suite 37, 355 South Sporting Hill Road Mechanicsburg, Pennsylvania 17055, being of full age and of sound and disposing mind and memory and not under any restraint, do hereby make, acknowledge, publish and declare this to be my Last Will and Testament, hereby revoking any and all Wills and Codicils heretofore made by me. ITEM I - I direct that my just debts, funeral and burial expenses, and the expenses of my last illness, claims for which are presented in the manner and within the time provided by law, be paid out of the assets of my estate or the income therefrom, as soon after my death as may be practicable. ITEM II - I hereby direct that all estate, inheritance, transfer and succession rexes, including i. nterest and penalties thereon, which shall be lawfully assessed by reason of my death against my estate; against any succession thereto; against the proceeds of any life insurance policy or policies, upon my life which may be payable to any one or more of the primary or contingent beneficiaries of this, my Last Will; or against any and all real or personal property in which I may have any interest during my lifetime and which shall pass by virtue of the contract or manner of holding the same to any co-owner as my survivor, if such survivor is a primary or contingent beneficiary of this Will, be paid as a debt or debts of my estate without reimbursement therefore being requested from such devisee, legatee, or beneficiary; provided, however, that if any such devisee, legatee, or beneficiary shall contest this Will, then any such taxes levied or assessed upon any property received by such person, either from my estate or otherwise, shall not be paid as aforesaid, and if paid by my representative or representatives, reimbursement therefore shall be required from the devisee, legatee or beneficiary and all provisions for such person hereinafter made shall lapse and be void as if such person had predeceased me leaving no descendents or heirs. ITEM III - I give in fee simple the real property that I own and used as my home, prior to me moving to the Country Meadows, located at 44 Kensington Drive, Camp Hill, Pennsylvania, along with the furnishings contained in said property, to my grandson, DAVID MICHAEL MURDOCH. ITEM IV - In addition to the gift set forth in Item III above, I give, devise and bequeath the sum of Ten Thousand dollars ($10,000.00) to to my grandson, DAVID MICHAEL MURDOCH. ITEM V - I give, devise and bequeath the sum of Ten Thousand dollars ($10,000.00) to the First United Methodist Church, Frederick and Simpson Streets, Mechanicsburg, Pennsylvania. ITEM VI - I give, devise and bequeath the sum of Ten Thousand dollars ($10,000.00) to Washington and Jefferson College, Washington, Pennsylvania. ITEM VII - I may leave a written statement or list in my safe deposit box disposing of certain items of my tangible personal property not otherwise specifically disposed of herein. Any such statement or list in existence at the time of my death shall be 2 determinative with respect to all items bequeathed therein. If no written statement or list is found in my safe deposit box or elsewhere and properly identified by the Executor within thirty (30) days after the probate of my Will, it shall be presumed that there is no such statement or list; any subsequently discovered statement or list shall be ignored. ITEM VIII - I give, devise and bequeath all the rest, residue and remainder of my estate, both real and personal, of every kind and nature whatsoever and wheresoever situated, which I may own or have the right to dispose of or to appoint at the time of my death to my son, DAVID MCCUNE MURDOCH currently residing in Lebanon, Pennsylvania. Should my son predecease me or die on or before the thirtieth day following my death, I devise and bequeath his share of my estate as follows: (1.) Fifty (50%) percent of my said Estate to my daughter in law BRENDA MURDOCH, currently residing in Lebanon, Pennsylvania. (2.) Fifty (50%) percent of my said Estate to my grandson DAVID MICHAEL MURDOCH, currently residing in Camp Hill, Pennsylvania. In the event BRENDA MURDOCH or DAVID MICHAEL MURDOCH predecease me or die on or before the thirtieth day following my death, I devise and bequeath her or his share of my estate to the survivor. ITEM IX - All estate, inheritance and other death taxes and any interest and penalties thereon imposed by reason of my death on property passing under my will and on 3 gifts made by me during my lifetime shall be paid out of the principal of my residuary estate, without apportionment or reimbursement. ITEM X - I make, nominate, and appoint my son, DAVID MCCUNE MURDOCH, as the Executor of this my Last Will and Testament. In the event that he shall refuse or for any mason whatsoever not accept this trust, or having accepted shall for any reason fail to complete the same, then I make, nominate, and appoint PNC BANK to act in the role of Executor. I direct and request that if my son, DAVID MCCUNE MURDOCH shall serve as my Executor, he shall not be required to give any bond or other security.
