DeLuca, Esquire who represents and avers as follows: 1. The Petitioner is Cumberland County Aging and Community Services, in and for Cumberland County, Pennsylvania, with its office located at 1100 Claremont Road, Carlisle, Cumberland County, Pennsylvania. 2. Nobue Sheller, currently resides at Golden Living Center-West Shore, 770 Popular Church Road, Camp Hill, Cumberland County, Pennsylvania. 3. On January 20, 2012, a Petition for the Appointment of Permanent Plenary Guardians of the Person and Estate of Nobue Sheller was filed in the Orphan's Court Division of the Court of Common Pleas, in and for Cumberland County, Pennsylvania to No.21-12-0085 and on March 1, 2012, after a hearing, Nobue Sheller was adjudicated to be an incapacitated person and Cumberland County Aging and Community Services was appointed Permanent Plenary Guardians of the Person and Estate of Nobue Sheller. A copy of the Final Decree dated March 1,2012 is attached hereto, marked as Exhibit"A", and incorporated herein by reference. 4. Prior to moving to Golden Living Center-West Shore, Nobue Sheller resided at 2056 Spring Road, Carlisle, Cumberland County, Pennsylvania. 5. Public records reflect that Nobue Sheller is the owner of the property at 2056 Spring Road, Carlisle, Pennsylvania. A copy of said Deed is attached hereto, marked as Exhibit "B", and incorporated herein by reference. 6. On or about May 30,2012,North Middleton Township filed a Petition for Relief to No. 21-12-0085 and, in it's Petition,North Middleton Township alleged that the structure which consisted of her home at 2056 Spring Road, Carlisle, Pennsylvania contained severe building code deficiencies under the International Residential Code and the Uniform Construction Code, which deficiencies resulted in the property being declared unsafe for human occupancy. 7. On June 27, 2012, an Order of Court was entered regarding the Petition for Relief which authorized North Middleton Township to demonish and raze the structure located on the property of Nobue Sheller located at 2056 Spring Road, Carlisle, Pennsylvania. A copy of the Order of Court dated June 27, 2012 is attached hereto, marked as Exhibit "C", and incorporated herein by reference. 8. The Cumberland County Tax Assessment for 2056 Spring Road, Carlisle, identified as Parcels No. 29-16-1094-027, 028, and 031A reflects three (3) parcels of r land assessed as follows: Parcel 27-Land $42,700.00; Parcel 28-Land $28,900.00; Parcel 31 A-Land $13,200.00. A copy of the assessments are attached hereto, marked as Exhibit "D", and incorporated herein by reference. 9. An appraisal of said property was conducted on January 2, 2013 by Diversified Appraisal Services of 36 East High Street, Carlisle, Cumberland County, Pennsylvania and the fair market value was determined to be $47,000.00. A copy of the appraisal is attached hereto, marked as Exhibit "E", and incorporated herein by reference. 10. The Petitioner believes and, therefore, avers that there are presently no mortgages or judgments recorded against said premises. 11. Cumberland County Aging and Community Services, the appointed Permanent Plenary Guardian of the Person and Estate of Nobue Sheller believes and, therefore, avers that the sale of said real estate is in the best interest of the Estate of Nobue Sheller and that the proceeds from said sale will be needed to pay for her continuing care at Golden Living Center-West Shore. 12. The Petitioner will engage the services of a realtor to sell the property. 13. Mark F. Bayley, Esquire, the attorney who represented Nobue Sheller in the prior Guardianship Hearing, has been advised that Cumberland County Aging and Community Services would petition the Court to sell said real estate and Attorney Mark Bayley advised that Nobue Sheller has had a continuing objection to anything relating to her home and such objection should continue. WHEREFORE, the Petitioner respectfully requests that this Honorable Court enter an Order directing the sale of 2056 Spring Road, Carlisle, Cumberland County, Pennsylvania(Parcel No.: 29-16-1094-027, 028, and 031A ) owned by Nobue Sheller, "AS IS — WHERE IS" with all faults and current conditions to an appropriate buyer and that Petitioner be authorized to execute any and all documents relating to the sale by signing as Guardian of the Person and Estate of Nobue Sheller. Section 5513, and following a hearing at which she was represented by court appointed counsel,Mark F. Bayley, Esquire, and at which evidence was presented by the Petitioner in support of the Petition, and, based upon the foregoing,the Court finds: 1. That Nobue Sheller is an incapacitated person in that she suffers from a mental impairment that prevents her from receiving and evaluating information effectively and prevents her from formulating and communicating decisions to such a significant extent that she is unable to manage her financial affairs or meet essential requirements for her physical health and safety on a daily basis, and is adjudicated as such. 2.
